The Spokane County Auditor race is an “open” seat, as longtime Democrat Vicky Dalton is retiring after serving in the position since 1999. Spokane County ranks 4th among Washington’s 39 counties by population and voters, with about 566,000 residents and approximately 375,433 registered voters.

Cathcart is a member of the Spokane City Council, first elected in 2019 and re-elected in 2023, where he currently serves on several committees, including as the Vice Chair of the Public Safety & Community Health Committee.

Cathcart has a public reputation as a budget hawk on the City Council, frequently focusing on spending details, opposing tax increases, and pushing for greater transparency in city finances. Cathcart supporters highlight his thorough review of the city budgets as a qualification for the County Auditor role, which includes financial oversight of the county’s roughly $1 billion budget.

It also means getting the basics right, from paying our county workers accurately and on time to recording property deeds and processing marriage licenses accurately to issuing vehicle registration and transferring vehicle titles efficiently.”

“Over 30 years ago, Congress made clear that States cannot put illegal aliens before our Nation’s own citizens,” said Associate Attorney General Stanley E. Woodward, Jr. “By granting illegal aliens in-state tuition, Washington, Oregon, New Mexico, and Arizona are pushing citizens to the side and ignoring federal law. No more. As of today, we have now sued 21 states that we allege were thwarting Congress’s clear prohibition on placing aliens over citizens. Our efforts will not cease until President Trump’s promise is fulfilled: illegal aliens will not receive benefits denied to American citizens.”

“This is a simple matter of federal law: colleges cannot provide benefits to illegal aliens that they do not provide to U.S. citizens,” said Assistant Attorney General Brett A. Shumate of the Justice Department’s Civil Division. “This Department of Justice will not tolerate American students being treated like second-class citizens in their own country.”

In the complaints, the United States seeks to enjoin enforcement of Arizona, New Mexico, Oregon, and Washington laws and regulations that require colleges and universities to provide in-state tuition rates for all aliens who maintain in-state residency, regardless of whether those aliens are lawfully present in the United States. Additionally, the complaint seeks to enjoin Arizona, New Mexico, Oregon, and Washington from enforcing their state laws and regulations that afford financial assistance and scholarships to illegal aliens.

Resident tuition at the University of Washington for 2026-2027 is listed at $13,406 against $44,460 for nonresidents. Western Washington University charges residents $8,808 and nonresidents $27,717. Evergreen charges $8,643 compared to $32,805, and Washington State University charges $6,349 against $15,185.

An illegal immigrant who signs the affidavit pays the lower number. A citizen from Boise or Portland pays the higher one.

“Sections 28B.15.012, 28B.15.067, and 28B.15.100 reward illegal aliens with eligibility for these resident tuition benefits in Washington while denying that same benefit to U.S. citizens who are not residents of Washington,” according to the WA complaint.

The Arizona complaint cites a report from AZ Center for Investigative Reporting, which estimated that more than 3,600 illegal aliens per year could qualify for in-state tuition under Arizona’s law in the years to come. The same report includes data from Arizona public universities and colleges showing that in the Fall 2025 semester, at least 720 illegal aliens had received in-state tuition, including 432 at Arizona State University. Given the roughly $24,000 difference in resident versus out-of-state tuition rates at Arizona State, our complaint alleges that just last year, illegal aliens received roughly $10.5 million in reduced tuition at ASU alone.

Today’s four lawsuits bring the Department’s total to 21 lawsuits that challenge in-state tuition for illegal aliens. Under the leadership of Acting Attorney General Todd Blanche, the Department’s efforts have already delivered wins for the American people, as five similar lawsuits in Texas, Kentucky, Oklahoma, Nebraska, and Illinois have resulted in favorable orders permanently enjoining and declaring unconstitutional analogous laws that gave reduced tuition to illegal aliens, including an order from the Fifth Circuit.

Lawsuits against other states that similarly put illegal aliens ahead of U.S. citizens are pending across the country in Minnesota, Virginia, California, New Jersey, Kansas, Massachusetts, Rhode Island, Maryland, Colorado, New York, Connecticut, and Vermont.

Thank you DOJ for suing states over this. Taxes are already way too high! Taxpayers should not be paying tens of thousands of dollars per year per illegal to attend UW or any other state colleges. Estimates show that subsidy may cost taxpayers more than $30,000 per school year, per student, at UW alone. This never should have been state policy in the first place, and must end!

Duckworth, who has owned multiple software companies, said, “I was a skeptic; I am no longer a skeptic.” Frazier said, “It’s a fantastic tool...a fantastic program.”

Georgia SEB Executive Director James Mills said: “It was recommended for election directors and election workers who want to use it and look at it. We encourage you to use it.”

The investigators presented the WHY, HOW, and WHAT, including highlighting ELLY's ability to quickly help find and remedy issues such as registered voters in multiple states, at business addresses, or at vacant lots.

Findings include nearly 100,000 individuals who had moved out of GA yet remained registered there and were listed as active in their new state (duplicate registrations). 40,427 of those voters registered in the new state voted in their new state while still being on the voter roll in GA.

Other problems included nearly 43,000 deceased people on the rolls, over 2,500 non-citizens on the rolls, almost half of GA counties having more people registered to vote than the citizen voting-age population, and more than 10,000 duplicate registrations (people registered to vote more than once) in one GA county alone.

The ELLY free platform consolidates public records into an online, accessible dashboard, turning what previously took hours or days of manual work into a much faster, more streamlined, and more manageable process that identifies issues and, over time, helps election workers clean and maintain more accurate voter rolls.

ELLY works by aggregating publicly available data to support list maintenance without altering records or making decisions on its own. It draws on government sources including USPS National Change of Address (NCOA) and address validation records, property tax and classification data, obituaries and death notices, mapping and property databases, and cross-matching for out-of-county or out-of-state registrations.

This creates a clear dashboard that flags potential discrepancies—such as invalid or commercial addresses, undeliverable locations, permanent moves, or non-residential properties—for review by election officials or trained volunteers. Decisions remain with local auditors, clerks, and boards under applicable federal and state laws, like the National Voter Registration Act (NVRA).

The program currently covers voter rolls in approximately 45 states plus WA D.C., and is offered at no cost. This makes ELLY a valuable resource for states and county auditors, clerks, and elections workers seeking efficient, cost-effective ways to maintain accurate voter rolls. Resource-strapped offices gain a practical supplement that supports compliance and builds public confidence by managing on an exception basis, rather than through exhaustive manual searches.

“This is a resounding victory for Missouri voters and election integrity,” said RNC Chairman Joe Gruters. “The court rejected Democrats’ latest scheme to overturn lawful congressional maps and create chaos ahead of the election. Missouri’s maps were fairly enacted by the legislature, upheld in court, and used in this year’s primary election. Today’s ruling makes clear those maps will stand.”

The Circuit Court of Cole County Judge Daniel Green ruled that the state’s referendum process does not apply to congressional redistricting, allowing the new Republican-drawn boundaries—already used in the August primaries—to govern the November 2026 midterm elections. State Senator Rick Brattin won the Republican nomination in the redrawn District 5 with 45% of the vote in a crowded GOP six-candidate field. He will face incumbent Emanuel Cleaver.

While in the State Senate, Brattin has been a prominent supporter of stricter election security measures, sponsoring and voting for legislation requiring voter ID, supporting bans or restrictions on drop boxes and certain forms of mail-in voting, working to prohibit private funding of election offices (“Zuckerbucks”), and advocating for cleaner voter rolls and processes allowing citizens to trigger election audits/recounts. In 2022, he publicly stated that “there is no issue more pressing to our country than the integrity of our elections” and that Missouri should have “the strongest election laws in the country.”

The Aug 19 ruling upheld Secretary of State Denny Hoskins’ decision to block Dems referendum aimed at overturning Missouri’s new congressional map. On Aug 4, Hoskins rejected the referendum.

Democrats and progressive national activist groups have already spent more than $6 million trying to overturn Missouri’s maps in court, and lost.

This outcome is vital for Republicans seeking to retain their majority in the U.S. House. By protecting a map that shifts Missouri’s delegation from a 6-2 Republican edge to a projected 7-1 advantage, primarily by redrawing the Kansas City-based district long held by Democrat Emanuel Cleaver into a solidly Republican-leaning seat, the decision prevents last-minute chaos and preserves the will of the legislature and voters who have already participated under these lines. In a midterm environment where control of Congress hangs in the balance, every protected seat matters, and this ruling strengthens the GOP.

Plaintiff Richard von Glahn, longtime progressive activist and labor organizer in Missouri and executive director of People Not Politicians, immediately appealed the decision to the MO State Supreme Court. Yesterday, Chief Justice Brent Powell granted the request and issued an order setting an expedited briefing schedule and oral arguments for the case on Sept. 2.

The County Circuit Court ruling is a huge victory for Secretary of State Denny Hoskins, a strong advocate for the new map.

Hoskins said, “The Missouri First Map remains the law of the land.” That’s the name proponents have used to describe the redistricting plan aimed at ousting Cleaver from office.

Also Wednesday, Judge Green blocked a plan from the ballot known as the Respect Missouri Voters initiative. It would make it more difficult for the legislature to overturn voter-approved measures. Plaintiffs appealed that decision to the MO Court of Appeals, then the MO Supreme Court ordered the appeal transferred to itself.

Oral arguments in the case are also scheduled for Sept 2. A final decision for both cases is expected by the Sept 8 deadline for placing measures on the November 2026 ballot.

“I’m 2-for-2 today and still batting a thousand,” Hoskins said. “Federal law is very clear that the Missouri Constitution cannot be interpreted to strip the General Assembly of its authority to conduct redistricting of congressional maps. I do not believe the Founding Fathers intended to have a referendum on a congressional redistricting map, and I’m pleased that Judge Green is in agreement.”

Republican Missouri Gov. Mike Kehoe, celebrated Wednesday’s decision in a social media statement, calling Green’s decision a “quick, common-sense ruling.” “Missourians voted for candidates using this map in August, and they deserve the ability to elect those candidates in November,” he said.

Beyond Missouri, Republican-led states have steadily secured meaningful redistricting advantages for 2026 via mid-decade map revisions in response to the many population shifts and political realities since the 2020 elections.

Similar efforts in Texas, North Carolina, Ohio, Florida, Tennessee, Louisiana, and Alabama have collectively positioned the GOP for realistic gains of about 10 House seats overall, while Democratic counter-efforts have yielded far fewer net advantages (CA and UT).

These new mid-decade maps eliminate Democratic strongholds in key areas, create more efficient Republican vote distributions, and reflect stronger conservative leanings based on 2024 presidential results—giving Republicans a decisive edge heading into November.

Democrats have been redistricting (gerrymandering) states’ congressional maps for decades, maxing out their potential. E.g., New England Democrats control ALL 21 House seats spread across six states (not a single GOP representative). It is estimated that if both parties MAXXED OUT on gerrymandering, the U.S. Congress would end up with 262 Republicans to 173 Democrats.

Finally, Republicans are fighting back and it is paying off! The table below shows redistricting activity between the 2024 and 2026 elections as well as the current pre-redistricting U.S. House delegation in each state, and projected 2026 gains.

The current party breakdown in the House is 219 Republicans to 212 Democrats (including one Independent who caucuses with Republicans) with 4 vacant seats (special elections are ongoing or scheduled for some of them).

The latest Cook Political Report rates 211 seats as leaning Republican or likely R wins in November, to the Ds’ 205, leaving 18 toss-ups (14 held by the GOP and 4 by the Democrats. Most often, the party not holding the Presidency does better in midterm House elections, with a few exceptions, including Dems picking up seats in 1998 and the GOP in 2002. The GOP looks to add 2026 to the list…

These court victories are incredibly important, and the RNC deserves sincere thanks for its steadfast legal work all across the country.

Under Chairman Joe Gruters, the RNC continues to fight relentlessly to protect voters. This commitment to election integrity and competitive fairness not only safeguards Missouri’s contribution to the national majority but bolsters the broader Republican effort to maintain House control in 2026.

Great job intervening in the Missouri case alongside the National Republican Congressional Committee and state party allies to uphold the Constitution, reject frivolous legal maneuvers, and ensure that duly passed legislation stands.

The RNC is currently engaged in 170+ election integrity lawsuits across 37 states.

This includes a significant win last week! The RNC, working alongside Texas Attorney General Ken Paxton, successfully defended the state’s landmark 2021 election integrity law, SB1. The U.S. Fifth Circuit Court of Appeals reversed a lower-court injunction that had blocked key provisions of SB 1, including requirements for matching ID numbers on mail-in ballots and applications, rules governing voter assistance and upholding key protections against voter coercion and ballot harvesting. Paxton, described the ruling a major victory! This is the third win in a years-long fight by Paxton and the RNC to defend SB 1 and protect Texas elections.

Also, yesterday, the RNC appealed a district judge’s ruling to the Nebraska Supreme Court that upheld the validity of a state law allowing certain UOCAVA overseas voters to vote. The case involves a state law dating back to 2005 that allows U.S. citizens who have never resided in Nebraska but have a parent registered to vote in one NE county to register in that county. It would be a felony to register or vote in multiple states or counties.

The RNC argues the law “dilutes the votes of lawful Republican voters” and violates Article VI, Section 1 of the Nebraska Constitution, which defines a qualified voter as a U.S. citizen who “has resided within the state and the county and voting precinct for the terms provided by law.”

The NE case brings the total to eight similar ongoing RNC lawsuits filed so far, with one victory. On May 26, a Wake County Superior Court judge ruled in favor of the RNC, reaffirming that only individuals who have actually resided in North Carolina may vote there. That decision struck down North Carolina Board of Elections (NCSBE) practices allowing “never residents”—typically U.S. citizens born abroad whose parents previously lived in the state—to register and cast ballots, upholding the clear residency requirements in the state constitution.

The Let’s Go WA (LGW) initiative aims to eliminate that tax. However, at issue was not the merits of the tax itself but a short “Public Investment Impact Disclosure” (PIID) required by state law. Under RCW 29A.72.027, enacted by Democrats in 2022, the Attorney General gets to prepare a brief statement for certain ballot measures that repeal, levy, or modify taxes or fees in ways that affect state revenue. Their statement appears on the ballot between the measure’s description and the yes/no question.

For IP26-645, the AG’s office produced deceptive language stating that the measure “would decrease funding for public K-12 education, higher education (including universities and community colleges), and human services (primarily healthcare).”

Open-government activist Arthur West (totally unrelated to LGW), appearing pro se, challenged the PIID as “Unconstitutional” and “politically charged propaganda.” He sought to amend or remove it by making the legal argument that adding government-written language to a citizen initiative after voters signed the petitions necessary to place it on the ballot is unconstitutional. Lanese denied West’s requests. West says he will appeal.

But what elevated the hearing from routine election-law litigation into widespread controversy was Judge Lanese’s incredibly strange conduct and the very politically biased reasoning he offered from the bench.

Video clips circulated rapidly on social media and among political commentators. Many observers, including many respected lawyers and policy advisors who pushed back and contacted media outlets, described the judge’s demeanor as highly animated: raised voice, emphatic gestures, and what some critics called “screeching” or “flailing.”

Podcaster and former Fox TV Reporter Brandi Kruse said on social media: WILL WASHINGTON STATE MEDIA EVER F*CKING DO THEIR JOB AND CALL OUT THE UNHINGED JUDICIAL ACTIVISM GOING ON? WHO DO YOU WORK FOR??? “We’re supposed to believe this guy is a neutral arbitrator while using the sentence “continue the downward regressive spiral of the tax scheme in Washington state and ranting about people who don’t want to pay taxes?”

KVI Radio’s Ari Hoffman called it “the most blatantly biased display I have ever seen from a judge. Unhinged Judge Chris Lanese loses it and says that the Washington Democrats' biased language against the income tax repeal has to stay because otherwise people might actually vote to repeal it.”

Radio host and TV personality Jason Rantz said, “the process is rigged and system corrupt. The only way to overcome it is to turn out the vote in enormous numbers. These people don’t play by rules.”

LD 35 State Representative Travis Couture said on X, “The bias and illogical nature of how this judge dismisses the clear and obvious facts about the budget process and the initiative is nearly beyond explanation. Point blank, he came in with a political opinion and his mind already made up. You can’t cut what you haven’t spent, Judge.
It’s ridiculous lawfare against the citizens of Washington. True Soviet stuff going on here, and this is a true kangaroo court.”

What’s even more troubling is that the judge canceled the LGW legal challenge hearing, where their arguments were also supposed to be made yesterday.

LGW issued a Press Release: JUDGE ALLOWS UNRELATED, CITIZEN LITIGANT TO ARGUE LGW’S OBJECTIONS BEFORE DENYING REQUEST PIID REWRITE; and condemned the handling of its legal challenge after LGW’s attorneys were denied the opportunity to present the arguments they had prepared for the scheduled hearing.

Last month, LGW formally challenged the AG’s PIID for I-645, arguing that the government-written statement gives voters a misleading description of the initiative’s fiscal impact. LGW expected to make that case in court today; instead, according to LGW’s legal counsel, Judge Chris Lanese took up issues surrounding LGW’s challenge during a separate case brought by Arthur West.

During that proceeding, Judge Lanese claimed that because West was arguing a case generally about PIIDs, he was required to make a ruling on I-645’s PIID at that moment. West, who is not an attorney for LGW, is not affiliated with LGW and did not bring LGW’s challenge, offered his own personal arguments about the language of I-645’s PIID. Ultimately, LGW’s counsel was not permitted to argue the case because Judge Lanese threw out the PIID hearing, thus canceling the scheduled hearing in which LGW’s arguments would be made.

LGW’s counsel characterized the procedure as unprecedented and objected to having an unrelated, non-lawyer litigant effectively address arguments LGW’s own attorneys had prepared to make. Rather than subsequently allowing LGW’s scheduled arguments to proceed, the court concluded the matter without granting LGW’s requested rewrite.

“This was a disgraceful way to handle a case involving the information millions of Washington voters will see on their ballots,” said Brian Heywood, LGW founder. “We came prepared to make our case. We had attorneys ready to argue specifically why the Attorney General’s statement is misleading and fails the neutrality voters are entitled to expect. Instead, a civilian who does not represent us was invited to argue issues from our challenge, and then the court shut the door without giving our legal team the opportunity to argue the case for the people.”

Why we should not be surprised at any of this: Lanese previously spent years working at the WA State AG’s Office. His former boss is now Governor Ferguson; current AG staff include former colleagues who draft the very ballot language under review. Also, the judge’s political donation history is exclusively progressive. While none of these facts automatically disqualifies a judge, they amplify the perception problem when combined with his shameful courtroom performance now being seen worldwide on video.

The effort far surpassed the required threshold of 308,911 valid signatures needed to qualify the citizens’ initiative for the Nov 2026 ballot. It is even more impressive that the feat was accomplished in only 51 days!

In a press release, the WAGOP reinforced that the AG’s PIID misleads voters and distorts the original purpose of the disclosure requirement.

“The people’s initiative to repeal the Ferguson-Pedersen state income tax scheme does NOT ‘decrease funding for public K-12 education, higher education and human services.’ This is a false statement, designed to confuse voters. In the interest of all Washingtonians, we can’t allow these intentionally misleading ballot statements to continue,” said WAGOP Chairman Jim Walsh.

July 28, LGW, sponsors of Initiative IP26-645, sued in Thurston County Superior Court to formally challenge the AG’s PIID. LGW’s legal counsel argues that the AG’s disclosure misrepresents the impacts of repealing the income tax because a repeal would increase state funding in the current budget, rather than decrease it, as the AG suggests. Additionally, the PIID misstates the top three categories of state services funded by the general fund in the current state budget. The PIID as currently written is inaccurate and would mislead voters.

The PIID isn’t meant to speculate about what might happen down the road; it’s supposed to tell voters what a law actually does to the budget in the current budget. But this tax doesn’t start collecting until 2029. Not a single dollar has been collected yet, so it cannot decrease funding.

“You can’t cut money that doesn’t exist. The Attorney General’s PIID is not just misleading; it’s factually incorrect,” said Brian Heywood, founder of Let’s Go Washington. “I-645 does not decrease funding at all in the current budget cycle, in fact it increases funding by returning millions of taxpayer dollars that would’ve been spent setting up an income tax bureaucracy and defending an unconstitutional income tax against legal challenges.“

Brown’s office PIID states the measure “would decrease funding for public K-12 education, higher education (including universities and community colleges), and human services (primarily healthcare).”

The statement “must be corrected” because that is the only effect that the initiative would have on the current state budget, wrote Callie Castillo, attorney for LGW.

The initiative seeks to repeal the state’s newly enacted 9.9% tax on individual income above $1 million (created by Dems’ ESSB 6346) before it takes effect.

A parallel lawsuit filed July 24, 2026, by open-government activist Arthur West, also filed in Thurston County Superior Court, more broadly contests the constitutionality of the PIID statute itself as an improper government insertion into the citizen initiative process.

The cases are pending in Thurston County Superior Court, with a hearing in the West matter scheduled for August 7, 2026, and the LGW challenge subject to an expedited timeline; any superior court ruling can be appealed directly to the Washington Supreme Court.

Final ballot language must be settled before August 21, when materials for the November 3 election are finalized, creating a tight window for resolution.

Today, twelve Republican-led states asked the Supreme Court to stay a lower-court injunction blocking key parts of President Trump’s March 2026 election-integrity Executive Order 14399 ENSURING CITIZENSHIP VERIFICATION AND INTEGRITY IN FEDERAL ELECTIONS, joining a parallel emergency request the administration filed Monday. The E.O. directs the Department of Homeland Security to compile state-by-state citizenship lists of voting-age residents and instructs the U.S. Postal Service to adopt new rules limiting mail-ballot delivery to people on approved lists.

June 25, 2026, a federal judge in Massachusetts (California et al. v. Trump) blocked key EO provisions for 23 Democrat-led states and D.C. ahead of the midterms. There, Obama appointee Judge Indira Talwani held that Sections 2 (DHS citizenship lists) and 3 (USPS rulemaking on mail ballots) of the EO are ultra vires (beyond authority) and unconstitutional, and she enjoined federal agencies from implementing them in the 23 plaintiff states + D.C. for the 2026 elections. Then on Saturday, in a 2-1 decision, the 1st U.S. Circuit Court of Appeals denied the DOJ request to pause that ruling.

On Monday, the DOJ, via Solicitor General D. John Sauer, sought an immediate stay in Trump v. California, contending the district court acted too soon while agencies are still deliberating and that relief is needed so any rules can take effect in time for November. “The executive order is an intra-branch directive from the president to his subordinates — which, of its own force, does not change anything at all about elections in any state,” Sauer told the Supreme Court in the appeal. “It does not require the states to do (or refrain from doing) anything at all.”

In its appeal to the Supreme Court on Monday, the administration framed its executive order as “general policy guidance” and stressed that the Postal Service had not finalized any regulations. The administration asked for an immediate “administrative” order to put the lower court decisions on hold.

The 12 GOP intervenors—Alabama, Florida, Indiana, Kansas, Louisiana, Missouri, Montana, Nebraska, Oklahoma, South Carolina, South Dakota, and Texas—argue the challenge is premature, the injunction improperly halts non-self-executing directives, and are asking SCOTUS to restore key parts of the election integrity executive order that direct DHS to compile citizenship lists and USPS to adopt new mail-ballot security rules. The application is signed under Missouri Attorney General Catherine L. Hanaway. Louis J. Capozzi III, Solicitor General of Missouri, is the counsel of record.

The two emergency application filings target the same injunction in the same underlying lawsuit (California et al. v. Trump). The pending SCOTUS stay requests seek to lift it so the E.O. provisions (and the related USPS rulemaking) can proceed while the appeal continues. Both filings make overlapping standing and ripeness arguments and urge the Court to curb what they call a trend of preemptive injunctions against executive orders.

Justice Ketanji Brown Jackson has ordered the plaintiff states to respond to both applications by 4 p.m. EDT on Monday, August 3. After that filing, the Supreme Court is expected to rule promptly on the stay requests—potentially within days or a couple of weeks—given the midterm timeline and the administration’s argument that implementation steps must begin in early-to-mid August. A grant would allow the challenged provisions to proceed in the affected jurisdictions while the First Circuit appeal continues; a denial would keep the injunction in place for the 2026 election cycle.

Meanwhile, in a parallel related case, yesterday the US Court of Appeals for the DC Circuit upheld a lower court ruling, temporarily clearing the way for the E.O. and for USPS to keep working to advance its proposed election-mail rule.

A three-judge panel (Judges Millett, Wilkins, and Katsas) of the U.S. Court of Appeals for the D.C. Circuit affirmed the district court’s May 28, 2026 order denying a preliminary injunction sought by the DSCC and other Democrat Party entities against key parts of E.O. 14399 (on citizenship verification lists via federal databases and related Postal Service rules for mail ballots).

The D.C. Circuit ruling is a solid procedural win for the Trump administration. It keeps the door open for agencies to continue developing the citizenship lists and the USPS rulemaking process in the face of the Democrats’ lawsuits. However, it does not:

• Decide whether the executive order is lawful on the merits

• Lift the broader injunction that still blocks key parts of the order in 23 states + D.C. (the multi-state case now at the Supreme Court for a stay request)

• Create any final, binding USPS rule that states must follow

• Change the practical status quo for the 2026 midterms in any major way

The underlying district-court case continues; plaintiffs can try again for an injunction if concrete agency actions occur, and the bigger legal fights now are at SCOTUS.

Mail-in voting has exposed serious vulnerabilities that threaten the integrity of U.S. elections. Unlike in-person voting—with its real-time identity checks and immediate tabulation—mail-in ballots travel through unsecured channels where opportunities for fraud, manipulation, and error multiply over the course of the election season.

Until mail-in voting is banned, the E.O. and USPS rule is an improvement!

Of Note: Last month, in the 2026 presidential election, Colombia hand-counted 99.8% of its 25+ million ballots in under 3 hours. Very minimal mail-in voting. Paper ballots. Photo ID required. Counted on-site at the polling tables right in front of witnesses and party observers. Results basically done the same night. Let’s hope all the U.S. states can get back to this someday…

President Trump has floated the idea for over a year and announced the event June 30 on Truth Social, describing it as a “Truly Historic Event” that has never been done before. The RNC began laying the groundwork earlier this year, voting at its winter meeting in January to make the event possible by amending By-law procedures centered around quadrennial presidential nominating conventions.

Typically, the RNC has held National Conventions every 4 years exclusively during presidential election cycles. These conventions serve primarily to formally conduct party business, nominate the party’s presidential and vice-presidential candidates, adopt the party platform, etc.

This 2026 Republican Midterm Convention will not focus on any formal party business and will be held at the American Airlines Center Arena. The two-day gathering expects to have thousands of Republicans attending from all 50 states. The event will be more like a large rally and will amplify the administration’s record of achievements through speeches, personal stories, and high-profile appearances (including President Trump, VP J.D. Vance, and many 2026 candidates), reinforcing themes of economic opportunity and national security.

Local authorities in Dallas have been finalizing event and security plans amid a compressed timeline and planned Democrat protests. It marks the GOP’s first national convention in Dallas since 1984. “This convention will be a Trumpapalooza; President Trump will unite Republicans around our shared vision, build momentum, and deliver an incredible convention for our Party,” RNC Chair Joe Gruters said.

“The RNC’s decision to bring its first-ever midterm convention to Dallas is a tremendous honor,” said Dallas Mayor Eric Johnson. “Dallas has become America’s top destination for business, families, and major events. I look forward to welcoming my fellow Republicans from across the U.S. to Dallas this September. As Chairman of the Republican Mayors Association, I’m confident that this unprecedented convention will energize our party, strengthen the conservative movement, and help build momentum for a successful 2026 election.”

The convention is intended to rally the base, showcase Republican achievements and the America First agenda, energize voters ahead of the November midterms, boost turnout, and help candidates in House and Senate races as the party works to hold (or expand) its congressional majorities.

A primary focus will be on key Republican House and Senate races and emphasizing the importance of affordability, job growth, energy production, border security, and public safety. The event is also expected to feature workers, innovators, entrepreneurs, manufacturers, first responders, and job creators—and pairing policy with high-energy entertainment!

Locating the convention in Texas also places a spotlight on the state’s U.S. Senate race, with Republican nominee Ken Paxton. Paxton is the state attorney general who, with Trump’s backing, defeated longtime Sen. John Cornyn in a primary earlier this year.

The convention aims to present a clear, optimistic contrast to Democrat messaging just weeks before ballots go out for the November elections and may help make the difference for many important 2026 races and in keeping Republican majorities in Congress in 2027/28.

Tickets are limited and range from about $1,500 to $250,000 (depending on the state and the package). Access is controlled by the RNC and distributed through state Republican Party organizations. All attendees are subject to state and national vetting/approval. People interested in attending are encouraged to contact their respective state Republican parties.

In NAACP v. USPS, the panel said, Appellants have made a strong showing that they will likely succeed on two of their arguments. First, their proposed rule is likely neither constitutionally nor prudentially ripe for review ... Next, appellants have demonstrated irreparable harm on the ground that absent a stay, the district court's injunction 'will render [them] unable' to 'issue and implement a final rule in advance of the November 2026 general election.' ... Finally, on this record, any countervailing harm to appellee and the public does not outweigh appellants' success on the two 'most critical' stay factors.

Bill Essayli, first assistant U.S. attorney for the Central District of California, posted, “This ruling is a win for election integrity and would have significant implications for states like California that refuse to submit their voter rolls to verify compliance with federal election laws.”

This ruling breathes optimism into efforts backed by President Trump’s March 31, 2026, Executive Order 14399, which calls for robust safeguards to verify citizenship and secure federal ballots transmitted through the mail.

The Federal Government has a duty under Article II of the Constitution of the United States to enforce Federal law, which includes preventing violations of Federal criminal law and maintaining public confidence in elections. The President also has distinct authority over foreign affairs.

The right to vote in Federal elections is reserved exclusively for citizens of the United States under the Constitution and Federal law. Federal statutes explicitly prohibit non-citizens from registering to vote or voting in Federal elections and impose criminal penalties for violations. (18 U.S.C. 241; 18 U.S.C. 611; 18 U.S.C. 1015; and 52 U.S.C. 20511). The Social Security Administration (SSA) maintains records that, in conjunction with the Department of Homeland Security’s (DHS) Systematic Alien Verification for Entitlements (SAVE) program under 42 U.S.C. 1320b-7, can assist in verifying identity and Federal election voter eligibility.

To facilitate enforcement of federal law, reduce the risk of fraud, and protect the integrity of federal elections via the U.S. Mail, additional measures are necessary. The USPS proposal includes practical steps to improve safeguards, introducing enhancements such as serialized barcodes, official Election Mail logos, and automation-compatible envelopes that will allow tracking of mail-in ballots (like a package) and reduce vulnerabilities to fraud or mishandling.

By partnering with states through a new Federal Ballot Mail Portal, officials can submit updated U.S. Citizen Voter Lists to efficiently match outbound and return ballots, while preserving state authority over eligibility determinations.

These steps build directly on existing USPS infrastructure, fostering greater transparency without disrupting the flow of legitimate votes.

With the D.C. Circuit poised to hear arguments soon, a sense of hope pervades discussions around possible implementation for the 2027 elections. Legal observers note the court’s emphasis on the rule’s non-conflict with the 2021 NAACP settlement, suggesting a pathway for quick affirmation that prioritizes federal law enforcement and fraud prevention.

If expedited, briefing could wrap up in August–Sept 2026, with oral arguments possibly in Sept or Oct. A decision might arrive in late 2026. Further review (en banc rehearing or Supreme Court certiorari) could delay matters until 2027.

As the appeals process unfolds, Americans can feel better about a possible more secure mail-in voting landscape that helps limit fraud and irregularities while safeguarding access for eligible citizens. No rights are diminished—only strengthened through accountability and data-driven oversight.

If the D.C. Circuit upholds the USPS rule, future elections could mark a pivotal step toward more secure, more efficient, and more transparent mail-in elections.

However, in a parallel Massachusetts case (California v. Trump, D. Mass.), U.S. District Judge Indira Talwani ruled on June 25, 2026, that key provisions of EO 14399 are unconstitutional and Sections 2 & 3, which direct the creation of federal citizenship voter lists and empower the USPS to restrict mail-ballot delivery to only those on approved state lists are legally void for exceeding presidential authority and intruding on states’ constitutional power over elections.

The judge issued a targeted injunction blocking the implementation of these measures in the 23 plaintiff Democrat-led states (including WA State) for the November 2026 midterms. On July 7, she denied the government’s request for a stay pending appeal to the First Circuit (with only a brief administrative pause), keeping the block in place for now while the appeal proceeds.

Both cases create a likely patchwork outcome for the proposed USPS election-mail rule. The rule (and related EO provisions) remains blocked in the 23 Dem states + D.C., meaning USPS cannot enforce the new voter-list and barcode requirements there ahead of the 2026 midterms.

However, in the other roughly 27 states that did not sue, the administration can continue moving forward with implementation, finalizing the rule, and applying the new standards unless additional lawsuits or a nationwide injunction intervene. The split reinforces ongoing legal fragmentation, with the First Circuit appeal and the separate D.C. Circuit case (the NAACP settlement challenge) likely to determine how uniformly the rule applies nationwide.

This comes on the heels of President Trump’s July 16 prime-time address which renewed calls for ironclad election integrity and declassified documents showing widespread vulnerabilities in voting systems and foreign interference. Saying, “We still have a major challenge that must be urgently addressed, because no country can be great without fair and honest elections… Our system today falls catastrophically short of that standard.” And referencing the problems with mail-in voting, saying “Tens of millions of ballots flowing aimlessly through the mail…”

Also, it is important to remember, CHINA CREATED FAKE DRIVER’S LICENSES TO GET FRAUDULENT MAIL-IN BALLOTS FOR JOE BIDEN. This all reinforces the administration’s position that the USPS rule is a vital, common-sense step for free and fair elections.

Only very briefly did Sen. Gary Peters, (D-MI), the ranking member on the committee, appear for the hearing’s opening statements. He asked a few questions and then left. The hearing was chaired by Sen. Rand Paul, (R-KY).

The hearing focused on massive fraud in taxpayer-funded programs (e.g., Minnesota daycare centers), election fraud-related issues, and government waste.

Witnesses included Nick Shirley (independent journalist), James O’Keefe (CEO of O’Keefe Media Group), and Dylan Hedtler-Gaudette (VP of Policy and Government Affairs Project on Government Oversight).

James O’Keefe delivered powerful evidence of voter fraud and detailed examples of corrupt NGO’s and taxpayer-funded scams, saying: “Congress expressly criminalized payments for “registration to vote” in covered federal elections. Why? Because the vote is sacred, because it belongs to the citizen alone. It is an act of conscience, of judgment, and when it becomes contaminated by incentives – when it is for sale – it undermines the sanctity and fairness of the process to elect those who represent us - The question before this committee is not whether this fraud exists. The question is why the incentives allow it to flourish. There is money in fraud. There is no money in exposing the fraud. When laws are ignored without consequences, fraud becomes the incentive.”

O’Keefe documented some of his work in LA, where his team captured 28 instances of paid ballot harvesters offering cash, drugs, or other incentives to homeless individuals for signatures on petitions and voter registrations. Circulators admitted to paying $2–$10 per signature, often coaching people to use fake addresses (federal crimes). These operations persist even after some prosecutions, raising alarms about the fraud in CA elections and around the U.S.

O’Keefe’s evidence underscored how such practices undermine democracy and waste public resources meant for legitimate needs. O’Keefe also expressed thanks to the citizen-journalism justice league featuring Savanah Hernandez, Cam Higby, Anthony Rubin, and Jon Choe.

Nick Shirley detailed shocking cases from his investigations, including empty or minimally attended daycare centers in Minnesota that billed Medicaid for millions in services never rendered. Prosecutors charged 15 people in related schemes involving over $90 million, with one major provider pleading guilty. He also highlighted a $120 million pharmacy fraud operation in Flushing, New York, and $185 million clawed back from adult daycares lacking proper receipts. Shirley pointed to patterns in immigrant communities, where fraudsters exploited programs while politicians looked the other way. Shirley’s on-the-ground footage, now viewed billions of times, proves how easy it was and is to commit fraud.

Sen. Josh Hawley (R-MO) asked Shirley if he thought Minnesota government officials were in on the corruption and “on the take” - to which Shirley answered, “it is a certainty.” Hawley later said Nick Shirley is a Patriot for uncovering the rampant fraud in Minnesota. AG Keith Ellison should take notes. Also saying, THE REASON WHY THESE PEOPLE CAN’T FIND FRAUD IS BECAUSE THEY ARE GETTING PAID BY THE FRAUDSTERS!

In fact, instead of engaging with this evidence and trying to end the fraud, Democrats have pushed legislation designed to silence watchdogs like Shirley. CA Dems AB 2624, derisively called the “Stop Nick Shirley Act,” proposed law would be used to block investigative reporting and intimidate journalists, watchdog groups, and members of the public documenting potential fraud. It is meant to silence citizen journalists and shield taxpayer-funded organizations from public scrutiny. The bill also threatens penalties for exposing potential fraud, filming, or sharing evidence or information.

During testimony from Shirley, Senator Ron Johnson (R-WI) aptly said, A better name for the “Stop Nick Shirley Act” would be the “Protect Medicaid Fraudster Act.” In another exchange, Shirley said, Democrats “quite frankly, need the fraud.”

Johnathan Choe reported on X: “The Democrats have no defense or explanation for the fraud, waste, and abuse still happening under their watch. In fact, leaders in many blue states like WA are refusing to investigate these allegations. They also know James and Nick would have annihilated them with inconvenient truths.”

A big thank you to the U.S. Senate for its committee oversight in holding yesterday's hearing, and to the citizen journalists helping to expose billions of dollars in corrupt NGOs and taxpayer-funded government fraud. Americans deserve better - Not Democrats’ indifference that lets fraud flourish.

“Democrats are allowing certain people who have never lived in New Jersey to vote in the state’s elections,” said RNC Chairman Joe Gruters. “The RNC is taking them to court to stop this unconstitutional scheme, protect lawful voters, and secure New Jersey elections.”

Background:

• The RNC, the New Jersey Republican Party, and Republican congressional candidate Michael McGuire are suing New Jersey election officials for allowing certain non-residents to register and vote in New Jersey elections.

• This lawsuit challenges a law that allows certain people who have never lived in New Jersey – and in some cases have never lived in the United States – to vote in state elections based solely on a relative’s prior residency.

• The RNC is suing to strike down this unconstitutional “never-resident voter” law and ensure only eligible New Jersey voters decide New Jersey elections.

• New Jersey’s Constitution requires voters to be state residents, and state officials cannot expand voting eligibility beyond those constitutional limits.

This case brings the total to eight similar RNC lawsuits filed so far, with one victory. On May 26, a Wake County Superior Court judge ruled in favor of the RNC, reaffirming that only individuals who have actually resided in North Carolina may vote there. That decision struck down North Carolina Board of Elections (NCSBE) practices allowing “never residents”—typically U.S. citizens born abroad whose parents previously lived in the state—to register and cast ballots, upholding the clear residency requirements in the state constitution.

“This is a clear win for fair and lawful elections,” said RNC Chairman Joe Gruters. “The court upheld the North Carolina Constitution and made clear that only North Carolina residents can vote in the state. The RNC will keep fighting to ensure only eligible citizens can vote.”

The court’s decision is simple and clear: Individuals who do not live—and have never lived—in North Carolina are not allowed to choose who represents the people of the state. The ruling does not impact voters who qualify under the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA), which applies to U.S. citizens who previously lived in a state and are currently serving overseas.

The RNC did, however, have a similar Michigan lawsuit dismissed in April 2026. In that case, the court upheld the state law as constitutional and deferred to the Michigan Constitution regarding voter qualifications.

Other RNC suits are ongoing in Colorado, Nevada, Arizona, Virginia, and Nebraska. In these cases, the RNC is challenging provisions under UOCAVA that some states interpret broadly to include “never-residents” - allowing certain non-residents who have never lived in the state to register to vote and vote.

Many other states and DC have comparable “Never Resided” provisions, creating an inconsistent national patchwork that fosters voter dilution and voter fraud. Washington state, for example, allows never-residents to vote based on any “family member’s” last domicile—which violates the state constitution.

THE WA STATE CONSTITUTION SAYS - Article 6, §1 Qualifications of Electors: All persons of the age of eighteen years or over who are citizens of the United States and WHO HAVE LIVED IN THE STATE, COUNTY, AND PRECINCT thirty days immediately preceding the election at which they offer to vote…

Expanding and filing more lawsuits in WA, OR, PA, NY, IL, and other states is also warranted. Needed changes would promote uniform adherence to residency principles, improve voter-roll accuracy, and reduce perceptions of partisan advantage (overseas civilian ballots have historically skewed Democrat in available data).

Thank you, RNC, for ramping up these important election-integrity efforts to challenge these ridiculous “never-resident” voting provisions. This litigation is essential to ensure fairness. By closing loopholes that allow non-residents to vote (with no real verification) minimize the risk of voter fraud and dilution, upholding the fundamental American principle of “One Person, One Vote” - Lawful voters deserve confidence that their votes are not diluted by unconstitutional expansions of the electorate, and the RNC’s proactive legal action helps secure fair, transparent elections where state residents alone decide state outcomes.

The DOJ is sending a clear message to state and local election officials: simply follow the law: Title III of the Civil Rights Act of 1960 (CRA), 52U.S.C. § 20701: the Voting Rights Act of 1965 (VRA), 52 U.S.C. § 10301; the National Voter Registration Act of 1993 (NVRA): 52 U.S.C. § 20501; and the Help America Vote Act of 2002 (HAVA), 52 U.S.C. § 20901.

Per 52 USC 20507, federal law mandates that state and local election officials properly maintain election records and undertake certain actions to ensure that only eligible U.S. citizens cast votes in elections for federal office.

In addition, any individual who knowingly and willfully provides false information in registering to vote or when actually casting a vote is in violation of the VRA 52 U.S.C. § 10307(c). Also, federal law 18 U.S.C. § 611 prohibits non-citizens from voting in federal elections.

The Department also cites the NVRA 52 U.S.C. § 20511, which makes it a crime—punishable by fines and up to five years in prison—for election officials to knowingly and willfully deprive residents of a fair election process by retaining noncitizens on voter rolls or facilitating false or fraudulent ballots.

Election officials have 5 days to respond, informing the DOJ how they intend to ensure compliance with these federal laws both at the state and local level and how the Department can assist in those efforts.

This notification and enforcement action underscores the DOJ’s commitment to ensuring that federal elections remain accessible only to eligible U.S. citizens, without overstepping into state administration, while firmly insisting on compliance with important longstanding federal requirements.

Maintaining accurate and clean voter rolls is a core responsibility under the NVRA and related federal laws. The DOJ’s letters serve as a timely reminder to all election officials nationwide that routine list maintenance—removing deceased individuals, those who have moved, or ineligible voters—is not optional but essential to election integrity. Legal voters deserve certainty, not assumptions, about who is voting in their federal elections.

By highlighting potential criminal liability for willful failures, the Department reinforces proactive measures, such as cross-checking with federal databases, to protect the rights of lawful voters and prevent dilution of legal ballots. This approach helps the public’s confidence in the election system by addressing vulnerabilities that could otherwise undermine fair outcomes.

Ultimately, the DOJ’s emphasis on legal compliance benefits everyone by safeguarding the principle of one citizen, one vote. Election officials who diligently keep rolls current fulfill their duty to both state laws and federal standards, reducing the risk of fraud, disputes or last-minute challenges.

As midterm elections approach, this reminder encourages best practices in voter list maintenance, helping to ensure that every valid vote counts while ineligible participation is minimized. Also, adhering to these rules strengthens trust in elections and election outcomes.

Of note: AAG Dhillon also announced yesterday that the DOJ will deploy federal election monitors to 15 jurisdictions across six states—Arizona, Michigan, Massachusetts, Minnesota, New Hampshire, and Virginia—for the 2026 primary election season. This is something the DOJ has done routinely for decades. Monitoring helps ensure real-time compliance, safeguarding the integrity of the election process.

Gathering such a large number of signatures in such a short timeframe highlights the deep frustration many Washingtonians feel towards the Democrats’ push for new taxes on income, which violates the WA State Constitution. The IP26-645 initiative targets ESSB 6346, which the state Democrats passed in the 2026 legislative session. Dems also deviously added a “necessity” clause to the bill that blocked the more preferred, faster referendum path, a move the state Supreme Court upheld in May. That forced LGW to gather twice as many signatures through the citizen initiative process.

At the heart of this success is Brian Heywood and his dedicated team of volunteers, whose organization and determination have proven unmatched. Heywood’s leadership has built a highly efficient grassroots machine, empowering thousands of committed citizens to hit the streets, engage their neighbors, and collect signatures with remarkable speed and accuracy.

“There are three primary problems with this tax: it’s unconstitutional and will be passed onto all income earners, it represents spending in Olympia that voters don’t trust will be used in their best interest, and it was passed by Bob Ferguson and Jamie Pedersen with the sole purpose of keeping the voters out of the process. We’re giving the power back to the people with this initiative and asking them to vote yes to repeal the income tax in November,” Heywood said.

The legislation imposes a 9.9% rate on household income exceeding $1 million annually, with the tax applying to income earned starting in 2028; it is expected to eventually expand beyond high earners and inevitably capture the middle class…

Specifically, the bill violates the state constitution’s long-standing prohibition on progressive income taxes, Art VII, Section 1 (Amendment 14 in 1930):

“All taxes shall be uniform upon the same class of property within the territorial limits of the authority levying the tax and shall be levied and collected for public purposes only. The word ‘property’ as used herein shall mean and include everything, whether tangible or intangible, subject to ownership.

Washington voters have rejected income taxes 10 times since 1932, and they’re not ready to accept one now, regardless of how it’s packaged.

In the 2026 legislative session, more than 116,000 Washingtonians made state history by signing in to oppose the 9.9% income tax heard in the State House of Representatives, making it the most opposed bill to ever come before the Washington State Legislature. Also, a few weeks prior, nearly 62,000 people signed in to oppose ESSB 6346 in the two days leading up to a Senate budget committee hearing.

This victory means Washington voters will have the chance to weigh in on the IP26-645 Income Tax Repeal alongside two other key LGW citizen initiatives on the November 2026 ballot: IL26-638 Protecting Fairness in Girls’ Sports by keeping biological males out of female competitions, and IL26-001 Strengthening Parental Rights in education through better communication and opt-out options for families.

Justice Amy Coney Barrett authored the majority opinion, joined by Chief Justice Roberts and the three liberal justices. They concluded, Federal Election-Day statutes do not prevent Mississippi from counting absentee ballots postmarked by Election Day but received up to five days thereafter; nothing in the federal Election-Day statutes requires ballots to be received by Election Day.

The decision reverses the Fifth Circuit’s decision and preserves similar grace periods that undermine finality and public trust. This ruling directly affects roughly 14–18 jurisdictions (including about 14 states, D.C., and territories) that allow post-Election Day receipt of timely, postmarked mail ballots for general or military/overseas voters. States like California, Washington (with its ridiculous extended 21-day window), New York, Illinois, and others can continue counting these ballots, potentially delaying final results in close races.

Justice Alito, in a strong dissent joined by Justices Thomas and Gorsuch (and partially by Kavanaugh), argued that “Election Day” means a single, specific day (like Labor Day or Independence Day) when voting processes should conclude, not an open-ended window.

“Today’s decision is inconsistent with the terms of the Elections Day Statutes, Contemporary Election Law Principles, two Centuries of Historical Practice, and the Case Law on the question presented. Federal law designates ‘the Tuesday next after the first Monday in November’ as ‘Election Day,’ 3 U. S. C. §21, and provides that elections for federal office must be held on that date (U. S. C. §§1, 7; 3 U. S. C. §1). The federal election-day statutes therefore require that ballots be received by election day. Mississippi’s law, which permits the counting of absentee ballots received up to five business days after election day, conflicts with this requirement and is preempted.”

Alito argues that the majority errs by treating “election” as merely the voters’ act of casting/postmarking ballots, ignoring the need for official receipt to make the collective choice final and authoritative.

Allowing post-election-day receipt undermines the statutes’ purpose of a fixed, national Election Day to prevent chaos, fraud concerns, and delayed results, and strongly rejects this as diluting “Election Day” into an extended period and “opening the window,” contrary to the single-day mandate. “We don’t have Election Day anymore. We have election month—or election months.”

Alito faults the majority for downplaying integrity concerns (e.g., ballots arriving late potentially “flipping” results, eroding confidence). He notes this creates “chaos and suspicions of impropriety” and “leaves open opportunities for voter fraud that may further undermine America’s faith in the integrity of this country’s elections.”

This outcome is obviously terrible for election integrity. By allowing post-election-day ballot arrivals, the Court has entrenched a system ripe for manipulation, chain-of-custody vulnerabilities, and perceptions of unfairness.

SCOTUS assumes a postmark proves when a ballot was mailed, however current USPS processing often cannot establish that with certainty. The court failed to consider that the USPS practices undermine the very decision it rendered.

Late-counted mail ballots have already fueled widespread skepticism in recent high-profile races, where outcomes appeared to shift dramatically after initial tallies (most recently in the LA Mayor race). In California, multiple U.S. House races have seen the candidate ahead on Election Night lose days later as late-arriving ballots were counted, flipping outcomes.

Without a firm nationwide receipt deadline, final results in tight contests will remain in limbo for days, allowing questionable late-arriving ballots to swing elections and inviting more legal challenges. This decision weakens, rather than strengthens, trust in our democratic process.

While the decision maintains the status quo for November’s midterms, it doesn’t close the door on stronger mail-in voting rules in the future (like the SAVE America Act) — it just affirms Congress (not the Court) should write them if desired. All Congress needs to do is pass legislation stating clearly that ALL ballots in federal elections must be RECEIVED by Election Day, not merely postmarked. For those who prioritize legislative solutions over judicial mandates, it is the next best option.

When questioned by Kittitas County Sheriff’s Office, she said she voted ballots in both states because of “issues in Colorado she wanted to be heard on,” and claimed she only voted on state/local races in Colorado (not federal ones, like president) and “did not attempt to double vote on national issues twice.”

Authorities say Ellis knew that voting in both states was illegal and was regretful and apologetic, according to court documents. Ellis is no longer registered to vote in Washington.

On June 18, 2026, Ellis appeared in Kittitas County Superior Court for her arraignment via online video. A not-guilty plea was entered by her attorney, Ulvar Klein. Ellis was informed by Judge James Kirkham that she must appear in person for her next hearing on Aug. 27, at which time she will be formally arrested and booked into jail before being released on her own recognizance.

This case will be particularly interesting to track against the backdrop of Washington’s evolving interpretation of double-voting statutes, following the 2026 appellate ruling in WA State v. Padrta.

AS A REMINDER: In Democrat-Controlled Washington State, it appears that under certain conditions, it is now legal to vote in multiple states. That is because the Leftist WA Court of Appeals, Division II, in Washington v. Padrta, issued an unprecedented ruling (reversing a “Double Voting” conviction) on January 6, 2026. No. 59737-3-II

This should have been a clear case proving Mr. Padrta illegally “double voted,” violating RCW 29A.84.650(1), the WA state law prohibiting voting more than once in the same election. Per statute (1) Any person who intentionally votes or attempts to vote in this state more than once at any election, or who intentionally votes or attempts to vote in both this state and another state at any election, is guilty of a class C felony.

After admitting to voting in two states in the Nov 2022 general election and being found guilty in Lewis County Superior Court, Padrta appealed the ruling in June, 2024. In Dec, 2025 the Court of Appeals heard the case and on Jan 6, 2026 the 3 judge panel (all Inslee appointee justices) issued its curious 2-1 split decision, ruled the law did not prohibit voting in Washington and another state in the same election cycle; saying that Padrta did not vote in the same “election” and therefore did not violate RCW 29A.84.650(1).

With one judge dissenting, the majority concluded that the term “election” in the statute is ambiguous, whether “election” refers to the overall voting process or specific contests. The court held that the evidence was insufficient to support the conviction under RCW 29A. 84. 650(1) and found the statute could mean either (1) a specific slate of candidates and issues on a particular ballot in one jurisdiction, or (2) the particular date on which an election occurs.

The court majority ended up agreeing with Padrta’s interpretation of the statute: The Washington and Oregon November 2022 general elections were not the same election because they had a different slate of candidates. And Padrta was not guilty because he only voted once in each of two separate elections.

The ruling created ambiguity by narrowly defining “election.” In response, the Legislature passed SB 6084: Clarifying the prohibition on voting more than once in an election (a Democrat sponsored bill signed into law in March 2026), which clarifies that a person may not vote in Washington and another state IF THE ELECTION DATE IS THE SAME. The new law amends 29A.84.650(1), adding language: The legislature finds that it has been and continues to be the law of this state that a person may not vote in an election in Washington and an election in any other state if the election date is the same for both states.

Any person who intentionally votes or attempts to vote in this state more than once in the same election, or who intentionally votes or attempts to vote in both this state and another state in the same election, is guilty of a class C felony.

The term "election" refers to any general, primary, or special election. An election is the "same election" if the election date is the same, regardless of the candidates, offices, issues, or measures on the ballot and regardless of the date on which ballots are mailed or returned.

SB 6084 is a narrow fix that clarifies same-day protections but does not address multi-state voting across staggered election dates or the underlying challenges posed by mobile populations and universal mail ballots.

However, the Democrats’ (aka “The Anyone From Anywhere Can Vote Party”) new law also codifies the appellate court’s ruling allowing dual voting by the same voter in multiple jurisdictions/states as long as the election is not held on “the same day.”

So now, if the “election” isn’t on the same date across different states, then it is allowed to vote as many ballots as possible, in as many “elections” as possible, wherever “voters” receive ballots…

The negative collateral impacts and ramifications are obvious: voters could receive ballots in several states and vote in all of them at any time (as long as the election dates differ), with no consequences.

SB 6084 may have good intentions to fix a bad court decision (which is why Republicans voted for it), but it is a poorly written piece of legislation that facilitates voter fraud and violates the principle that an individual may only have one voting domicile.

LET’S BE CLEAR - BECAUSE OF DEMOCRATS - IN 2026, DOUBLE VOTING IS NOW LEGAL IN WA STATE: SB 6084 codified that it is only illegal to vote in different states in elections that fall on the same date.

Now, after Padrta and SB 6084 are in effect, it will be interesting to see whether OR, CO, and other states also allow dual voters (with multiple simultaneous domiciles) when elections are held on different dates.

Many counties in WA State and other states hold 3, 4, 5, or even 6 elections per year, each on a different date. About 45 States hold their respective primary election on different dates - only WA, MI, KS, MO, and VA hold their Aug 4, 2026 primary election on the same dates…

Different election-date scenarios across states are harder to police and may require interstate data sharing.

The Ellis case highlights both the intent and limitations of SB 6084. While the law closes the specific loophole exposed in Padrta for same-day elections, it leaves open questions about staggered election dates across states throughout the year. With Washington and Colorado both relying heavily on mail-in ballots, SB 6084 falls short of fully enforcing the single-domicile voting principle.

And of course, loose mail-in voting laws and well-known gaps in voter roll maintenance facilitate all of this in the first place. Mail-in voting (pioneered early in both OR and WA) makes it easier to participate across states if registrations aren’t promptly updated and rigorously maintained.

This is a straightforward instance of double voting after a move, where Ellis kept her old registration active and voted in both states. It was detected through routine interstate cross-checks, which election officials now perform more frequently. But catching it after ballots have been counted and results certified is little solace to candidates and the electorate.

The case highlights ongoing difficulties in updating voter registrations across state lines, and it raises legitimate questions about one-person, one-vote and the principle of a single voting domicile.

The case could set a precedent for how aggressively Washington pursues and litigates interstate double voting under its clarified statute; interstate double voting is a Class C felony. Let’s hope that double-voting cases, like Ellis's (same-day 2024 ballots), will be prosecuted under the clarified law.

“Yet again, Democrats are trying to let people vote in a state where they’ve never lived,” said RNC Chairman Joe Gruters. “Jena Griswold is ignoring Colorado’s Constitution and allowing non-residents to cast ballots in Colorado elections. The RNC is fighting these unconstitutional schemes across the country, and we’re suing to stop this one.”

Background:

• The RNC, Congressman Jeff Crank, and Douglas County Clerk and Recorder Sheri Davis (Plaintiffs) sued Colorado Secretary of State Jena Griswold.

• The lawsuit challenges a Colorado law and election policy that allows certain people who have never lived in Colorado - and in some cases have never lived in the United States - to vote in Colorado elections.

• Colorado’s Constitution is clear: voting is reserved for Colorado residents.

• Griswold’s policy allows people to vote based solely on the past residency of a parent, guardian, or spouse, despite never having lived in Colorado themselves.

• The lawsuit seeks to strike down Colorado’s unconstitutional “never-resident voter” law and stop its enforcement.

• The lawsuit also seeks the removal of ineligible never-resident voters from Colorado’s voter rolls.

• This lawsuit builds on the RNC’s successful record defending voter eligibility requirements across the country, including a major victory last month in North Carolina, stopping non-residents from voting, and last week’s new lawsuit challenging a similar policy in Nebraska.

The RNC’s lawsuit against Colorado has clear merit on state constitutional grounds. Residency has traditionally meant personal presence and intent to remain, not a familial connection. The North Carolina court just upheld this principle, ruling that never-residents cannot vote in state and local elections under that state’s constitution.

The Colorado lawsuit raises a straightforward constitutional question: Can a U.S. citizen who has never lived in Colorado establish legal residency there simply because a parent, spouse, or guardian once did?

Article VII of the Colorado Constitution requires voters to have “resided in this state.” The RNC says the requirement cannot be met by proxy or inheritance; Residency is not inherited and cannot be established by proxy. An individual who has never personally made Colorado his or her home has not resided in this state.

Plaintiffs rightly contend this practice dilutes the votes of actual state resident voters and adds voters who, by the state’s own constitutional language, are ineligible. Similar rules have produced measurable numbers of such ballots in past elections that could swing close races. The suit seeks the removal of ineligible names from the rolls, plus an injunction against the policy.

Federal Military and Overseas Voters (UOCAVA) protects overseas voting rights for federal races but does not override state residency requirements for state and local contests. Courts routinely defer to state constitutions on voter qualifications, giving the RNC a credible pathway to another victory.

Other states maintaining the same policy should face identical scrutiny. Washington state, for example, allows never-residents to vote based on any “family member’s” last domicile—a rule even broader than Colorado’s, and which, of course, like Colorado, violates the state constitution.

THE WA STATE CONSTITUTION SAYS - Article 6, §1 Qualifications of Electors: All persons of the age of eighteen years or over who are citizens of the United States and WHO HAVE LIVED IN THE STATE, COUNTY, AND PRECINCT thirty days immediately preceding the election at which they offer to vote…

The state constitution should matter!

Many other states and DC have comparable “Never Resided” provisions, creating an inconsistent national patchwork that invites the very dilution claims raised in Colorado. Consistency would promote uniform adherence to residency principles, improve voter-roll accuracy, and reduce perceptions of partisan advantage (overseas civilian ballots have historically skewed Democrat in available data).

The RNC has also pursued this legal strategy in Arizona, Michigan, and Virginia, expanding it to WA, OR, PA, NY, IL, NV, NJ, and other states is also warranted.

Election integrity demands that states apply their own constitutional residency rules fairly and evenly rather than selectively extending privileges that conflict with foundational voter qualifications.
