The title of today&#8217;s post is taken from Chapter 28 of Walter Van Tilburg Clark&#8217;s lyrical novel, <em>The City of Trembling Leaves.  </em>The &#8220;city&#8221; is Reno and the book is the semi-autobiographical story of Clark&#8217;s life and friendship with Robert Caples.<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-2" href="#footnote-2" target="_self">2</a></p><p>Robert Caples is one of Nevada&#8217;s most acclaimed artists.<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-3" href="#footnote-3" target="_self">3</a>  One of his most famous works, is the mural, <em><a href="https://www.washoecourts.com/Historical/img/artwork/Caples.jpg">Creation</a>,</em> in the Washoe County Courthouse designed by famed Nevada and Reno native, Frederic Joseph DeLongchamps. It is also the story of Tim&#8217;s (Clark&#8217;s) unrequited love for Rachel Wells. The book is long.  One writer has described it as follows:</p><blockquote><p>&#8220;No one has heard of it or read it, and of those whom I for force to it, all are caught up by its beauty, its unbelievably thorough informing of life, yet none, I think has understood all its implications.&#8221;<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-6" href="#footnote-6" target="_self">6</a></p></blockquote><p>Yesterday&#8217;s tour was organized to follow the events of Chapter 28, which is the center point of the novel.  Tim Hazard, the protagonist, and Rachel drive down to the mansion from Reno in a Model T, named Tilly.  They picnic, swim and dance under the moon to the tune of <a href="https://youtu.be/JTHBaX0RhcY">Moonlight and Roses</a>.<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" Should the government have any concern about protecting lenders?  </p><p>There seems to be a clear governmental interest in the case of depository financial institutions.  First, the government can claim an interest in protecting depositors.  Depositors are, of course, lenders to the financial institution.  Financial institutions are also themselves lenders and the government can claim an interest in the safety and soundness of the institutions by ensuring that they do not make improvident loans.  But what about non-depository lenders?  Should the government care whether they engage in negligent or reckless lending? </p>

At the time, that was the longest telegram ever sent.   The process of sending such a telegram is astonishing.  The sending operator would need to convert the text of the message into thousands of dots and dashes and then the receiving operator would need to convert those dots and dashes back into words.  It took roughly 200,000 dots and dashes in Morse Code to transmit the telegram!<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-2" href="#footnote-2" target="_self">2</a>. Why send such a prodigious and costly message?</p><p>The answer is politics.  President Lincoln wanted additional Republican support for his election and his legislative program.  It was thought that if the Colorado, Nebraska, and Nevada territories became states, their electors, representatives, and senators would support Lincoln.  In March 1864, Congress enacted legislation enabling the three territories to join the union as states.  Nevada was the only territory to complete the process before the election, but it needed to get its voter approved constitution to Washington so that it could be proclaimed a state before the election. Peck, got stuck in the snow in Aurora and did not vote.</p><p>Below is the certification by Nevada Governor Nye of the proclamation by Abraham Lincoln. Proponents of legislative intervention won the day and Section 144 of the Delaware Corporations Code was amended.  The battle did not end with the enactment of SB 21.  Six weeks after Delaware&#8217;s governor signed SB 21 into law, a plaintiff filed suit challending the constitutionality of SB 21. We were traveling along the mountains of the great Sierra, which rose on our right, covered with snow; but below the temperature was mild and pleasant.  We saw a number of dams which the Indians had constructed to catch fish. After having made about 18 miles, we encamped under some large cottonwoods on the river bottom, where there was tolerably good grass.&#8221;<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-2" href="#footnote-2" target="_self">2</a></p></blockquote><p>This is the first written description of the beautiful river that descends from Lake Tahoe to empty eventually into Pyramid Lake, Nevada.<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-3" href="#footnote-3" target="_self">3</a></p><p>You won&#8217;t find a &#8220;Salmon Trout River&#8221; on contemporary maps, however.  The river is now known as the Truckee River. Thocmetony explained:</p><blockquote><p>&#8220;Truckee is an Indian word, it means all right, or very well.&#8221;<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-7" href="#footnote-7" target="_self">7</a></p></blockquote><p>According to various accounts Captain (or Chief) Truckee responded with the Paiute word, &#8220;tro-kay&#8221;, when asked about the route through the Sierra.  &#8220;Tro-kay&#8221; became anglicized as &#8220;Truckee&#8221;.  There are other explanations for how Thocmetony&#8217;s maternal grandfather came to be called Truckee, but most agree that name honors a leader who strove to establish and maintain friendly relations Nevada is not unique in this respect.  California and Delaware have similar statutes.<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-1" href="#footnote-1" target="_self">1</a>  Undoubtedly, these statutes have been useful to corporations in remedying the previously irremediable.   </p>
