Repeat a lie often enough and it becomes the truth. The lie that Louisiana schools require students to be vaccinated to attend school has been stated so often that it is a part of our culture—but we’re ready for a radical cultural shift.

No, students do not have to be vaccinated to attend ANY Louisiana school, including colleges and universities.

The law, R.S. 17:170, states that proof of immunity or vaccination be provided, OR a note from a physician that vaccination is contraindicated for the student’s health, ORthe parent or student can provide a “written dissent.” To dissent simply means you do not agree with the request for the student’s vaccine information, for whatever reason. R.S. 17:170 makes no mention of religious or philosophical reasons because no reason is needed to dissent. Schools simply need a document in the student’s file to satisfy the law: either proof of immunity, an immunization record, a note from a physician, or a written dissent from the student or parent/guardian (if student is a minor).

These are not exemptions from the law—this is the law. And it has ALWAYS been that way.

The state of Louisiana cannot lawfully compel anyone to be vaccinated. Yet many within the education and healthcare systems continue to manipulate, pressure, or mislead parents into vaccinating their children, often by misrepresenting or selectively citing state law.

This coercion, whether intentional or due to ignorance, must stop.

Parents and students: Do not submit vaccine records to any Louisiana school.

Instead, always assert your rights by submitting a written dissent.

NO, you do not have to use the form provided by the Louisiana Department of Education (LDOE) or the Louisiana Department of Health (LDH). The law does not specify any particular form has to be used. The form provided by LDOE and LDH includes a statement about being removed from campus in the event of an outbreak of a “vaccine-preventable disease.” While R.S. 17:170(F) does include a provision for the possible exclusion of unvaccinated students (not teachers) from campus in the event of an outbreak of a vaccine-preventable disease, we do not recommend that any parent or student agree to this provision in writing.

Why not sign the form provided by LDOE or LDH?

In 2021, with approval from the Louisiana Department of Health, colleges and universities mandated COVID-19 vaccination, even though COVID-19 is not a vaccine-preventable disease. Until a law passed in 2024 prohibiting schools from requiring covid vaccination, there were still 86 NOLA city schools requiring covid vaccination for students as young as 5. Any of these schools could have excluded students during an outbreak of COVID-19 despite it not being a “vaccine-preventable disease.”

What other illnesses does the state require vaccination records for, despite the fact that they are not truly vaccine-preventable?

All of them.

The state requests vaccination history for the following illnesses:

MMR: Measles, Mumps, Rubella

• Measles: According to Physicians for Informed Consent, “nearly 50% of schoolchildren and most adults vaccinated with the MMR vaccine can still be infected with measles virus and spread it to others, even with mild or no symptoms of their own.” Note that CDC data indicates a third dose of MMR to be ineffective.

• Rubella: According to Physicians for Informed Consent, by age 15, “1 out of 3 vaccinated children are susceptible to infection and spread of rubella.”

• Mumps: According to Physicians for Informed Consent, “immunity from the vaccine wanes so that one quarter of vaccinated children lose protection within 7.9 years, half within 19 years, and three quarters within 38 years.”

DTaP: Diphtheria, Tetanus, and Pertussis

• According to Physicians for Informed Consent, DTaP “does not prevent asymptomatic infection or the spread of diphtheria or pertussis, and it has no effect on the transmission of tetanus because tetanus is not contagious.” The CDCalso admitted in a recently archived webpage that the tetanus toxoid used in the vaccine has never been tested for efficacy, rather inferred.

  • “Efficacy of the toxoid has never been studied in a vaccine trial. It can be inferred from protective antitoxin levels that a complete tetanus toxoid series has a clinical efficacy of virtually 100%. . .”

Hep A: Hepatitis A

• Hepatitis A is transmitted via the fecal-oral route and is not typically communicable in a standard school setting with proper hygiene and sanitation. According to the CDC, “the exact duration of protection after vaccination is unknown.”

Hep B: Hepatitis B

• According to Physicians for Informed Consent, “about 50% of vaccinated children lose their immunity by age 5.” Because Hepatitis B is a bloodborne illness, it is not transmitted through casual contact and therefore poses no risk of spreading in a typical school setting.

IPV: Polio

• According to the CDC, polio “vaccination does prevent disease. It does not prevent asymptomatic infection and further spreading of polioviruses.”

Varicella: Chickenpox

• According to the VARIVAX package insert, recently varicella vaccinated individuals can transmit the virus to others. If anyone should be excluded during a chickenpox outbreak, it’s those recently vaccinated with varicella vaccine.

  • “Post-marketing experience suggests that transmission of varicella vaccine virus (Oka/Merck) resulting in varicella infection including disseminated disease may occur between vaccine recipients (who develop or do not develop a varicella-like rash) and contacts susceptible to varicella including healthy as well as high-risk individuals.

    Due to the concern for transmission of vaccine virus, vaccine recipients should attempt to avoid whenever possible close association with susceptible high-risk individuals for up to six weeks following vaccination with VARIVAX.”

MenACWY: Meningococcal

• According to the CDC, “MenACWY, MenB, and MenABCWY vaccines showed that they produce an immune response. This immune response suggests the vaccines provide protection, but data are limited on how well they work.” Additionally, “available data suggest that protection from MenACWY vaccines decreases in many teens within 5 years.”

Most people assume vaccines prevent transmission and infection of communicable diseases, yet some of the illnesses we vaccinate for are not communicable, especially in a school setting. Hep B (sexually transmitted, IV drug use), Hep A (food borne illness, fecal-oral route of transmission), polio (fecal-oral route of transmission), and tetanus (non-communicable) are prime examples. Other vaccines do not prevent transmission or infection, while making the recipient more susceptible to future infections, like pertussis-containing vaccines. And then other vaccines may provide protection against symptoms, though for how long is not well known, while the recipient can shed the vaccine strain of the virus, as with chickenpox and measles vaccines.

If vaccines reduce symptoms without preventing infection or transmission, then removing unvaccinated students does nothing to eliminate risk. In fact, failing to test vaccinated individuals—who may carry and spread a virus while remaining asymptomatic—poses a far greater public health threat. At least, for those afraid of viruses.

This is why it’s important NOT to sign a form saying the student will be excused in an outbreak of a vaccine-preventable disease.

Additionally, these drugs have serious gaps in product safety—a risk the state has no right asking you to shoulder, especially without full transparency, informed consent, and manufacturers’ liability for those harmed.

These gaps in vaccine product safety include:

• No pre-licensure, inert placebo controlled clinical trials

• No long term safety reviews

• No studies on cumulative toxicity

• No adequate adverse event reporting

• No product liability, meaning the consumer cannot sue for vaccine-associated injury or death

In September 2024, vaccine injury attorney Aaron Siri delivered a detailed presentation on the deficiencies in vaccine safety oversight to the Louisiana House Committee on Homeland Security. Below is a short excerpt from that presentation.

“Not a single childhood vaccine, I could tell you, has gone through a placebo controlled clinical trial, sufficient duration, and power to assess that it was safe before being injected into millions of children in America. I can say that categorically, not because it’s my opinion, but because anybody who goes to the FDA website could see that for themselves by looking at the package inserts and the underlying clinical trial documents that are available on the FDA website.”

Can Louisiana schools refuse a “written dissent”?

No, R.S. 17:170 applies to ALL Louisiana schools, including licensed daycares and universities, both public and private. No school can ask you to “request” an exemption—all schools are obligated under the law to accept your “written dissent.” Some schools feel they are excluded from this law, but they risk emergency federal funding and state accreditation if they fail to follow the law. Also, misrepresenting state law in school handbooks vitiates any contract with parents or students. Read more at HealthFreedomLA.org.

The option to refuse to provide vaccine records to schools has been in place since R.S. 17:170 went into effect in 1991. In 2024, three important bills were signed into law by Governor Jeff Landry:

• Act 675, authored by Representative Kathy Edmonston, requires ANY communication about the vaccine requirements for school attendance to include a citation of the law detailing the option to submit a “written dissent.” R.S. 17:170(E(2)

• Act 460, authored by Representative Beryl Amedee, is the first law of its kind in the nation, prohibiting schools from discriminating against students based on their vaccination status. R.S. 17:170(E)(3)

• Act 674, authored by Representative Kathy Edmonston, prohibits any school from requesting covid vaccination for school attendance. R.S. 17:170(A)(4)

By not providing the entirety of the law, including the option to dissent, schools and healthcare professionals violate informed consent and medical ethics.

No one should feel pressure to undergo a medical procedure, especially one that has been so terribly misrepresented to parents.

Finally, it is our position that this lie—that Louisiana schools require students to be vaccinated—paved the way for the medical fascism that occurred during covid. In an April 2020 interview with FOX News’ Laura Ingraham, U.S. Senator Bill Cassidy cited the Louisiana law to justify the concept of immunity passports. Note in the post below, Cassidy states vaccine information is HIPPA protected. That statement is also a lie.There are schools in Louisiana that allow all teachers to see the student’s vaccination information—and there is no legal consequence for sharing it.

This interview was the moment vaccine passports were thrust into public consciousness, thanks to Senator Cassidy, who used his platform to normalize the concept of medical segregation.

The radical remedy for the medical fascism we experienced during covid is a prohibition of medical mandates—all of them—including the state’s vaccine law which has been used for decades to manipulate parents into vaccinating their children.

For now, exercise your right to dissent. Do not provide ANY vaccination records to ANY Louisiana school, regardless the student’s vaccination status.

On the 28^th of July, 2026, Washington’s self-dealing swamp creature, Anthony Fauci, sat before a United States Senate committee and refused to answer questions. Protected by a last-second presidential pardon issued in the final hours of the Biden administration, the former public face of America’s COVID response invoked the Fifth Amendment a reported 111 times.

Fauci thumbed his nose at lawmakers and the public who endured the lockdowns, mandates, school closures, and the career-destroying pressure to conform. The man who shaped policy for millions chose silence when truth had a personal cost. It was an arrogant performance that mocked the accountability he demanded from the rest of us.

While parts of the country moved on post-COVID and pretended the last several years never happened, Louisiana did not. The Louisiana House of Representatives, led by members of the Louisiana Freedom Caucus, convened public hearings in 2024 that forced the state to confront what occurred during the height of COVID-era policies. Lawmakers heard directly from citizens who were harmed, from physicians and nurses who lost their livelihoods for questioning official state dogma born of federal talking points, and from experts who raised long-ignored questions about vaccine safety and origins. Those hearings were not performative. They produced legislation that actually changed the rules. Freedom Caucus members with some allies in the Senate moved out with impactful legislation.

The Legislature heard the people and the Governor signed these bills into law.

• My 2024 bill in the House, HB976, known as the Don Scoggins Law, restored and strengthened the right of patients in healthcare facilities to receive daily in-person visits from a designated essential caregiver. In essence, we put in law that NO ONE will ever be forced to die or suffer alone in a hospital. No matter WHAT, people in hospitals will be able to have visitors. What the government did during COVID was cruel and it’s not allowed any more in Louisiana. Ever.

• Representative Beryl Amedee’s HB908 prohibited schools from discriminating against students based on vaccination status in academics, athletics, or extracurricular activities. No more threats and no more punishment.

• Kathy Edmonston’s HB46 banned any public or private school from requiring the COVID-19 vaccine as a condition of enrollment or attendance, while her HB47 required schools to clearly inform parents of their legal right to dissent from immunization requirements.

• In 2025 and 2026 legislative sessions, the momentum continued. In the 2025 Senate, SB19 by Senator Mike Fesi authorized pharmacists to dispense the Nobel Prize-winning drug ivermectin to adults under a standing order, removing unnecessary barriers to a medicine that became a cultural and medical flashpoint. The lies told about Ivermectin were breathtaking, and it’s now easier to get in Louisiana. No one is forced to buy it, but you can get it if you wish. Ivermectin saved lives and lies kept it from being disseminated.

• My bill HB690 directed the Louisiana Surgeon General to write rules governing the use of products under Emergency Use Authorization, focusing on informed consent, adverse-event reporting, and transparency. People MUST be told if a drug they are being given is an experiment or is fully vetted. Millions of doses of experimental COVID vaccines were shot into the arms of Louisiana citizens without citizens KNOWING they were NOT being given a fully vetted drug.

• Senator Thomas Pressley’s SB133 stripped the World Health Organization, the United Nations, and the World Economic Forum of any jurisdiction or enforcement power inside Louisiana. The people of Louisiana do not have to bow to these foreign entities. This was a clear line in the sand, drawn by a legislator and validated by the Governor.

• This year, Senator Patrick McMath’s SB29 required coroners to document recent vaccination history in cases of sudden, unexplained child deaths. Parents need to have a full picture of what happened to their children and an accurate record in a terrible moment is critical.

These measures did not erase the past. They did, however, send a clear signal that Louisiana stands for health freedom. Louisiana held the hearings, listened to the people who paid the price, and then wrote statutes that limit the state’s ability to repeat the same mistakes. There are legislative champions of health freedom who line up every year and try to ensure our citizens are treated with dignity and within the bounds of the law and human decency. We stand with our citizens and we will not back down.

And we won’t have to plead the Fifth.

Ask Gov. Landry to Veto HB775

Earlier this week, Health Freedom Louisiana submitted the following letter requesting Landry’s veto of this deeply concerning legislation.

Dear Governor Landry,

I am writing to respectfully urge you to veto HB775, authored by Representative Emily Chenevert.

Undoubtedly, this legislation was drafted with the best of intentions. However, as passed by the Legislature, HB775 creates a dangerous loophole that allows individuals with no verified legal authority to seek medical treatment for a minor while relieving healthcare providers of any obligation to verify who is presenting the child for care.

A recurring theme in support of HB775 was the assertion that minors are already treated as adults under Louisiana law for medical purposes. That claim is misleading. Existing law contains exceptions allowing minors to consent to treatment in specific circumstances, including when the minor believes himself or herself to be ill or afflicted with a disease. HB775 substantially expands beyond these exceptions by creating new pathways for medical treatment without parental involvement and by reducing the verification requirements that currently protect both minors and parents.

Under the bill, a person merely professing to be a temporary custodian or caregiver is granted the same authority as a parent or legal guardian for purposes of consenting to medical treatment. Healthcare providers are expressly permitted to rely on those representations without investigating, verifying, or confirming the individual’s legal authority and are granted immunity for doing so.

One of the most troubling aspects of HB775 is that it creates a pathway for a minor to obtain a vaccine or other medical treatment without a parent’s knowledge or consent. Under the bill, a minor who disagrees with a parent’s medical decisions could simply seek out another adult, a family friend, neighbor, coach, relative, or other acquaintance, to accompany them to a healthcare provider and profess to be acting as a temporary custodian or caregiver at the parent’s request. Because the bill expressly relieves healthcare providers of any duty to investigate, verify, or confirm that person’s legal authority, there is no meaningful safeguard to ensure the parent actually authorized the treatment.

This concern is not hypothetical. During the COVID-19 pandemic, many parents expressed legitimate fears that children could be vaccinated without their knowledge or against their wishes. HB775 creates a framework in which those concerns become more plausible by weakening existing protections that require medical decisions for minors to be made by individuals with verified legal authority. Parents should not have to worry that a child could circumvent their decisions simply by finding another adult willing to claim temporary caregiver status.

Importantly, vaccination is not treatment for an existing illness or disease. Under current law, minors cannot simply invoke treatment exceptions to obtain vaccines without parental involvement. HB775 changes that practical reality by allowing an unverified temporary custodian or caregiver to stand in the place of a parent for medical decision-making.

Further, HB775 undermines the protections established by the National Childhood Vaccine Injury Act (NCVIA), specifically 42 U.S.C. § 300aa-26(c), which requires healthcare providers to provide Vaccine Information Statements to the legal representative of a child before administering a covered vaccine. By allowing an unverified temporary custodian or caregiver to consent to medical treatment on a minor’s behalf, HB775 creates a pathway for children to receive vaccines without ensuring that the parent or legal guardian, the individual whom federal law contemplates as the child’s legal representative, has received the required information or authorized the vaccination.

These provisions are particularly troubling because they undermine the framework established in R.S. 40:1159.4, which was designed to ensure that medical decisions for minors are made by individuals with lawful authority. That statute establishes a clear hierarchy of consent, appropriately prioritizing parents and legal guardians over those acting in loco parentis. HB775 erodes those safeguards by elevating unverified caregivers to the same status as parents while eliminating any requirement to confirm their authority.

While several improvements were made to HB775 during the legislative process, these provisions remain deeply concerning. Parents have a fundamental right and responsibility to direct the medical care of their children, and Louisiana law should not weaken the protections that safeguard that relationship.

For these reasons, I respectfully ask that you veto HB775 and preserve the protections Louisiana families currently rely upon.

With the legislative session coming to a close, we are left with one final opportunity to ensure Representative Emily Chenevert’s HB775 is not enacted into law: ask Governor Landry to veto HB775.

HB775 has been flawed from its inception and only managed to get worse as the session progressed. Our initial concern centered on the lowering of the age of medical consent from 18 to 17 and the ability of minors of any age to get vaccines (HPV, Hep B, and any future vaccine) for sexually transmitted illnesses (STI). Thanks to your advocacy, the age was amended in Senate Health and Welfare to align with LA Civil Law, but Rep. Chenevert included in the amendments a change in the definition of who could consent on the minor’s behalf and removed any legal necessity to confirm who was presenting the minor for treatment.

From “any person who has been granted legal authority” in the original bill to “any person professing to be serving as temporary custodian or caregiver...at the request of a parent or legal guardian” in the final version of the bill. To add insult to injury, "any person professing to be serving as temporary custodian or caregiver" is EQUAL TO the parent or legal guardian.

Additionally, a healthcare provider “may rely in good faith on the representation of a person professing to be serving as temporary custodian or caregiver” and “a healthcare provider or healthcare facility relying on the representations of a temporary custodian or caregiver under this Section shall have no affirmative duty to investigate, verify, or confirm the legal authority of the person professing to be serving as temporary custodian or caregiver...”

In summary: ANYONE can seek medical care for ANY minor for ANY reason and the healthcare provider and facility are free from criminal and civil liability.

From the Senate committee to the Senate floor, we did manage to get two significant changes to the bill, thanks to Senator Thomas Pressly, who carried the bill in the Senate.

• First, the bill was amended to exclude students who are dual enrolled from being considered the age of majority.

• Second, STI vaccines are excluded from those minors seeking prevention of STIs.

Despite these significant wins and the amended age to 18, this bill still poses a threat to minor and parental rights.

Below is the language in HB775 that will have every predator and child trafficker flocking to Louisiana. Healthcare workers are given free rein to treat any minor for any reason without verifying the authority of the adult accompanying the child. They get to act on “good faith” that the person with the minor has some capacity to seek treatment for that child.

Additionally, the bill removes all civil and criminal liability from healthcare facilities and providers who treat a minor in this capacity. The exception for negligence in Section D is comical considering the healthcare provider is excluded from investigating, verifying, or confirming the legal authority of the person seeking care for the minor.

This is not a bill that protects minors or incentives parental involvement. HB775 incentivizes criminal activity.

Why is HB775 a bad bill? Get the details below.

Last week, HB775 by Rep. Emily Chenevert was successfully amended to reflect the age of majority currently specified in Louisiana’s Civil Code: 18. While coming away with that small victory, HB775 still managed to leave Senate Health and Welfare worse than it arrived.

Rep. Chenevert included in the amendment set this troubling language which allows ANY person to seek ANY medical care for ANY MINOR for ANY reason and the healthcare provider is immune from liability. Parents who have endured custody disputes or legal battles over medical decision-making should recognize the serious implications of this language.

“(1) A healthcare provider, healthcare facility, hospital, physician, nurse, emergency medical services provider, or other person licensed or authorized to provide healthcare services in this state may rely in good faith on the representation of a person professing to be serving as temporary custodian or caregiver of a person who has not attained the age of majority.”

Additionally, because vaccines are a preventative medical intervention, the language in the amendment below allows minors to receive vaccines like HPV and Hep B (or any future vaccine for the prevention of an STD), for the prevention of sexually transmitted illness without parental consent.

“(j) If the person who has not attained the age of majority is seeking contraceptives or prevention or treatment for a sexually transmitted infection.”

This provision violates federal law, the National Childhood Vaccine Injury Act (NCVIA), which requires that a parent receive a Vaccine Information Sheet (VIS) prior to vaccination. Additionally, should they be injured by a vaccine, minors are prohibited from seeking compensation in the Vaccine Injury Compensation Program (VICP) — only the parent can seek compensation on their child’s behalf.

Further, any minor enrolled in a college or university, including those dual-enrolled, is considered an adult and may seek ANY medical care, including vaccinations — again, a violation of federal law.

“(i) If the person who has not attained the age of majority is enrolled as a student in a college or university.”

These provisions in HB775 are a tremendous concern!

HB775 was “returned to the calendar,” but we need this bill killed, or significantly amended.

BACKGROUND: HB775 is an attempt to amend a section of law, RS 40:1079.1, that allows a minor “who is or believes himself to be afflicted with an illness or disease” to seek medical care. This DOES NOT mean there is no age of consent in Louisiana. Age of majority is established in Civil Code Article 29:

Treatment of a minor is conditional in RS 40:1079.1 and cannot be ignored: to receive treatment, a minor must be ill or believe themself to be ill or have a disease. This establishes a threshold of treatment rather than eliminating an age of consent. This language does not give a physician carte blanche to treat every minor.

This threshold of treatment also eliminates the possibility of preventive care, like vaccination, because vaccination is not a treatment for any illness or disease. For example, a minor with the mumps would never be given an MMR vaccine because a vaccine is not a treatment for mumps.

HB775 lowers the age of medical consent from 18 to 17, meaning minors can consent to ALL medical treatment, including vaccination, without parental consent a year earlier than years prior.

Lowering the age of medical consent to 17 would allow minors to independently consent to ALL medical and mental health treatment as well as a wide range of vaccines, including newer products and vaccines administered in school-based health centers, pharmacies, and public health clinics, without a parent ever being notified.

HB775 creates significant concerns regarding coercion and informed consent.

Teenagers are uniquely vulnerable to pressure from authority figures, school personnel, peers, and public health messaging, particularly in settings tied to school attendance or extracurricular participation. At the same time, most 17-year-olds lack the legal and financial maturity to fully understand the complex regulatory framework surrounding vaccines, including the fact that vaccine manufacturers and physicians operate under broad federal liability protections through laws like the National Childhood Vaccine Injury Act and the PREP Act.

Meaningful informed consent requires not only disclosure of the risks and benefits of both the disease and the vaccine, but also the capacity to understand the legal, medical, and long-term implications of the decision. Removing parents from that process at 17 undermines both parental rights and the safeguards intended to protect minors from coercive or inadequately informed medical decisions.

We want to encourage parents to email and call Rep. Emily Chenevert and urge her to amend the bill to maintain the age of medical consent at 18.

For families who plan to initiate a power of attorney at 18 for children with special needs, this is especially important. If the bill is passed as is, POA would need to be completed at 17.

The law HB775 attempts to amend does pose a threat to parental authority and it should be corrected, but lowering the current age of medical consent from 18 to 17 is not the answer.

Two bills moving through the legislature are bad enough on their own, but if passed in conjunction create a nightmare for minor consent in Louisiana.

HB775 by Representative Emily Chenevert lowers the age of medical consent from 18 to 17, allowing minors to consent to medical treatment without parental involvement.

HB1249 by Representative Steven Jackson expands school-based healthcare and behavioral health services while reducing parental oversight and notification - in what other setting would a parent typically drop a child off for medical evaluation or treatment and later pick them up with limited knowledge of what occurred?

Together, these bills create a dangerous pathway for minors to access medical and mental health services at school without meaningful parental involvement.

HB926 by Rep. Bayham is moving forward — but amendments are needed before final passage.

This legislation protects a fundamental principle:
Medical decisions belong to individuals — not the government.

HB926:

• Prohibits government medical mandates

• Prevents discrimination based on medical status

• Protects access to public services, employment, and transportation

• Ensures healthy individuals cannot be excluded from public life

Patrick McMath, Chair of the Senate Health and Welfare Committee, introduced two meaningful bills this session aimed at providing comfort for grieving parents across Louisiana. In addition to SB29, SB32 establishes a Perinatal Bereavement Care Initiative within the Louisiana Department of Health to support families experiencing the loss of a child.

While SB32 focuses on compassionate support for families after loss, the effort to ensure grieving parents also receive transparency and complete information during death investigations has been years in the making.

That journey began in 2020 when Representative Beryl Amedee introduced HB468, which would require vaccine information to be included in the legally required investigation of an infant 12 months of age or younger who died suddenly and without explanation. Our review of the coroner investigative process uncovered a significant gap in a child’s medical history. Because there are multiple sites of vaccine administration - the pediatrician’s office, Shots for Tots Clinics, health clinics - without accessing the Louisiana Immunization Network System (LINK), coroners are not guaranteed a complete picture of an infant’s medical history. In 2020, covid disrupted the legislative session and HB468 was never heard.

In 2022, after the rollout of covid vaccines, Representative Raymond Crews introduced HB915 which would require coroners to consider vaccine history when any individual died within 60 days of vaccination. The coroner association opposed the legislation and the bill was defeated on the House floor, 30-61.

In 2024, Representative Amedee introduced HB288 which would require a coroner to include vaccine history in the autopsy of an infant 12 months of age or younger who died suddenly and without explanation. Once again, the coroner association opposed the bill and it failed a House floor vote, 51-50. Immediately following the bill’s defeat, Rep. Amedee introduced and passed HR292, which instructs LDH to compare the previous ten years’ SIDS death certificates with the infants’ vaccination records. State-level analysis is important because no system, national or otherwise, routinely performs this type of linkage analysis.

We count HR292 as perhaps the most significant piece of health freedom legislation HFL has advocated for.

The data gathered from HR292 will provide essential insight into previously unexamined associations between vaccination timing and sudden infant deaths, helping to identify patterns that have not been fully examined due to fragmented record keeping. By aligning death certificate data with vaccination records, the resolution advances transparency, strengthens the integrity of public health analysis, and ensures that policymakers and the public have access to more complete information when evaluating infant mortality trends.

This is an unprecedented analysis at the state level, with the potential for far-reaching impact once the data is thoroughly analyzed, independently reviewed and publicly released.

The passage of SB29 is yet another groundbreaking win for Louisiana.

Patrick McMath’s SB29 finally closes the critical information gap by ensuring coroners review LINKS when investigating the unexpected and unexplained death of a child 15 years old or younger. SB29 does not determine causation, but ensures more complete data is available to evaluate potential patterns in childhood deaths - an area where long-term, comprehensive analysis has historically been absent not only in Louisiana, but nationwide.

Louisiana is only the second state to pass this legislation, but we are hopeful all states will follow since all families deserve transparency, complete investigations, and the assurance that no relevant medical information is ignored when a child dies unexpectedly and without explanation.

Representative Bayham’s HB926 passed House Health and Welfare last week and is headed for a House floor vote soon. This bill addresses government mandates but we have requested that some amendments be made, including the removal of the language stating “medical masks are not medical devices.” The FDA defines medical masks as medical devices therefore the state cannot adopt a different definition. Secondly, the exclusion of RS 17:170 must be a stand alone subsection, not grouped with child welfare laws.

Representative Beryl Amedee’s HB948, which would allow parents to seek a second opinion if their child receives a cancer diagnosis, failed to advance in House Health and Welfare after significant opposition from groups including the Louisiana Hospital Association, the LA Chapter of the American Academy or Pediatrics, and the Forensic Nurses Association. Testimony seemed designed to create confusion—whether intentional or not. The bill received one lone vote from Representative Ray Crews.

1. Update on HB1041 — the Louisiana Medical Freedom Act

Representative Jay Gallé’s HB1041, the Louisiana Medical Freedom Act, passed House Health and Welfare without objection — not surprising as the Louisiana Hospital Association removed their objection when hospitals were exempted from the bill. We hope to get the amendment in the correct posture soon so that hospitals are not completely excluded, but the bill as-is is still an incredible win. What the bill does:

• A private business shall not deny, restrict, or otherwise penalize any individual’s access to services, products, venues, education, training, trade, or transportation based on the individual’s refusal of a medical intervention. A business entity shall not require a medical intervention as a condition of employment.

• A government entity or official shall not require a medical intervention for any of the following: access to government services, use of public buildings, facilities, infrastructure, or transportation, and employment by government entities.

• Under no circumstances shall a healthy individual or alleged asymptomatic carrier of an illness be excluded from public activities based on the individual having declined a medical intervention during an outbreak or public health emergency, excluding R.S. 17:170(F).

• Personal protective equipment can only be required if it is consistent with adopted federal and state workplace and occupational safety regulations, and does not discriminate based on medical intervention status. PPE that is only authorized for emergency use may not be mandated.

• Schools must comply with R.S. 17:170—meaning any parent or student can dissent—and may not require any medical intervention beyond that required in R.S. 17:170. If schools do not comply with R.S. 17:170, violations may be prosecuted by the attorney general or appropriate parish or municipal prosecutor - parents have never had this option before.

• Any medical interventions that can be required are subject to any applicable laws or legal precedents providing for or protecting exemptions and reasonable accommodations.

• Excludes the state’s laws concerning child welfare — this was part of the original model bill that was inadvertently left out. Why this needs to be in the bill: some children need evaluations and tests when removed from situations involving abuse — this bill would prevent that without the exception. (A thorough review of child welfare laws should be done separately.)

What we were not able to achieve:

• Healthcare-related facilities are excluded.

• Rep. Gallé attempted to repeal R.S. 17:170(F), the existing law that says unvaccinated students may be sent home in the event of an outbreak. We will attempt to challenge this again in the future.

• Excludes the state’s laws concerning tuberculosis.

When we went into the hearing, we had four votes. With these concessions, Rep. Gallé was able to get the bill out of committee unopposed. We are seeking an amendment to the healthcare facility exemption to ensure it is in its proper posture.

We are celebrating this huge win! The bill went from four votes out of fourteen to being unopposed.

Next stop for HB1041 is the House floor and getting the healthcare-related facilities exception in its proper posture. We will let you know when that happens.

2. Representative Beryl Amedee’s HB737, which would repeal the state’s meningococcal vaccine requirement for school attendance, failed in House Education with a vote of 4-8.

3. HB452 by Rep. Amedee, which would prohibit insurance incentives specifically for vaccine uptake, failed in the House Insurance Committee with a vote of 4-12.

Representative Mike Bayham’s HB926 is a very similar piece of legislation, although not as comprehensive. On Wednesday, April 8th, the House Health and Welfare hearing was full of people in opposition to HB926. Ultimately, there was not enough people on the committee to vote favorably - literally not enough republicans in the room - so Rep. Bayham agreed to voluntarily defer till a later date.

Right out of the gate, though, it was clear that legislators didn't understand the legislation. A committee member asked if this would prevent a business owner from asking patrons to wear shoes. This legislation has nothing to do with shoes and everything to do with coerced medical interventions.

Below is HFL Co-Director Jill Hines’ testimony for HB926.

This article is an attempt to explain Rep. Jay Gallé’s HB1041, The Louisiana Medical Freedom Act.

What is the purpose of the Medical Freedom Act?

The purpose of the Act is to protect the fundamental right of individuals to make voluntary, informed medical decisions without coercion, discrimination, or exclusion by employers, schools, businesses, or government entities.

HB 1041 is necessary to ensure that medical decisions in Louisiana are voluntary, informed, and free from coercion, no matter the source.

Why do we need the Louisiana Medical Freedom Act?

In 2020, former Governor John Bel Edwards declared a state of emergency in response to SARS-CoV-2 that remained in effect for two years, during which Louisianans experienced a profound violation of human rights.

During those two years, Louisianans were subject to censorship, mass manipulation, unethical behavior modification (6 ft. distance, arrows in aisles, isolation of the elderly), and various forms of coercive medical mandates, including masking, COVID testing, and vaccination. Government mandates reached every corner of society—impacting individuals, private businesses, and students from daycare through higher education.

The federal government spent $900 million on messaging campaigns designed to influence public perception and behavior. These efforts extended to unethical strategies designed to increase vaccination among adults and minors alike, including lotteries, scholarship incentives, and campaigns such as “Shots for Santa,” which associated vaccination status with moral virtue.

At the same time, Biden’s federal health agencies hid data that covid vaccines caused significant harm including idiopathic thrombocytopenia purpura, blood clots, myocarditis, pericarditis, kidney failure, etc.

The extent of damage is still being uncovered because there were no long term studies - instead, the citizens of Louisiana unknowingly became test subjects. In fact, a public records request in 2023 revealed that LDH referred to EUA vaccines as FDA approved vaccines. It is very likely that many Louisianans have no idea they received an experimental vaccine.

At the time, ideology was rivaled only by incompetence within our state health agency, and people died as a result.

While the state of Louisiana exploited the number of covid deaths to increase vaccine uptake, they failed to inform the public that the number included thousands of repeatedly vaccinated individuals.

A public records request in 2023 revealed that at least 3,091 individuals with multiple covid vaccinations had died of covid. This number, while shocking, doesn’t tell the whole story. Notice the number only includes people who had completed the primary series (two shots) fourteen days prior to death. We have no idea how many people died after the first shot in Louisiana.

Manipulative messaging compounded the harm, making coercive covid mandates even more egregious. Medical mandates reached every corner of society, impacting individuals, private businesses, and students from daycare through higher education.

No one was immune from medical mandates. In 2025, Figueiredo et al., found that mandates precipitated “economic losses of $465 billion ($286 billion to $735 billion) with persistent declines in employment particularly among healthcare support occupations.”

Who pays for the harms done?

Exacerbating the harm done is the lack of liability for those responsible. Not only is there no recourse for the physical harm people suffered when undergoing these covid interventions, but the government and drug manufacturers bear no burden of responsibility.

Millions of Americans have been injured and in many cases left destitute in the process of trying to recover their health. Meanwhile, they are left to beg for crumbs in federal compensation programs.

If the lack of liability were made known as part of the consent process, how many people would have accepted the treatment? How many were vaccinated under duress to begin with because of workplace mandates?

The Core Principle: Informed Consent

The doctrine of informed consent requires that individuals have the ability to freely accept or refuse a medical intervention.

If refusal is not a real option, if it results in job loss, exclusion, or denial of services, then consent ceases to exist. It becomes coercion.

Medical decisions must remain between a patient and their physician—not subject to pressure from employers, institutions, or the state.

Private Employer Mandates and the Limits of Authority

Protecting private business rights and limiting government overreach are important and well-established principles. However, there is a critical distinction when it comes to medical decision-making.

This is not a question of government versus private actors—it is a question of whether any entity has the authority to compel a medical intervention.

When an employer conditions a person’s livelihood on undergoing a medical procedure, it effectively inserts a third party into the exam room, using economic pressure to influence a deeply personal decision. That is a line that must not be crossed.

Employment Does Not Equal Medical Authority.
Individual rights do not disappear in the workplace. While businesses retain operational discretion, they do not have authority over the medical decisions of their employees. Employment is an agreement for services rendered—not control over personal health decisions.

Employers cannot dictate deeply personal medical choices, even in the name of risk management. The law already recognizes limits in similar contexts, including genetic testing and other sensitive health decisions. Medical autonomy deserves the same protection.

When the Market Isn’t Truly Free

In theory, individuals can choose where to work, and businesses can set their own policies. In practice, many industries, especially healthcare, are heavily shaped by government regulation, licensing requirements, and institutional control.

In these environments:

• Workers often cannot simply “go elsewhere” without leaving their profession entirely

• Starting a competing business is often impractical due to regulatory barriers

• Employers operate under government incentives, mandates, and funding conditions

When these pressures exist, what appears to be a private decision is often influenced, or effectively dictated, by government policy.

COVID-era mandates provide a clear example. Many so-called “employer mandates” were driven by federal requirements tied to funding, contracts, and compliance. Businesses were placed in a position where enforcement was necessary to maintain operations, creating a system in which private entities enforced government policy.

Compounding this dynamic is the unique liability structure surrounding vaccines. Unlike most products in a true free market, vaccines are shielded from traditional liability. This shifts risk away from manufacturers and institutions and onto individuals.

This raises an important question:
If the system is not truly a free market, should individuals still be subject to coercive medical requirements within it?

Healthcare Is Not a Free Market

Healthcare settings are inherently environments of risk. That’s where people go when they are sick. There are over 1,400 known pathogens, and only 15 or so that are addressed through vaccination.

Even if every vaccine worked perfectly, patients and healthcare workers would still be exposed to hundreds of other pathogens. Risk cannot be eliminated, it can only be managed.

No mandate can eliminate risk. But it can violate fundamental rights.

What HB1041 Does

HB 1041 ensures that:

• No individual is coerced into a medical intervention

• No one is discriminated against based on medical decisions

• Access to employment, education, and services is not conditioned on medical compliance

The bill applies to:

• Government entities

• Private businesses

• Schools and institutions

It restores the principle that medical decisions must remain voluntary and informed.

What HB1041 Does Not Do

HB 1041 does not prohibit access to medical care or interventions.

It does not interfere with the physician-patient relationship.

It does not prevent standard workplace practices such as drug testing, which are not considered medical interventions under the Act.

It does not prevent use of PPE when used in compliance with established safety standards.

It simply ensures that individuals retain the right to decide what happens to their own bodies.

Risk is an inherent part of society, especially healthcare, and it cannot justify overriding fundamental rights. The answer is not coercion. It is informed, voluntary decision-making.

There are three crucial bills in three separate committees that day, including the Louisiana Medical Freedom Act. Here’s the rundown.

The most crucial bill of the year, Rep Jay Gallé’s HB1041 — the Louisiana Medical Freedom Act — is in the House Health and Welfare Committee on Wednesday, April 15th at 9:00 am in Room 5. If you have experienced job loss, discrimination, or loss of educational opportunities due to a medical mandate, like masks or vaccines, please plan to attend, submit a green card in support, and testify for the Medical Freedom Act.

This bill helps address the growing problem of pediatricians refusing care to unvaccinated children, as well. If your family has experienced dismissal from a practice, your voice is critical—please submit a green card in support and plan to testify.

If you’ve never testified before, here’s what to expect: fill out a green card (found on the desk at the front of the room), check the box that you would like to testify, then turn it in to the Sergeant at Arms. Keep your testimony to 3 minutes and practice beforehand.

The Medical Freedom Act

Right now, health insurance plans are allowed to reward or penalize providers based on vaccination rates—and children are paying the price. Representative Beryl Amedee has introduced legislation, HB452, which removes financial incentives that can lead to discrimination and barriers to care for unvaccinated children.

Legislators need to hear directly from families whose children have been denied pediatric care or treated differently due to vaccination status. HB452 No Bonuses for Pushing Shots

Lastly, Representative Amedee’s HB737 is scheduled to be heard in the House Education Committee on Wednesday, April 15th at 9:00 am in Room 1. Please stop by the committee room, submit a green card in support, and testify if possible.

HB737 repeals the state laws requiring meningococcal vaccination. Earlier this year, federal guidance replaced universal meningococcal vaccination with a targeted approach focused on high-risk individuals. Even in countries that do not require meningococcal vaccination, disease incidence rates are well below rates of concern. In 2024, there were 503 cases of meningitis in the United States — that’s ~ 0.1 case out of 100,000.

Decisions regarding this vaccine should remain between patients and their physicians, rather than being mandated by the state.

The era of medical mandates is over. It’s time to pass the Louisiana Medical Freedom Act.

Representative Jay Gallé files the Louisiana Medical Freedom Act, HB1041. The significance of who filed this incredible legislation cannot be overlooked, but first let me tell you what the Louisiana Medical Freedom Act (MFA) does.

What is the intent of the Medical Freedom Act?

Because no one and no government has the right to mandate a medical intervention, the Louisiana Medical Freedom Act eliminates coercion and discrimination from the medical consent process by prohibiting public and private employers, schools, businesses, and government entities from requiring or conditioning participation, employment, education, or services on medical interventions such as vaccines, masks, tests, or other medical products. The Act reaffirms informed consent as a foundational human right in health care.

The MFA prohibits government, businesses, and schools from mandating a “medical intervention,” defined as a medical procedure, treatment, device, drug, injection, medication, or medical action taken to monitor, diagnose, prevent, treat, or cure a disease or alter the health or biological function of a person. Medical interventions include but are not limited to vaccines, biologics, swabs, and tests, including genetic and genomic testing, pills, capsules, creams, sprays, liquids, injections, chips, devices, and monitors.

What the MFA does NOT do:

• The MFA does not prevent employers from doing random drug screening, because those tests are not administered to monitor, diagnose, prevent, treat, or cure a disease or alter the health or biological function of a person.

• The MFA does not prohibit the use of PPE but does ensure that the PPE requirements are consistent with adopted federal and state workplace and occupational safety regulations, and do not discriminate based on medical intervention status.

• The MFA does not repeal the state’s vaccine law for schools, R.S. 17:170, but only full compliance with R.S. 17:170 satisfies the statutory aspects of the MFA. Section F of R.S. 17:170, the section that allows healthy, unvaccinated children to be sent home during an outbreak, is repealed with the MFA.

• The MFA does not prevent employers or schools from sending home sick people.

What the MFA does do:

The MFA ends every coercive and unjust medical discriminatory practice, including but not limited to:

• removing unvaccinated pediatric patients as clients,

• preventing access to medical care, like organ donation, based on your refusal of a medical intervention, and

• limiting access to higher education in healthcare-related fields because of refusal to undergo medical treatment.

Chairman Gallé is the right man for the job.

We are thrilled that the Chairman of the House Select Committee on Homeland Security, State Representative Jay Gallé, has taken on the monumental challenge of sponsoring the Louisiana Medical Freedom Act. In September of 2024, upon the passage of HR133 by Rep. Chuck Owen, the House Select Committee on Homeland Security oversaw the review of the state’s response to covid. After two days of testimony by state agencies, medical licensing boards, various healthcare-related associations, healthcare workers, and human rights advocates, the main recommendation of the committee after they reviewed the state’s response to covid was “no mandates” legislation.

The effects of medical mandates on society were—and continue to be—so detrimental that ending them entirely is both just and necessary to uphold fundamental rights and rebuild public trust. It is no coincidence that Chairman Gallé has stepped forward to sponsor this bill.

The MFA does not prevent anyone from choosing any medical intervention they desire; it ensures that those decisions remain voluntary and free from coercion. It guarantees that medical mandates will NEVER AGAIN be used to compel compliance or condition access to employment, education, or public life. The MFA protects individuals, families, and communities from medical coercion and ensures that the harms experienced during the covid era are never repeated.

The MFA enshrines the principle that no one and no government has the right to mandate a medical intervention.

Before we get to the legislative update, please take action on these two important bills in committee next week:

1. HB485 by Representative Beryl Amedee is a parental rights constitutional amendment that will go before voters statewide if approved by the legislature. This measure would firmly protect parental rights in the Louisiana Constitution and ensure that government interference is subject to the highest level of judicial scrutiny.

Parents—not government—should make decisions for their children.

The bill will be heard on Monday, March 30th at 9:30 a.m. in Room 4. Please attend and submit a green card in support. Please take a moment to contact members of the House Civil Law and Procedure Committee and ask them to support HB485.

Protect Parental Rights

2. Representative Kim Coates’ HB403 is moving through the Louisiana Legislature and would expand opportunities for individuals and families to sell homemade foods directly to consumers while earning a living wage.

This legislation supports small businesses, home-based entrepreneurs, and local food producers by removing unnecessary barriers and allowing people to earn a living wage. Currently, cottage food producers are limited to a $30,000 income. Why do we allow the state to determine who can earn a living wage and who cannot? HB403 raises that amount to $100,000.

At its core, this is about a simple principle: People should have the freedom to produce and sell homemade foods without state-imposed barriers to a living wage.

HB403 is in House Health and Welfare on Wednesday. Please send a message to the committee today and ask them to support cottage food entrepreneurs.

Freedom to Sell Homemade Foods

Now for an update on other bills:

Senator Fesi’s fluoride bill, SB4, has been amended to remove the statewide ban on municipal water fluoridation. Please send a message to your state senator and ask them to remove the amendments to SB4 because no one — and no government — has the right to mandate a medical intervention and that’s exactly what fluoridated water is.

Water is for Hydration Not Medication

Senator Patrick McMath’s SB29, A Voice for the Voiceless, left the senate with ZERO opposition and nine co-authors! This bill will require coroners to include vaccine history in the death report of children 15 years of age and younger who die suddenly and without explanation. We will let you know when it will be in House Health and Welfare for a vote.

Senator Fesi’s SB36 is being amended by the office of the Louisiana Surgeon General to incorporate informed consent for other medical interventions, as well as, vaccines. The ban on food as an mRNA platform for vaccines was amended out of the bill. We will let you know when it is back in committee.

Senator Vincent Cox’s HB106 passed committee without objection. This legislation will prevent daycares and preschools from administering melatonin without parental consent. HFL sent a letter of support to the committee for this bill.

We are still waiting for several bills to be filed — when they appear on the legis.gov website, we will let you know!

Support SB4: Water Should Hydrate, Not Medicate

SB4 stops the fluoridation of public water systems, protecting Louisiana families from being exposed to a medicine added to drinking water without their knowledge or consent. Water should hydrate, not medicate.

Contact members of Senate Health and Welfare and ask them to support SB4 and end forced medication through Louisiana’s water supply.

Support SB36: Vaccine Informed Consent/No mRNA Food

Patients deserve clear safeguards to ensure medical decisions are made with full knowledge and without pressure. This legislation adds common-sense guardrails to ensure vaccines are given only with clear, voluntary permission and that patients are protected when they are most vulnerable. SB36 also includes a one-line prohibition: “The use of food as a delivery mechanism for an mRNA vaccine.” Yes, food as a delivery mechanism has been considered an option since the 90’s and this bill prohibits its use in Louisiana.

SB29 by Senator Patrick McMath, A Voice For the Voiceless, is making its way through the legislature and is scheduled for a senate floor vote TODAY!

The senate will convene at 4:30 p.m. - please send an email then make a quick phone call to your senator’s office - instructions are included in the link below. Ask for their support of this common sense bill that requires a coroner to include vaccine history in the autopsy of an infant who dies suddenly and without explanation.

Support SB29

Louisiana could be the first state to pass this much needed legislation. We have one of the highest infant mortality rates in the country and to date vaccine information has never been legally required despite the large number of vaccines an infant receives in the first year of life.
