is there anything she cannot do do better
faster with greater alacrity than any other mother
we might conceive while weaving with her strings
and fingers a lullabye to sing us along
we stand aside in awe of the elegance
of her design and ours after hours
and hours of tinkering with the tech she winks

off-rhythm in their conversation more syncopated than a church accordion song cat leaps to the column pier arched back hissing but i see who&#8217;s there telling stories from the bible both of them know by heart big church dinner him over that side grandma crowded in here she was nine grandpa fourteen i looked at him and he looked at me and that&#8217;s all we said decades flip the bible pages by rapid-as-a-home-made-cartoon-animation until he left them spilling to the floor by the bed and her still in it her joints tormented her so i sat up in the dark it wasn&#8217;t a dream he come here and here he knelt on all that crinkle paper put his hands on my knees like this and prayed his hands give such heat win she called me win in the morning she woke up pain completely gone and grampa too back where he come from the ether heaven or the quantum field what&#8217;s it matter to a ligament that no more needs the liniment than a grandson churched and we pose no challenge to the equilibrium

the scale of things that encompass a cranium
is more than embodied brains contain
       the wheel rocks to and from

all life is violence     all violence is
is a change in chemistry     and     o yes
a crust congealing on a sea of iron
&#9;the wheel rocks to and from

red rifts lash out     hot as an exlover&#8217;s tongue
life roots in the scar tissue&#9;the cooling lava floods
stretchmarks in a mother&#8217;s belly     calming to the touch
forgive her the violence of a birth so rough
and the polar cold at her extremities 
&#9;the wheel rocks to and from

what we have and hold is the mystery at hand
the eyes behind the eyes that we behold
and the silence intervening     shekinah and the holy ghost
the brooding nature of an earlier earth     explosive
and by turns oppressed     a bully alone with herself
her with her plumes of orange flame and abalone eyes
locked in ice for an epoch     a silent screaming face
by grace of replication    life teems in a warm crevasse
&#9;the wheel rocks to and from

this is our history     this is our home
the counteraction of a pendulum
to the wheel is strapped a human form
to demonstrate     davinci-wise     our range of motion
like an angel drawn in snow     a starfish man
inverted on a card     a figure four     change is to come
to a circle lurching rightsideup from upsidedown 
we know so little else of him     so little can be known
of the geometrically ideal     and the golden mean
this crust of cooling continent set adrift
what we do know     we know by measurement
and inference     an incremental divination
of our history and of our home
       the wheel rocks to and from.

It&#8217;s how we operate effectively in a world full of other people. I spent twenty years working as a correctional officer, providing &#8220;care, custody, and control&#8221; of inmates at every security level, both men and women. During that time, I couldn&#8217;t help observing that crime&#8212;even &#8220;victimless&#8221; crime&#8212;is a result, always, of relational dysfunction. Unfortunately, the typical response we make to the commission of a crime is also dysfunctional. In <em>Justice in the Making: Relating, Participating, Communicating, </em>Robyn Penmen deftly explains the underlying causes of our inappropriate legal responses and interventions, how and why they not only fail to achieve justice but inevitably pile injustice on top of injustice, making situations worse, and the world less safe.</p><p>&#8220;What we&#8217;ve got here,&#8221; says Strother Martin&#8217;s character, The Captain, in the 1967 movie <em>Cool Hand Luke,</em> &#8220;is failure to communicate.&#8221; I heard the line repeated many times during my career as a CO&#8212;I&#8217;m sure I said it myself a time or two&#8212;and the weight of irony was never lacking. In <em>Justice In the Making (JITM),</em> Penman lays bare the fact that this irony pervades our customary approaches to every sort of justice&#8212;criminal, social, restorative, you name it&#8212;and it is indeed due to a failure of communication. Communication that disrespects the other is incapable of success; yet as Penman demonstrates, disrespect is the modus operandi of our legal systems.</p><p>The failure is not only part and parcel of our justice systems, it is inherent in our standard model of communication&#8212;that is, that communication is best understood as a matter of information transmission and reception, as if human beings are little more than recording devices. Emerging as it does from a much more nuanced, social constructionist view of communication known as The Coordinated Management of Meaning, <em>JITM</em> posits that justice cannot be enacted within an adversarial system in which courtroom behavior is governed by competition between two legal teams.</p><p>Understanding that justice is rendered impossible by the very means we use in our attempts to achieve it, creates &#8220;a seismic shift in how we view&#8221; its enactment. The implications reverberate across every aspect of our social lives, from international and domestic affairs to race relations to family life. It&#8217;s not a complicated shift. Though it calls for a fundamental overhaul of courtroom demeanor and of the roles played by attorneys, judges, witnesses, and litigants, both the shift and the need for it are readily understood. For that reason, I recommend <em>Justice In the Making</em> to anyone interested in working toward a more sane, equitable, and peaceful world&#8212;one in which we practice justice together on a daily y2="14"></line></svg></button></div></div></div></a></figure></div><p>The current climate of cruelty in our social worlds can leave us frustrated and scrambling to respond in ways that embrace the ethos and praxis of CMM.<a class="footnote-anchor" data-component-name="FootnoteAnchorToDOM" id="footnote-anchor-1" href="#footnote-1" target="_self">1</a>  My personal frustration makes it tempting, at times, to abandon the desire to respond thoughtfully and, instead, to react emotionally to the fear and anger I feel, especially knowing that people who employ and support the use of institutional and systemic cruelty to achieve moral, intellectual and political domination don&#8217;t seem to be interested in listening to speech that opposes or impedes them.</p><p>We are all by now aware that a deep well of hatred for the weak and vulnerable exists and is often used to attack those who stand with the disadvantaged and dispossessed. The question is why? What makes cruelty attractive? This may be an under-appreciated aspect of cruelty. It does seem that people we so easily label &#8220;haters&#8221; have wanted since forever to teach the rest of us what weakness and vulnerability feel like. What if the way we feel now is the way they have felt all their lives? Scared (for ourselves and/or for those we love), alienated, marginalized, disrespected, mocked, inferior, outmaneuvered, prohibited, devalued, irrelevant, frustrated, misunderstood, preyed upon&#8230;</p><p>The list is long and, I think, familiar to most of us who dwell in a climate of polarization, regardless of our cultural and political affiliations.</p><p>Strong emotions can&#8217;t be reasoned away. If an &#8220;effective&#8221; response to cruelty can be made, it won&#8217;t be well-reasoned, academic or intellectual. That&#8217;s not to say that intellectual and academic interests shouldn&#8217;t be pursued&#8211;that&#8217;s one of the most important freedoms we have and must defend&#8212;but if those are the paths by which we seek to engage with the historically weak and fearful who find themselves in a position to lash out against other weak and fearful groups and individuals, we may be wasting valuable time. We can&#8217;t conduct a one-sided management of meaning.</p><p>If the opposite of cruelty is kindness, then kindness must be extended even to the incorrigibly cruel. Kindness might mean sheltering the targets of cruelty or standing in the way of cruelty, and brave people are doing that. We can be brave, we can support the brave, we can surround targets with our bodies if we have to, we can tell brave stories, and we can go about the business of CMM as if our social worlds were not under constant threat.</p><p>Or we can hunker down, stay low, keep doing the work, prepare ourselves for civil collapse, even war, and hope enough of us are still around to pick up the pieces once evil exhausts itself (as I hope and believe it will&#8230;eventually).</p><p>Patti Digh posits what she calls &#8220;radical tenderness&#8221; as her best response to cruelty, saying, &#8220;It&#8217;s about meeting the world&#8212;and ourselves&#8212;with fierce compassion, especially when it&#8217;s hardest to do so. When the easy thing would be to shut down, lash out, or walk away, radical tenderness invites us to stay soft. Not soft like fragile. Soft like brave and porous.&#8221; She reminds us that &#8220;people act out of pain more often than malice. That doesn&#8217;t mean harm is okay&#8212;but it does mean we can choose to respond with understanding instead of punishment. We can say: <em>This hurt. And I still see your humanity. </em>That is hard to do; that takes practice.&#8221;</p><p>That practice is deeply aligned with the practice of CMM. Digh describes &#8220;radical tenderness as a way to build something better: not just justice that punishes, but justice that heals.&#8221; The healing potential of relationally responsible justice is a major theme in Robyn Penman&#8217;s new book, <em>Justice in the Making: Relating, Participating, Communicating, </em>in which she asserts that we are daily responsible for creating justice in our social worlds by showing respect to others. I may find it difficult to respect people who engage in or cheer on acts of cruelty, but self-respect requires it of me.</p><p>This is one reason why, in the parlance of CMM, (M)mystery is held as the ultimate priority. I may not and most often cannot know the inter-generational stories that provoke a group or an individual to commit specific acts of cruelty. I&#8217;ve been asked why not (by poets and other provocateurs) more times than I can count. One reason: corrections is mostly pretty boring. A boring day is a good day, from my correctional-officer perspective&#8212;predictable, survivable.<br><br>A few years ago my friend Randy Sprout invented a poetic form I like to play around with. We call it the randometer, after him and, as it happens, because the meter is less important than the repetition of 1) the first line of each stanza as the fourth line of the same stanza and 2) the repetition of the third line of each stanza as the second line of the following stanza.<br><br>Lines may be of any length in any rhythm, nor is the number of stanzas fixed. Since the second line of the first stanza does not repeat in the same way as the rest, I sometimes try to recall it in the third line of the final stanza, the only other line that doesn&#8217;t otherwise repeat. This is optional. It can work to bracket a poem by bringing it back around to its starting point. If you&#8217;re the sort of person who likes to watch a snake eats its tail, you could create an endless loop of a poem this way. Post it to TikTok, maybe. Send me a link if you do.<br><br>The repetitious nature of the randometer makes it an ideal form for writing about the regularity inherent to modern incarceration and, come to think of it, to daily life in most contexts. Unlike a good day in prison, the form offers a remarkable sense of surprise and delight in the way the mind and the language work together to create meaning, then shift it to make new interpretations i can&#8217;t blame him anymore more for that

through town like a two-by-four through the heart

a flashlight or a book to read or anybody
but mom to ask about the fuses in the fuse box
she looked confused     her hair had fallen out

and leave mom home to pay the hospital

to winter in proximity to others of the clans
of where they come from     where they family

and god i grant them the wisdom in all of it
how lost i must seem to them in my tent
of storytelling mindless selfchatter
painting thought clouds on a desert landscape

</pre></div><p>If you&#8217;re interested in this sort of thing, the form I&#8217;m using in this poem is known locally as the &#8220;randometer&#8221; after Randy Sproat, who invented it. My best description of the form is: A series of quatrains in which the first line of each stanza is repeated in the fourth line of the same stanza, and the third line of each stanza is repeated in the second line of the following stanza. End rhymes are optional, as is the number of stanzas, and no meter is prescribed, giving the name of the form its double meaning.<br></p><p>I don&#8217;t repeat the prescribed lines verbatim. That might be cheating, you decide. What I like to do instead is to borrow some feature&#8212;a word, a phrase, or something close in sound or meaning&#8212;from the first and third lines and repeat that.
