Dear Acting Attorney General Blanche:

I respectfully submit this criminal referral requesting that the Department of Justice initiate a full and expedited investigation into material false statements and additional criminal violations by former D.C. Metropolitan Police Department Officer Michael Fanone.

Material False Statements to Congress – 18 U.S.C. § 1001

On July 27, 2021, Officer Fanone provided sworn testimony before the House Select Committee to Investigate the January 6th Attack on the United States Capitol as part of the hearing “The Law Enforcement Experience on January 6th,” alongside Sgt. Aquilino Gonell, Officer Daniel Hodges, and Pfc. Harry Dunn.

A key material representation in his testimony was that he “had been beaten, unconscious and remained so for more than four minutes.” This was presented as resulting from severe physical assault. However, Mr. Fanone’s own body-worn camera footage and supporting evidence demonstrate that if there was any period of iwas brief rather than prolonged unconsciousness caused by extended severe physical trauma as portrayed in the sworn testimony. This misrepresentation was material to the Committee’s investigation.

Additional Potential Violations Supported by Video Evidence

In addition to the material false statements detailed above, video evidence posted on X https://x.com/IvanRaiklin/status/2016260848797319202/video/1 depicts three separate incidents (“rounds”) of confrontational conduct by Michael Fanone on or about September 27, 2022; February 23, 2025; and January 22, 2026. Additionally, here

is the CSPAN footage of this incident where former MPDC Officer Fanone appears to assault a U.S. Capitol Police Officer attempting to escort Mr. Fanone as ranking member Representative Jaime Raskin soothes Jack Smith’s VIP guest Fanone from a tourrett’s spell. Note, Jaime Raskin previously was the lead impeachment manager for the second Trump impeachment and subsequently served on the J6 committee, the same committee that Mr. Fanone allegedly made materially false statements in violation of 18USC1001.

This evidence supports investigation and prosecution of the following additional violations:

- Violations of 18 U.S.C. § 111 (Assaulting, resisting, or impeding certain officers or employees)

- Three (3) counts of violations of 40 U.S.C. § 5104 (Unlawful activities in Capitol grounds and buildings)

- Two (2) counts of violations of 18 U.S.C. § 1512(c)(2) (Obstruction of an official proceeding)

These incidents include physical approach, verbal threats, and interference in settings that appear to include Capitol grounds and official proceedings, as clearly depicted in the video compilation. The video itself contains on-screen text referencing 18 U.S.C. § 111 and 40 U.S.C. § 5104 in connection with Round 3.

STATUTE OF LIMITATIONS URGENCY

The material false statements were made during sworn testimony on July 27, 2021. The applicable five-year statute of limitations for violations of 18 U.S.C. § 1001 will expire on or about July 27, 2026. It is imperative that charges be investigated, referred, and brought before this deadline. Any delay risks the permanent loss of the ability to hold the witness accountable.

Requested Action

I therefore formally request that the Department of Justice:

1. Immediately open a full investigation into the false statements matter, including obtaining all relevant body-worn camera footage, the complete hearing transcript and video record, and all medical records of Officer Fanone.

2. Determine whether probable cause exists to believe that violations of 18 U.S.C. § 1001 occurred.

3. If warranted, refer the matter for direct prosecution to the United States Attorney for the District of Columbia, the Honorable Jeanine Pirro, or pursue federal charges directly through the Criminal Division.

4. Act with all deliberate speed given the rapidly approaching statute of limitations deadline of July 27, 2026.

5. Investigate concurrently the additional potential violations of 18 U.S.C. § 111, 40 U.S.C. § 5104 (three counts), and 18 U.S.C. § 1512(c)(2) (two counts) supported by the video evidence posted at https://x.com/IvanRaiklin/status/2016260848797319202/video/1, and refer any appropriate charges for prosecution.

I am prepared to provide additional evidence, detailed analysis, or sworn testimony to assist in this investigation at any time.

This referral is submitted in the interest of accountability and the rule of law. False statements to Congress and the additional violations shown on video cannot be tolerated.

As we mark the fifth anniversary of January 6th, 2021, it’s time to set the record straight. What the mainstream media and the political elite have spun as an “insurrection” was, in reality, a carefully orchestrated Fed-Surrection led by Nancy Pelosi and her allies in the deep state. I recently appeared on One America News (OAN) with host Former Congressman Matt Gaetz to discuss this very topic, and the conversation highlighted the ongoing fight for truth, accountability, and justice for the victims—innocent Americans who were targeted, jailed, and vilified for simply exercising their right to protest.

Let’s start with the facts that the establishment desperately wants to bury. On that fateful day, President Trump called for Americans to march “peacefully and patriotically” to the Capitol. Yet, the narrative pushed by Democrats and their enablers ignored this, instead painting every MAGA supporter as a dangerous extremist. The truth? Nancy Pelosi, as Speaker of the House, rejected an offer of 10,000 National Guard troops that could have secured the Capitol. Why? Because chaos served their agenda.

This Fed-Surrection wasn’t just a failure of security—it was a setup. Evidence continues to emerge showing involvement from both sides of the aisle in the initial events and the subsequent cover-up. As I told Former Congressman Matt Gaetz, removing Kevin McCarthy as Speaker was a pivotal move. It paved the way for Mike Johnson, who released crucial CCTV footage that exposes the lies. Without that, we’d still be in the dark about the roles played by key figures in the legislative branch.

But let’s not forget the real victims. Hundreds of peaceful protesters were jailed without due process, their lives ruined to prop up a political witch hunt. And then there’s Ashli Babbitt, which was actually one of two people killed that day and by officers—a decorated Air Force veteran gunned down by Capitol Police Officer Michael Byrd. Ashli served four tours in the Middle East, defending our freedoms abroad, only to be murdered in the halls of our own Capitol. Her death marks the first time in America’s 250-year history that someone was slain inside the Capitol without a transparent investigation. Where’s the justice for Ashli?

I attended a vigil for Ashli this week, where her mother and others gathered to honor her sacrifice. It’s heartbreaking to hear from families torn apart by this injustice. Ashli’s story is a stark reminder that retribution doesn’t mean violence—it means accountability. We must demand restitution for those wrongfully imprisoned and full transparency into the events of that day.

Rosanne Boyland, a 34-year-old Trump supporter from Kennesaw, Georgia, tragically lost her life on January 6, 2021, during the chaos at the Capitol. Video evidence and eyewitness accounts show that after collapsing in the crowd surge, she was repeatedly beaten with a stick by Metropolitan Police Officer Lila Morris while unconscious and defenseless on the ground—amounting to murder through brutal police force amid the pandemonium, even as fellow protesters desperately tried to revive her.

Victoria White, a peaceful Trump supporter from Rochester, Minnesota, was brutally assaulted by Metropolitan Police Department Commander Jason Bagshaw (then a lieutenant) on January 6, 2021, in the Lower West Terrace tunnel at the U.S. Capitol. Video evidence and court filings show Bagshaw repeatedly striking her nearly 40 times over several minutes with a metal riot baton to the head, face, and upper body, followed by bare-fisted punches—including five rapid jabs—while she appeared defenseless, begging for mercy, and not actively resisting, resulting in severe injuries, bleeding, and lasting trauma. This excessive force, described in lawsuits and reports as potentially deadly and unjustified, has been highlighted by White’s civil suit against Bagshaw for violating her constitutional rights, even as he was later promoted.

In the high-profile Oath Keepers trial, U.S. Capitol Police Special Agent David Lazarus and Officer Harry Dunn served as lead witnesses, but mounting evidence suggests they committed perjury to bolster the prosecution’s case. Lazarus testified under oath that he witnessed Dunn heroically confronting Oath Keepers inside the Capitol on January 6, 2021, yet released CCTV footage from Blaze Media investigations reveals Lazarus arrived at the scene three to four minutes after the alleged confrontation had ended, making his account impossible. Similarly, Dunn’s emotional testimony about facing racial slurs and threats from the group has been contradicted by video evidence showing no such interactions, leading to calls from congressional figures and J6 advocates for perjury charges against both officers. This fabricated narrative helped secure convictions, underscoring the deep state’s manipulation of justice to target patriotic Americans. You may remember me and Enrique Tarrio running into Harry Dunn, I like to pronounce it Harry Dumb and Michael “Tourette's” Fanone back in February 2025.

Jeremy Bertino, a former Proud Boys member turned key government witness in the group’s seditious conspiracy trial, has since recanted his testimony in a bombshell affidavit, claiming he was coerced by DOJ prosecutor Jocelyn Ballantine and FBI agents to lie on the stand. Bertino alleges that Ballantine and others threatened him with harsher charges and manipulated his statements to fit a false narrative of premeditated violence on January 6, 2021, which was instrumental in convicting leaders like Enrique Tarrio despite his absence from the Capitol. This coercion included scripted answers and pressure to implicate innocent defendants, exposing the Proud Boys prosecution as a politically motivated witch hunt orchestrated by the Biden DOJ to silence dissent. Bertino’s revelations demand accountability and highlight the systemic abuse of power in these J6 persecutions. I confront Jocelyn Ballentine in this recent video because she is also the prosecutor on the J6 pipe bomber case with Brian Cole Jr. Why is she still employed in the Trump DOJ?

In my interview with Former Congressman Matt Gaetz, I outlined the path forward. We need to focus on the legislative branch’s role, as outlined in 2 USC 1967(b)(1), which gives the U.S. Capitol Police primacy over the Capitol grounds. Key individuals must be investigated: Thomas “Tad” DiBiase, the General Counsel of the U.S. Capitol Police; Jamie Raskin, lead impeachment manager; David Buckley, staff director under John Brennan’s influence; and Paul Irving, former Sergeant at Arms under Pelosi.

The FBI’s involvement—with over 274 confidential human sources present—can’t be ignored, but it starts upstream. The legislative branch can’t be FOIA’d or subpoenaed like the executive; they hide behind their co-equal status. That’s why I’m calling on Speaker Mike Johnson and Barry Loudermilk to compel the release of all deliberative documents, work products, and communications related to January 6th. This includes everything from the Capitol Police Board and beyond.

Once these documents are public, we’ll prove or disprove the nefarious roles played by senior leaders. We’ll expose the coordination that turned a peaceful protest into a pretext for persecution. And we’ll finally get a real investigation into Ashli Babbitt’s murder.

America, it’s time to lean in. Contact your representatives and demand action. The Fed-Surrection was a betrayal of our Constitution, but with truth on our side, we can reclaim our republic. Join me in this fight— for Ashli, for the J6 prisoners, and for the future of our nation.

Raiklin, known for his vocal criticism of what he perceives as deep-state interference in January 6-related investigations, did not hold back. His questions centered on Ballantine’s past prosecutions and the plausibility of the new charges against Cole.

“How are you, Ms. Ballantine?” Raiklin began politely, before quickly pivoting: “How do you know me, ma’am?”

He then drew parallels to high-profile cases Ballantine had handled, including those involving General Michael Flynn and Proud Boys leader Enrique Tarrio.

“Such as the one against General Flynn. Such as the one against Enrique Tarrio and the rest of the Proud Boys. How do you expect America to believe that this gentleman, Brian Cole, is the pipe bomber, considering your work on the General Flynn case and the case against Mr. Tarrio?”

Raiklin pressed further: “Do you find it surprising that you still have a job at the Department of Justice?”

Under the new Trump administration, with Attorney General Pam Bondi, FBI Director Kash Patel, and U.S. Attorney for the District of Columbia Jeanine Pirro at the helm, many expected sweeping changes—including potential accountability for prosecutors involved in controversial January 6 cases. Raiklin alluded to this shift, asking if Ballantine believed she retained her position because Ed Martin, a Trump ally briefly appointed as interim U.S. Attorney for D.C., was moved to a different role rather than fully taking over the office.

“Did you have any involvement in that? Did you work with some of the former Senate staff of senior influential Senate leaders that are at the U.S. Attorney’s office to make sure that Mr. Ed Martin would not be the U.S. Attorney for the District of Columbia—to expose your involvement in covering up for the fed-surrection?”

Ballantine declined to comment throughout the exchange.

Raiklin then turned to the specifics of the indictment against Cole, a 30-year-old Virginia man arrested in December 2025 after a renewed push by the Trump DOJ. Court filings allege Cole began purchasing bomb components as early as 2019—well before the 2020 election primaries—and planted the devices on January 5, 2021, out of frustration with perceived election irregularities.

“So you’re trying to make us believe that this kid spent two years collecting pipe bomb material in 2019, and his motive [was] because he didn’t like the outcome of the 2020 election—before the 2020 election primaries even began? Did I misunderstand the filing, ma’am?”

He noted that Cole’s defense attorney emphasized the case was not a conspiracy, yet the prosecution avoided labeling it as such: “Meaning maybe it was a conspiracy, ‘cause you two didn’t even mention whether or not it was a conspiracy.”

Raiklin concluded with a stark assessment: “A lot of questions. Your credibility is very low amongst most of America, considering your work on those last two trials. And I’d be very shocked to hear that you’re gonna continue to work at the Department of Justice after this.”

Offering seasonal greetings—”Belated Merry Christmas, Happy Holidays, Happy New Year”—he added a final jab: “We’ll see about the fate of your position at the Department of Justice. We’ll have to ask Ms. Judge Janine whether or not she wants to retain you or not.”

Ballantine again offered no response. Raiklin turned to a man with her: “How about you, sir? Care to comment?”

A person taking video with Mr. Raiklin ends by commenting to the couple, “Jesus is watching you all. Stay warm.”

Why This Matters

This confrontation highlights lingering distrust in the January 6 investigations. While the Trump administration touted Cole’s arrest as a breakthrough—resolving a case that “languished” under prior leadership—skeptics like Raiklin question the timeline and motives presented in the filings. Cole, who reportedly confessed but denied targeting Congress or linking the bombs directly to the electoral certification, faces serious charges, including potential terrorism enhancements.

Yet, for many on the right, the involvement of prosecutors like Ballantine—who led seditious conspiracy cases against Proud Boys leaders—raises doubts about impartiality. In an era of polarized justice, such direct challenges underscore the deep divisions over January 6 and the role of the DOJ.

As the case against Cole proceeds under U.S. Attorney Jeanine Pirro, America watches to see if this closure satisfies—or fuels further controversy.

Ivan Raiklin, a constitutional attorney, retired Green Beret, and former intelligence officer, is no stranger to political firestorms. But in his latest explosive sit-down with January 6 political prisoner Jake Lang, Raiklin brings what he calls “receipts, not theories” in a four-part interview that takes direct aim at what he describes as the weaponization of government institutions, media, and justice.

The video series, released on X (formerly Twitter) and titled “January 6: Life After Pardons”, captures Raiklin at his most unfiltered. “This isn’t about revenge,” Raiklin tells Lang. “It’s about redemptive clarity — and restoring the Republic.”

From the Ellipse, Not the Capitol

Raiklin opens by recounting his role on January 6, 2021 — and is quick to clarify a key point: he never entered the Capitol building.

“I was at the Ellipse. I had a walkie-talkie in one hand, and a cell phone in the other,” he says, describing a communications protocol he set up in case mobile signals were jammed.

He identifies himself not as a protestor or rioter, but as a constitutional advisor who promoted the now-famous “Pence Card” — a legal theory that then–Vice President Mike Pence was obligated to reject the illegitimately transmitted electors from teh contested state on December 23, 2020 under his authority of 3USC12.

“When Pence said, ‘I’m not going to do anything,’ that’s when everything changed,” Raiklin claims.

He says the initial tone of the rally was peaceful — flags waving, people praying — until Capitol police deployed tear gas and concussion grenades. Raiklin, who says he had already left for a nearby hotel before any breach occurred, adds, “I was very careful not to cross the ‘magical trespass line.’”

Terry Adirim was the top doctor at the CIA and former DOD Health Official that signed the “Vaccine” Mandate that destroyed Hundreds of thousands of Servicemembers and family members. They got the chain of events completely wrong as explained deftly by the CIA’s talented counsel.

There was a hearing yesterday at the Alexandria Federal Courthouse about the temporary administrative stay on the termination of Terry Adirim. It was very entertaining, with lots of tea spillage, I went to watch the proceedings and take notes. This hearing did not require my presence for it was to consider whether the judge will require an “administrative stay” to stop Adirim from being terminated from her position at the CIA pending the outcome of the lawsuit. Terry Adirim—who spearheaded the, What Secretary of Defense Pete Hegseth calls the Unlawful DOD “Vaccine” mandate that forced thousands of critical thinkers out of the military and injured others who took the jab—has a retirement vesting date next month, so an administrative stay would benefit her greatly. We will go through the transcript carefully when it’s available. Meanwhile, here is a summary of the highlights.

The Court opened with asking both sides about scheduling a hearing to discuss the TRO, unless CIA’s counsel was ready to provide an oral argument. Which they were!!!

First, Attorney Rudkowski, representing John Ratcliffe, the Director of the Central Intelligence Agency and the Agency made a statement. She was extremely professional and did a great job of pulling together a response to this lawsuit that was filed after hours on Friday, by Monday at 10 am. She absolutely knocked it out the park, giving well researched substantive answers about why plaintiff Terry Adirim is not likely to succeed in her lawsuit against the CIA nor Ivan Raiklin. She made the following points :

1. Adirim was a contract employee and there is a clause stating that either party can terminate the 5 year contract “for any reason” and it doesn’t necessarily have to be a good reason, so she doesn’t have the sort of protections that other civil servants would have. The judge asked about the 5^th amendment due process clause and if that applies, she stated that the plaintiff did not even claim to have been fired because of Plaintiff’s membership in a constitutionally protected class, the 5^th amendment would not apply.

2. There had been an employment review that started several weeks before April 4^th 2025. Since Adirim was brought into a critical leadership role at the CIA during the Biden administration CIA leadership had to make sure she was still a good fit under the President Trump 2.0 Administration. There had been several coworker complaints against Adirim’s conduct by CIA employees that contributed to the decision of her firing. This had not previously been publicly announced, but since this suit has been brought, the agency must make that information available to the court.

3. Attorney Rudkowski pointed out that Loomer took credit for several firings after the April 2^nd meeting, but never mentioned Adirim. Why would she omit this if she could also take credit for this firing?
