It was published by the Federal Reserve Bank of St. Louis and written by Vice President and Economist Dave Andolfatto. <em><strong><a href="https://www.stlouisfed.org/on-the-economy/2014/august/the-gold-standard-and-price-inflation"><span data-color="#0000ff" style="color: rgb(0, 0, 255);">Original article here</span></a></strong></em></p><p>The article addresses the question: <em><strong>Why doesn&#8217;t the United States return to the gold standard so that the Federal Reserve can&#8217;t create money out of thin air?</strong></em></p><p>The article explains that the phrase &#8220;create money out of thin air&#8221; refers to the Federal Reserve&#8217;s ability to create money at virtually zero resource cost.</p><p>Right there, they are admitting that the underlying assertion is true: the Federal Reserve has the ability to create money at virtually zero resource cost. That is their own description of what is commonly referred to as creating money &#8220;out of thin air.&#8221;</p><p>But let&#8217;s read the entire argument before breaking it down.</p><p>The article states that it is frequently asserted that the Federal Reserve&#8217;s ability to create money at virtually zero resource cost necessarily leads to excessive price inflation. Under a gold standard, the temptation to overinflate is allegedly absent because gold cannot simply be created out of thin air.</p><p>Following that reasoning, a return to the gold standard would appear to provide a way to guarantee price-level stability. The article, however, argues that a gold standard does not guarantee price stability.</p><p>It characterizes the gold standard as essentially a &#8220;promise made out of thin air&#8221; to keep the supply of money anchored to the supply of gold. To demonstrate how tenuous that promise can be, the article points to the events of 1933.</p><p>On April 5, 1933, President Franklin D. Roosevelt ordered gold coins and certificates of denominations exceeding $100 to be turned in for other money by May 1, at a set price of $20.67 per ounce.</p><p>Two months later, a joint resolution of Congress abrogated (got rid of) gold clauses in many public and private obligations that required debtors to repay creditors in gold dollars of the same weight and fineness as those originally borrowed.</p><p>In 1934, the government increased the official price of gold to $35 per ounce. According to the article, this effectively increased the dollar value of the gold on the Federal Reserve&#8217;s balance sheets by almost 70 percent. This action allowed the Federal Reserve to increase the money supply by a corresponding amount, subsequently leading to significant price inflation.</p><p>The article uses this historical example to argue that the gold standard provides no guarantee of price stability. It further argues that because price inflation in the United States had remained relatively low and stable during the preceding 30 years, a gold standard was not necessary to achieve price stability.</p><p>From this perspective, price stability depends less on whether money can be created &#8220;out of thin air&#8221; and more on the credibility and ability of the monetary authority to manage the nation&#8217;s money supply responsibly.</p><p>That is the entire article. Now it is time to rip it apart.</p><p>What follows is my point-by-point analysis of the claims made in the Federal Reserve article, including the information I believe has been omitted or misrepresented.</p><p>The article begins by stating that the phrase &#8220;create money out of thin air&#8221; refers to the Federal Reserve&#8217;s ability to create money at virtually zero resource cost.</p><p>First off, the phrase itself is actually true. They are admitting that the Federal Reserve can create money at virtually zero resource cost while simultaneously attempting to minimize the significance of what that means.</p><p>While the physical creation of the money may be inexpensive for the Federal Reserve, the real resource cost is borne by the public through the dilution of savings, wages, and purchasing power.</p><p>Framing this creation of money as a victimless, zero-cost benefit amounts to a falsification of the data because it ignores the cost imposed on the purchasing power of the existing money supply.</p><p>The article next states that it is &#8220;frequently asserted that such an ability necessarily leads to too much price inflation.&#8221; Merriam-Webster defines inflation as &#8220;a continuing rise in the general price level usually attributed to an increase in the volume of money and credit relative to available goods and services.&#8221;</p><p>In other words, an increase in the volume of money and credit relative to the goods and services available is itself identified as a cause of inflation. As the amount of money in circulation increases relative to available goods and services, the purchasing power of the currency decreases and prices rise.</p><p>This is why I take issue with the article&#8217;s framing. The article acknowledges the Federal Reserve&#8217;s ability to create money at virtually zero resource cost, but then treats the connection between that ability and excessive price inflation as merely something that is &#8220;frequently asserted.&#8221;</p><p>The article then states that under a gold standard, the temptation to overinflate is &#8220;allegedly absent&#8221; because gold cannot be created out of thin air. It continues by saying that it would therefore follow that returning to a gold standard would be the only way to guarantee price-level stability.</p><p>I agree with the underlying point that gold cannot simply be created at will. What I object to is the manner in which the argument is framed. By describing the absence of this inflationary temptation as merely &#8220;alleged,&#8221; the article presents the underlying argument as though it were questionable or deserving of dismissal, despite acknowledging the physical limitation that gives rise to the argument in the first place.</p><p>The article then states that, unfortunately, a gold standard does not guarantee price stability. This statement is correct, but an important distinction is missing: <em><strong>what kind of price instability are we talking about?</strong></em></p><p>The discussion focuses on inflation while failing to address the possibility of deflation resulting from limitations in the available supply of gold and silver. If the monetary supply is constrained by the availability of precious metals, there may be periods in which the supply of money does not expand sufficiently to keep pace with other economic changes. Under those circumstances, the purchasing power of the existing money could increase and prices could fall.</p><p>Therefore, simply stating that a gold standard does not guarantee &#8220;price stability&#8221; does not tell us enough. The direction and cause of that instability matter. Inflation and deflation are both changes in the price level, but they are not the same phenomenon and should not be treated as though they are interchangeable.</p><p>Would the cost of goods decrease if there were less money in circulation? Under a gold and silver monetary system, there could be years in which there is not enough newly available gold or silver to mint additional coins at the same rate as in previous years. As the available money supply becomes more limited, the value of the existing money could increase, meaning the prices of goods and services could fall.</p><p>This brings us back to the article&#8217;s statement that a gold standard is not a guarantee of price stability. That statement may be correct, but it does not necessarily mean that the instability would take the form of inflation. Prices could also deflate when the available supply of monetary gold and silver is constrained.</p><p>That distinction is not addressed in the article. The discussion emphasizes the possibility of instability under a gold standard without explaining that such instability could include deflation and an increase in the purchasing power of the existing money supply.</p><p>This is an example of omitted data. When material information necessary to fully understand a situation is left out of the discussion, the reader is left with incomplete data from which to draw a conclusion. In this case, discussing price instability without addressing both inflationary and deflationary possibilities leaves out an important part of the monetary picture.</p><p>This is precisely why omitted data is so important. If you do not know the missing information, you do not see it and therefore do not think to question the conclusion being presented.</p><p>The article next characterizes the gold standard as &#8220;simply a promise made out of thin air to keep the supply of money anchored to the supply of gold.&#8221;</p><p>Under the de jure organic law of the Republic, however, gold and silver as money are not merely a &#8220;promise made out of thin air.&#8221; The constitutional foundation for gold and silver money is found in Article I, Section 10, Clause 1 and Article I, Section 8, Clause 5 of the Constitution.</p><p>From this fact, substance-backed money operates as a natural limitation on monetary expansion because the government cannot simply create the underlying gold or silver at will. The physical substance itself places a limit on how rapidly the monetary supply can be expanded.</p><p>Characterizing this system as nothing more than a &#8220;promise made out of thin air&#8221; therefore alters the nature of the argument. It reduces a constitutional and substance-based monetary restraint to nothing more than an arbitrary promise, while presenting a fiat monetary system&#8212;where additional monetary units can be created without the same physical limitation&#8212;as the preferable alternative.</p><p>The use of gold and silver was not some arbitrary monetary idea adopted without serious consideration. The people who established this country&#8217;s monetary system understood what they were doing and believed that gold and silver would provide long-term stability by placing a substantive limitation on the monetary system.</p><p>The Founders had extensive experience with different forms of money. They had lived through the use and depreciation of colonial paper currencies, dealt with British monetary policies, and spent years debating questions involving coinage, credit, paper money, and the proper monetary structure of the new nation. These were not foreign concepts to them.</p><p>For that reason, dismissing the connection between the money supply and gold as merely a &#8220;promise made out of thin air&#8221; writes off the historical experience and deliberation that went into establishing the monetary system in the first place.</p><p>The article then attempts to demonstrate how weak this supposed promise can be by turning to the events of 1933. This is where the issue becomes considerably more serious because, in my view, what follows is not an example of the gold standard simply failing on its own. It is an example of the government deliberately acting against the monetary system that had been established.</p><p>On April 5, 1933, President Franklin D. Roosevelt ordered gold coins and certificates of denominations exceeding $100 to be turned in for other money by May 1, at a set price of $20.67 per ounce.</p><p>The problem with the article&#8217;s use of this example is that it treats governmental interference with and suspension of the gold standard as though it were an inherent failure of the gold standard itself. FDR&#8217;s actions in 1933 were not an example of the gold standard simply failing on its own. They represented a de facto hostile suspension of the gold standard through the exercise of emergency banking powers.</p><p>By ordering citizens to surrender their gold and subsequently interfering with private contractual obligations requiring payment in gold, the government fundamentally altered the monetary system under which those obligations had been created. These actions amounted to a breach of trust and an unlawful taking of property rather than a natural failure of gold as money.</p><p>Two months later, Congress adopted a joint resolution abrogating gold clauses in numerous public and private obligations that required debtors to repay creditors in gold dollars of the same weight and fineness as those originally contracted for. This measure is commonly referred to as <strong>House Joint Resolution 192 (H.J.R. 192)</strong>.</p><p>That distinction is critical. If the government first interferes with the operation of a monetary system, alters contractual obligations tied to that system, and then points to the resulting instability as evidence that the original system itself was defective, the cause and the effect have been reversed.</p><p>Congress abrogated the gold clauses in many public and private contracts that required debtors to repay creditors in gold dollars of the same weight and fineness. In 1934, the government increased the official price of gold to $35 per ounce, effectively increasing the dollar value of gold on the Federal Reserve&#8217;s balance sheets by almost 70 percent.</p><p>By doing this, they made the Federal Reserve richer.</p><p>Devaluing the dollar by raising the official price of gold to $35 per ounce was an act of debasing the currency, which was a felony punishable by death under Section 19 of the original, unrepealed Coinage Act of 1792.</p><p>To blame the gold standard for inflation caused by the government breaking the gold standard is a completely irrational conclusion.</p><p>The government had already taken the gold at the previous price of $20.67 per ounce. It then increased the official price to $35 per ounce. Instead of maintaining the previous relationship between gold and the dollar, the government took the gold and then increased its dollar value, making it considerably more expensive for the people to acquire that same gold afterward.</p><p>That is theft. The government took the people&#8217;s gold at one value and then increased its value after taking possession of it, leaving the people to spend substantially more dollars if they wanted to acquire the same amount of gold again. The article then uses the consequences of these government actions as an argument against the gold standard itself.</p><p>That is why this conduct was considered a felony under the 1792 U.S. Money Act. They understood these concepts. If you take the gold away from the people and then raise the value of that gold, you have effectively stolen it from them because you have made it substantially more expensive for them to get it back.</p><p>Before this occurred, gold was valued at approximately $20 per ounce. The government took the gold at that price and then raised the official price to $35 per ounce. The people would now have to spend substantially more of the newly issued fiat currency to acquire the same amount of gold they previously possessed. That is theft.</p><p>The article continues: &#8220;This action allowed the Federal Reserve to increase the money supply by a corresponding amount and subsequently led to a significant price inflation.&#8221;</p><p>That is not a positive result. Price inflation means that people have to spend more money to purchase the same goods and services. Inflation is not being presented here as a problem, even though the article has just acknowledged that the government&#8217;s actions significantly increased the money supply and subsequently led to significant price inflation.</p><p>The article then concludes: &#8220;This historical example demonstrates that the gold standard is no guarantee of price stability. Moreover, the fact that price inflation in the U.S. has remained low and stable over the past 30 years&#8230;&#8221;</p><p>This is a crucial part of the deception.</p><p>The article was written in 2014. Thirty years before 2014 takes us back to approximately 1984. Therefore, when the article claims that price inflation remained &#8220;low and stable over the past 30 years,&#8221; the period being discussed is roughly 1984 through 2014.</p><p>By limiting the discussion to the previous 30 years, the article completely ignores the period between 1933 and 1984. That is 51 years of monetary history that is simply left out of the analysis.</p><p>The article reaches back to 1933 when discussing the supposed failure of the gold standard, but when it turns to the performance of the monetary system that replaced it, it limits the comparison to the 30 years preceding 2014. What happened between 1933 and 1984? That entire period is omitted.</p><p>Even a comparison of the cost of living between 1984 and 2014 calls the article&#8217;s characterization of inflation as &#8220;low and stable&#8221; into question. Looking specifically at New York City rents provides a clear example.</p><p>On the Upper East Side, a small triplex rented for approximately $900 in 1987 and increased to approximately $2,700 by the mid-2000s. A two-room apartment was listed for $275 in June 1982, reflecting the lower end of the rental market during the early 1980s. In Greenpoint, a four-room railroad apartment without amenities such as central heat rented for approximately $270 in 1984.</p><p>The average rent in 1984 was approximately $335. By 2014, the average rent for a one-bedroom apartment was approximately $1,623, while a two-bedroom apartment averaged approximately $2,174.</p><p>That is not &#8220;low and stable&#8221; inflation. It represents a substantial increase in the cost of housing over the very period the article uses to support its claim.</p><p>Adjusted for inflation, approximately $350 in 1984 was equivalent to roughly $1,000 to $1,200 by 2014. These figures were obtained from iPropertyManagement.com.</p><p>This directly contradicts the picture the article is attempting to present when it states that &#8220;price inflation in the U.S. has remained low and stable over the past 30 years.&#8221;</p><p>The article then uses that assertion to reach its next conclusion: because price inflation supposedly remained low and stable during those 30 years, &#8220;the gold standard is not necessary for price stability.&#8221;</p><p>But that conclusion depends upon accepting the characterization of inflation during that period as &#8220;low and stable,&#8221; while simultaneously ignoring the 51 years between 1933 and 1984 and the substantial increases in the cost of living that occurred even within the 30-year period the article chose to emphasize.</p><p>Inflation is neither low nor stable, and the purchasing power of money should not move in only one direction. It should experience highs and lows as the economy itself fluctuates. The fact that inflation occurs while deflation does not tells us that the fiat currency system is doomed to failure because it does not fluctuate naturally with the economy and with the ability or inability to coin money from precious metals as it should.</p><p>In a gold- and silver-backed economy, there will be years in which fewer coins are minted because less gold and silver are available for coinage. With fewer coins entering circulation, the purchasing power of the existing money increases. The monetary supply therefore fluctuates according to the availability of the precious metals underlying it.</p><p>Under the fiat system, that physical limitation does not exist. Because the monetary system is no longer based upon precious metals, the value of the dollar can be manipulated by creating however much additional money the monetary authority chooses to issue.</p><p>The article then states that &#8220;price stability evidently depends less on whether money is created out of thin air and more on the credibility of the monetary authority.&#8221;</p><p>The monetary authority being referred to is the Federal Reserve. This is also the wrong source of currency for the United States of America.</p><p>The source of economic stability is not the government. It is the production of the people. The people and their ability to produce are what create stability within the economy.</p><p>When everything is manufactured in China and Americans increasingly purchase goods produced overseas, our own economy becomes destabilized. Chinese products are often purchased because they are inexpensive, but there is a consequence: American production suffers and Americans lose jobs.</p><p>The physical limits of a sound economy are the ability of the people to work and produce, combined with the ability to obtain and coin gold and silver for use within society.</p><p>This is the production of the people. The government&#8217;s job is to coin gold and silver for use in society, while the people produce. They produce products and they provide services. Through that continued production, the economy continues to flow.</p><p>When the people stop producing things domestically and instead obtain everything from China, that production is no longer occurring here. The productive activity that should be supporting the American economy has been transferred overseas.</p><p>When domestic production declines, morale goes down and the economy suffers. The economy begins to fluctuate while Americans increasingly purchase cheap products manufactured in China.</p><p>The article then refers to the monetary authority&#8217;s ability &#8220;to manage the economy&#8217;s money supply in a responsible manner.&#8221; But they are not managing it responsibly. They are stealing the wealth.</p><p>There are also several important things omitted from the article. Modern money is not created only by central banks. Commercial banks also create money through lending.</p><p>The chain looks like this:</p><p><strong>Banks issue loans; that creates deposits; more money enters the system; the value of the money already there changes.</strong></p><p>The article focuses primarily on central-bank management of the money supply, but a major part of the modern monetary system is credit creation through commercial bank lending.</p><p>Historically, the gold standard placed limits on this process because convertibility requirements placed pressure on banks. The article does not deeply address that mechanism. This is another important omission.</p><p>Another omission is the effect that newly created money has on money already in circulation. Every new dollar printed out of thin air dilutes the purchasing power of every dollar already in circulation.</p><p>This is a hidden unconstitutional tax on your physical energy and labor. By omitting the fact that the public is the surety paying this resource cost through a reduced standard of living, the Federal Reserve frames counterfeiting as a victimless public benefit.</p><p>Another omission becomes apparent when we look at the tax system itself. The article completely omits why a fiat monetary system requires a highly coercive national income tax. This is another vital omission of data.</p><p>In a monetary system that is not backed by substance, the value of paper currency is regulated by the supply of currency in circulation. Because the Federal Reserve can create unlimited amounts of fiat currency, there must be a mechanism to retire excess currency from circulation to prevent immediate hyperinflation and economic collapse.</p><p>The income tax and the IRS were created in 1913 for this exact purpose: to act as a sponge to soak up and remove excess paper currency from circulation. By omitting this, the Federal Reserve hides the fact that its so-called &#8220;responsible&#8221; management of the money supply requires Americans to act as involuntary sureties backing government debts they never authorized.</p><p>The entire article operates on an inversion. The de facto central bank&#8212;a private corporate entity that monopolizes and devalues the public currency&#8212;is presented as a benevolent protector. This reverses the true commercial relationship between the producer and the parasite.</p><p>And this brings us to the real reason why.</p><p>The Federal Reserve is a private banking trust operating a commercial counterfeiting franchise. To maintain its monopoly and keep the public trapped as debtors and sureties within its civil franchises, it must continuously publish false economic data to discourage people from demanding lawful money&#8212;gold and silver substance&#8212;that would restore individual sovereignty and strip the bankers of their control.</p><p>The ideal scene would be a monetary system in which the currency is 100 percent denominated in and redeemable for physical gold and silver substance, coined and minted only by the U.S. Treasury. It would operate under a de jure constitutional republic in which the government is strictly limited by the Constitution and cannot borrow money in the private names of the people.</p><p>And there you have it.</p><p>That is what propaganda looks like, and that is how you break it down. You examine what is being said, identify what has been omitted, compare the claims against the underlying data, and keep pulling the thread until you can see the entire picture.</p><p>Don&#8217;t just accept the information being presented to you. As the invention of modern conveyances multiplies the rapid intercourse among our citizens, the necessity of regulating the public highways and establishing tribunals for the adjudication of transit offenses becomes paramount to the internal order and prosperity of the state.</p><p>If men were angels, no government would be necessary to regulate their conduct upon the roads. But because the passions of men will not conform to the dictates of reason and safety without constraint, it is an essential object of civil society to establish rules for the common welfare. Therefore, it is proper that the individual states retain the independent and uncontrollable authority to provide for the safety of those who travel within their borders, as these are objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people.</p><p>The institution of local tribunals specifically tasked with the oversight of transit&#8212;what we might term &#8220;traffic courts&#8221;&#8212;is a natural extension of the state&#8217;s duty to administer private justice, carrying it home to men&#8217;s doors. However, the structure of these courts and the fines they impose must never degenerate into instruments of oppression. We must remain vigilant against arbitrary methods of prosecuting pretended offences, and arbitrary punishments upon arbitrary convictions, which have ever appeared to be the great engines of judicial despotism.</p><p>It is a fundamental maxim that the accumulation of all powers in the same hands may justly be pronounced the very definition of tyranny. Thus, the magistrate who determines the infraction in a traffic court must not be the same executive officer who apprehends the citizen on the highway. Furthermore, in the assessment of pecuniary mulcts&#8212;or fines&#8212;for violations of the rules of the road, the government must be strictly constrained by the Constitution. The Eighth Amendment explicitly dictates that &#8220;excessive bail shall not be required, nor excessive fines imposed&#8221;. A traffic court that levies ruinous fines merely to fill the local treasury, rather than to genuinely promote the safety of the community, would substitute the violent agency of arbitrary power in the place of the mild and salutary coercion of the magistracy.</p><p>Moreover, while the dilatory course of a trial might be argued as inconvenient for minor infractions of the road, we must remember that the trial by jury in criminal cases is a valuable safeguard to liberty. Any structure of a traffic court that systematically denies the accused the right to a speedy and public trial, or the assistance of counsel for his defense, violates the fundamental principles of the constitutional charter.</p><p>In short, while the regulation of traffic is a necessary exertion of the state&#8217;s domestic police power, it must be administered by a judiciary that is bound down by strict rules and precedents. They rule on what is placed before them.</p><p>If no one challenges jurisdiction, there is nothing to decide.</p><p>Silence is treated as agreement.</p><div><hr></div><h3><strong>Where Jurisdictional Errors Hide</strong></h3><p>Jurisdictional defects are rarely dramatic. They are procedural.</p><p>Improper service.<br>Wrong venue.<br>Statutory overreach.<br>Lack of standing.<br>Misclassification of the action.</p><p>These defects do not stop a case on their own.
