In November 2025, a photograph lit up local WhatsApp groups. It looked like a man breaking the rules: a commercial fishing boat, the Judah II, and a tractor on Salt Rock’s main beach, a Blue Flag stretch of sand set aside for swimming and surfing, where a commercial boat is not normally allowed to launch.

To many who saw the photo, a commercial boat and a tractor on a bathing beach looked illegal and unsafe. Within minutes the outrage arrived. Who let him launch there? Why not somewhere else?

The honest answer is more uncomfortable because the man on the beach was not the problem. He was the symptom, and he was there legally, on a special temporary permit granted only because his usual launch site had closed.

Kaas Versteijnen is KwaDukuza’s only commercial fisherman, and the launch site his licence and three decades of work depend on has been closed for 18 months. It sits behind the new Club Med resort at Tinley Manor, and the public can no longer reach it.

It is public. Here is the proof.

First, what a launch site actually is. This coast has no harbours, so boats are towed down onto the beach on trailers and driven straight into the surf. The stretch of sand where that is allowed to happen is called a launch site.

Tinley Manor is one of them, and it is a public one, not a private slipway. The province formally listed it as a public launch site in 2021, one of 25 along the KwaZulu-Natal coast, and put it in the hands of the KwaDukuza municipality to run.

In an official operational plan issued to the municipality in October 2022, the provincial Economic Development, Tourism and Environmental Affairs Department (EDTEA) spells out how the site must work.

That plan is blunt about what the site is. Condition 4.1 requires that the access road be “signposted indicating that the road leads to a public launch site.”

Condition 9.2 says any person with a registered boat and a skipper’s certificate “shall be allowed to launch from and beach at the site.” This is not a members’ club. It is a public coast.

And it was busy. In 2024, its last full year, boats launched from Tinley Manor 513 times, according to the Oceanographic Research Institute’s (ORI) Boat Launch Site Monitoring System, the province’s official count.

The site never once breached its limit of 30 launches a day.

Just over four in ten launches were recreational fishing trips. One in ten was commercial. The rest were charters and public-safety craft, because the National Sea Rescue Institute and the KZN Sharks Board, which services the shark-safety nets off this coast, launched from here too. Then, in the same report, ORI’s own scientists record what came next: “This launch site has now been closed for the Club Med construction, so 2025 launch numbers will be much lower.” The state’s own monitors confirm the lockout in a government report.

What the resort’s footprint did to the road

Club Med opened at Tinley Manor on 4 July 2026. It is a big development: the Collins Residential consortium has put R2.1 billion into it, and Club Med bills it as its first resort in South Africa and its first anywhere to pair a beach with a safari. Nobody is suggesting the resort was built unlawfully. The problem is what its footprint did to the road. The only route down to the public launch site now runs through Club Med’s private land, and that access has been closed.

For a while, nobody objected because everyone understood the closure to be temporary. The club was told in writing that access would stop only while the resort was under construction and then return. Construction is finished. The resort is open. The access has not come back.

Whose job is it to reopen it

Not, in the first instance, Club Med’s. Under Section 18 of the Integrated Coastal Management Act, providing coastal access is a legal duty, and it falls to the coastal municipality. KwaDukuza does not simply manage Tinley Manor.

It is obliged by national law to set aside a way for the public to reach the coast. The 2022 operational plan puts it plainly: the municipality “shall retain responsibility for the site even though management may be delegated... to a club.”

That club is the Umhlali Ski Boat Club, the site’s operator for more than 50 years. John van Rooyen, the club’s acting chairman and secretary, has been careful about where he points the finger.

“Our fight is not with Club Med,” he told Uncensored. “The municipality runs the launch site, and it is they who need to come to the party to figure out access.”

He is blunt about the cost. Over 18 months, he says, commercial operators have lost launching days, revenue and access to the ocean, left to launch only on the calmer days at Salt Rock, a beach he calls dangerous.

“Charter boats have cancelled or cut trips and lost income. Recreational boating has stalled, and private investment with it, and the KZN Sharks Board has had less room to run its shark-safety work,” added Van Rooyen.

Van Rooyen: Over 18 months, the financial, operational and community impact has been substantial.

The ski boat club says it met municipal officials in April and put practical options for restoring access on the table. It is still waiting for a way forward.

The squeeze, on paper

What the ski boat club did get was a run of signals pointing the other way.

First came the numbers. At a public meeting at Adventure Church in November 2025, attended by close to 100 people, the municipality proposed amending the site’s management plan.

The daily launch limit would fall from 30 to 12. Club Med would become the sole operator. Only the resort’s tractors would be allowed on the beach, with everyone else parking at the top and their boats ferried down a private road.

The ski boat club, which owns its own equipment and employs its own safety officer, opposed the plan and says it only learned of the proposed changes when a member spotted the public notice.

Then, in March 2026, the ski boat club and the landowner, Tinley Leisure, drew up a memorandum of understanding to break the deadlock. Under it, the launch site would be shared by the ski boat club’s fleet, Club Med’s charters, and the National Sea Rescue Institute, with up to 30 launches a day, co-managed by the club and the resort. The ski boat club signed it. The Tinley Leisure signature block is blank.

The developer’s position hardened from there. In an email to the club’s contacts, the head of legal at Syncerus Holdings, writing for Tinley Leisure, stated that the landowner “has no obligation to provide access through its privately owned land and will not be providing access,” and that there is “no commercial basis” on which it could contract with the ski boat club.

There is a detail the developer’s letter leaves out. When Versteijnen appealed the resort’s environmental authorisation, the appeal was dismissed and the authorisation was confirmed.

But the same ruling instructed the developer to “urgently” engage all parties and agree on a temporary solution for the public launch site, failing which the department could invoke compliance measures.

EDTEA’s Coastal Unit later told the developer directly that its no-access stance “is not aligned with the requirements as understood in terms of the MEC’s appeal decision and the EIA authorisation,” and referred the matter internally.

Just use another site, they say. The data says no.

Of the four public launch sites on this stretch of coast, Tinley Manor was the practical one for commercial work.

Blythedale, the nearest commercial site, caps launches at 15 a day and, in Versteijnen’s account, means a 2.5km haul through cane and dune. Salmon Bay at Ballito is the busiest launch on the coast, but the 2024 register records no commercial launches there at all, and Versteijnen holds no permit for it.

That is why, on the day the photograph was taken, he was on a swimming beach in the first place, launching under a departmental permit that runs until 2027.

Uncensored first put his case to air in November 2025, before the story reached the wider press.

The heritage is real, too. The Umhlali Ski Boat Club has operated the launch site since the early 1970s, more than half a century, and some members bought homes nearby on the understanding that they could launch there.

The gate, and the question

On Saturday, 8 August, about 25 boats and vehicles drove in convoy to the closed Club Med gate to hand over a memorandum. Neither the municipality nor the developer sent anyone to receive it.

Strip away the resort’s scale and the lawyers’ letters and one plain fact remains. A stretch of public coast, gazetted by the province, authorised to the municipality, monitored by the state and used 513 times in its last full year, has been closed to the people it belongs to for a year and a half.

It does not have to be a fight. All the ski boat club is asking, John van Rooyen told Uncensored, is that access to the public launch site be restored and that the municipality, which runs the site, lead the way in getting it done.

“It is not a big ask for a piece of public coast,” he said.

Lately, I’ve noticed a change in how people talk about the news. Not anger or outrage but something quieter. A sentence that trails off rather than lands: “I don’t read the news anymore, at least, not as I used to.” Sometimes it’s said with a shrug, sometimes with guilt but more often with relief.

I recognise the impulse, even though disengagement is not an option for me.

I don’t encounter South Africa’s failures through headlines alone. My work takes me into audit reports that don’t reconcile, forensic investigations that circle the same conclusions without consequence, leaked documents that arrive cautiously, and whistleblower accounts weighted with fear and calculation. I spend days verifying claims, cross-checking figures, confirming timelines, and working out what can be proven rather than what merely feels true.

I unravel these stories for a living. Still, there are days when the accumulation feels heavy. Not because the work doesn’t matter, but because so much of it lands without effect.

That is the quiet context in which we are approaching another election cycle.

The system feels broken; that much seems settled. What is no longer settled is whether staying engaged still matters.

Switching off can feel like relief, muting the noise and stepping out of the churn to protect your mental space from a steady diet of failure and delay.

I understand the appeal, but disengagement carries a cost, even when it feels rational.

As a journalist, I sit uncomfortably with that question.

I still believe in exposing failure, I wouldn’t be doing this work if I didn’t. But I’ve learned that exposure on its own doesn’t carry the weight it once did. When nothing follows, when no one is held to account, revelation begins to feel circular. Over time, the work has shifted for me. It is less about naming what has gone wrong and more about understanding how decisions are made, where power actually sits, and where it has, on occasion, been forced to bend.

Against that backdrop, I’ve been paying close attention to how political movements elsewhere are trying to reach audiences who have already tuned out.

Recently, the UK Green Party released a campaign video that deliberately breaks with conventional political messaging. It isn’t polished nor dense with policy. It is raw, emotionally direct, and unembarrassed about its anger. The tone assumes scepticism. It assumes exhaustion. It speaks to people who feel spoken over, managed, or ignored by institutions that no longer seem responsive.

What struck me was not the ideology itself, but the strategy.

The video does not assume an attentive audience. It does not presume trust. It starts from the premise that large parts of the electorate are no longer listening by default. Engagement, it suggests, has to be earned.

South Africa is not the UK. Our political terrain is more fragmented, more unequal, more burdened by history. Imported rhetoric rarely lands cleanly here. But the underlying insight travels. People are not disengaging because they are ignorant. They are disengaging because they feel trapped inside systems that absorb pressure without reforming.

This is what I think of as the doom loop.

Failure is exposed. Outrage follows. Nothing happens. Attention wanes. The next failure lands in a quieter room, perhaps as a headline scrolled past on a phone at the end of a long day.

Over time, the loop becomes self-reinforcing. Journalism documents decline. Audiences disengage. Institutions face less pressure. The space for accountability shrinks further.

Breaking that loop doesn’t mean pretending things are better than they are. It requires something more difficult: showing how consequence can still follow visibility.

This is also what many people who avoid reading the news are still quietly looking for. Not cheerfulness or spin, but evidence that change is possible. Clear explanations of how it happens. Proof that effort connects, however imperfectly, to outcome.

Optimism, in this sense, is not denial. It is earned through evidence.

One of the clearest examples of this comes from outside politics altogether.

In the Brazilian Amazon, one of the most significant factors in reducing deforestation during parts of the past two decades was not a sweeping new law or a single campaign. It was the widespread availability of satellite data. Once deforestation could be seen in near real time, ignorance was no longer plausible. The facts were visible, public, and verifiable.

The technology itself wasn’t the solution. It just made it harder to look away.

That transparency altered incentives. It enabled enforcement where political will existed and created pressure where it did not. By grounding debate in observable fact, it narrowed the space for denial.

The lesson extends beyond forests.

Many systems do not fail because of a lack of passion or intelligence. They fail because of fatigue, fragmentation, and eroded trust. Addressing those problems requires more than better messaging. It requires designing work and telling stories in ways that allow people to stay engaged without burning out, to learn from failure without shame, and to see how their efforts connect to outcomes that matter.

For journalism, that has meant discipline.

Not every story is for everyone. Not every investigation needs to chase maximum reach. A more honest starting point is clarity about where consequence is possible. Whether that lies with a regulator who can act, a court that can compel compliance, a parliamentary committee that can summon officials, a municipal council facing public scrutiny, or voters deciding whether participation still feels worth it. Different audiences require different forms of evidence and different kinds of narrative.

Relevance matters more than virality. This is where disengagement begins to carry political weight. As public systems weaken, those with resources start to find ways around them. They buy reliability where the state no longer provides it. Gated living, private security, backup power, water that runs, roads that are maintained. It is not indifference so much as an attempt to make daily life manageable. Those without those options remain exposed.

The public sphere narrows, but power does not. It becomes less visible, less contested, and harder to reach.

I don’t think the answer is constant outrage. I also don’t think the answer is withdrawal. I am less certain about what comes next, except that it has to sit somewhere between the two. Something that allows people to stay engaged without being consumed by it.

We are not uninformed. We are exhausted.

And until institutions, political movements, and journalism itself reckon honestly with that exhaustion, the question will remain unresolved at the centre of our public life. Does staying engaged still matter?

I don’t pretend this resolves the tension I’ve been describing. It doesn’t. But it does reflect where I am right now: unwilling to retreat completely, and equally unwilling to pretend that exhaustion isn’t real.

What I watched at Thornhill is playing out along the KwaZulu-Natal North Coast. People move onto land that belongs to someone else, divide it into plots and sell it for cash. Owners who obtain court orders to reclaim their land are left holding judgements that go unenforced. After months of examining court orders, police dockets and interviews with landowners, buyers and officials, a pattern emerges: organised groups are turning unlawful occupation into an extortion economy, operating in plain sight.

The law gives private owners one principal remedy: obtain a High Court eviction order. The process is slow. By the time an order is granted, more people have often occupied the land, yet only those cited in the application are bound by it. Every new arrival requires a fresh court application. Even a successful order ultimately depends on the police enforcing it. Owners who have exhausted their finances fighting through the courts are left watching their land disappear while those behind the invasions exploit every delay.

This story is not about the landless. South Africa’s demand for land is real, rooted in generations of dispossession, and many people who occupy vacant land do so because they have nowhere else to go. It is about those who have turned that desperation into a business by selling land that was never theirs to sell, taking money from some of the country’s poorest people while stripping owners, the state and the landless alike of any legal certainty.

The North Coast promotes itself as one of South Africa’s fastest-growing investment corridors. On 4 July, only a few kilometres from Thornhill, Club Med opened its first southern African resort at Tinley Manor, a R2 billion development and the most expensive resort ever built in the country. The developer publicly thanked KwaDukuza Municipality for working alongside it weekly, even daily, to move approvals forward.

That is the municipality at its most effective. This is the same municipality, on the same coastline, telling a landowner a short drive away there is nothing it can do

What Thornhill is

Thornhill is a 104-hectare private property off the R102 between Stanger and Groutville. In 2009, the KwaZulu-Natal Development Tribunal approved plans for a middle-income housing development of about 2,300 homes, together with a school, commercial sites and public open space. Every required state approval had been obtained, including environmental authorisation. As a condition of approval, the owner, whom this publication is not naming for safety reasons, installed bulk water, sewerage and electricity infrastructure at a cost of millions of rand.

The project was intended to provide something the North Coast has very little of: housing for the missing middle, families who earn too much to qualify for a government-subsidised house but too little to enter an increasingly unaffordable private property market. The invasion did not only take a developer’s land. It took the potential homes those families were meant to occupy.

Then came the people who make a business out of other people’s property. What has emerged resembles a land mafia: organised land-invasion syndicates that identify vulnerable private and public land, divide it into plots and sell it, often claiming to act on behalf of a traditional authority despite the land being privately owned and registered in the Deeds Office. Buyers hand over money for stands that have no legal existence.

The tactic is well established on the North Coast. Private farmland has been divided into plots and sold for between R20,000 and R50,000, often accompanied by claims that the land falls under customary authority or restitution rights.

Sworn statements in the police docket record that several Thornhill buyers were told the property fell under the Dube chief or the Qwabe clan and that they believed the plots were being lawfully allocated through customary authority.

In February 2026 I asked the Dube and Qwabe traditional authorities, the Ingonyama Trust, the provincial Department of Cooperative Governance and Traditional Affairs, iLembe District Municipality and KwaDukuza Municipality whether Thornhill fell under any traditional authority and whether the sales had been authorised. My enquiry was passed between offices and, despite repeated follow-ups, none answered the questions.

Most of the structures now standing at Thornhill are permanent brick-and-mortar houses rather than informal shacks, indicating that many buyers had the resources to build. Others clearly did not. I met one woman who told me she had paid R25,000, her entire life savings, for a plot that a High Court has since ordered her to vacate.

What enforcement actually costs

The owner has approached the High Court three times in an attempt to reclaim his land.

The first eviction order, granted in April 2024, was executed at his own expense. He paid the sheriff, hired earthmoving equipment and demolished the illegal structures. He then spent more than R200,000 securing the property with fencing. Within days the fence had been torn down, new structures were going up and the private security company he had hired withdrew after its staff were threatened by men carrying high-calibre firearms.

A second eviction order, granted on 15 September 2025, gave the occupiers until 30 September to leave. This time the police did not enforce it.

A third application is now before the Pietermaritzburg High Court. The owner’s legal costs have run into the millions while the settlement continues to expand.

The civil litigation has been matched by a criminal case.

The owner laid fraud charges against two men alleged to have organised the illegal sale of plots at Thornhill. According to the National Prosecuting Authority, each accused faces 11 counts of fraud and one count of theft. The case has appeared in the KwaDukuza Magistrate’s Court about 20 times without a single witness giving evidence.

The NPA says most postponements resulted from the accused failing to appear in court and that prosecutors have now asked the court to investigate the delays. The matter was set down for trial in April 2026. April came and went. It was postponed again.

The prosecution’s case depends largely on testimony from the buyers themselves, the very people the alleged organisers are accused of exploiting. Many have yet to come forward.

The municipality’s role

During the Thornhill proceedings, a member of KwaDukuza Municipality’s executive committee, part of the municipality’s political leadership, appeared in court in support of the occupiers and attempted to address the court on their behalf.

KwaDukuza also contracts an outsourced anti-land invasion unit at a cost of millions of rand each month, yet illegal structures continue to multiply.

Asked to comment in October 2025, municipal communications manager Sifiso Zulu said the Thornhill matter “is private and the municipality is not involved.”

The municipality is correct that a private landowner must obtain an eviction order. That does not mean it has no role. Illegal electricity connections draw power from the municipal grid. Municipal bylaws remain enforceable. An organ of state may also approach a court for urgent relief where circumstances warrant it. KwaDukuza has more legal options available than it acknowledges.

Thornhill is not alone

Thornhill involves privately owned land, where at least the owner has access to the courts. Elsewhere on the North Coast, even the state has proved unable to protect its own property.

At Umhlali, the law initially worked as intended. In 2021 the Pietermaritzburg High Court granted an eviction order over privately owned land and the Public Order Police removed the occupiers that September. The operation cost the owner more than R2 million in legal fees.

The occupation did not end. It simply moved.

The displaced residents relocated onto neighbouring land owned by Transnet, the state-owned rail company. What began as fewer than 100 people has grown into a settlement of about 2,000, a figure confirmed through site visits, drone footage and discussions with the settlement’s leadership.

The settlement has no formal sanitation, water or refuse removal.

In September 2025 an Umhlali business owner formally alerted Transnet to sewage flowing down embankments onto public roads. Transnet classified the complaint as urgent, referred it to its legal division and arranged a stakeholder meeting with KwaDukuza Municipality the following month.

Only Transnet attended.

I later submitted six questions to Transnet, including why a state-owned company had failed to secure its own land months after receiving formal notice. Its response did not directly answer the questions, saying only that the matter remained with its legal team.

Elsewhere on the North Coast private landowners battle the state to enforce court orders.

Here the state is the landowner, and it has been no more successful protecting its own property.

Behind the Shaka’s Head settlement, more than 5,000 people occupy municipal land earmarked for development along the P445.

In that matter the court suspended an eviction until KwaDukuza installs bulk infrastructure at the relocation site, Vlakspruit Farm.

Eight months later, the services had still not been installed.

What the state breaks, the syndicates exploit

The failure at Vlakspruit is not an isolated case. It points to a deeper problem: the collapse of KwaDukuza’s housing delivery.

KwaDukuza is one of only a handful of municipalities in KwaZulu-Natal accredited to act as its own housing developer. It receives housing grants directly from the provincial Department of Human Settlements and delivers projects in its own name.

Yet the municipality’s own records tell a stark story.

Over the five years to 2021, more than R568 million in housing funding was allocated to KwaDukuza. During that period, fewer than 1,100 houses were confirmed completed.

The municipality has also spent hundreds of millions of rand acquiring land intended for housing.

Council resolutions and Deeds Office records show that R44.7 million in provincial funding was used in 2020 to purchase farmland at Shakaskraal for the Rocky Ridge housing project. Hyde Park Farm was bought for R55 million in 2011. Thelula Farm followed in 2016 for R21 million. Vlakspruit Farm was acquired in 2013 for R59 million, a price an independent valuation later found to have been inflated for portions of a sugar farm without services.

Some of the land was subsequently leased back to farmers.

Years later, not one house stands on any of those properties.

Where housing projects have proceeded, the record raises further questions.

Rocky Park, launched in 2010 as KwaZulu-Natal’s first Breaking New Ground rental pilot, was intended to deliver 350 units for R330 million. Only 18 units were built and not one could be certified for occupation.

Two forensic investigations, one completed in 2019 and another commissioned by the Office of the Premier and presented to council in September 2025, found that the contractor had been paid R116 million for work independently valued at R57 million. They also identified payments made after the contract had expired and R41.6 million in missing payment vouchers.

Neither report has been released publicly. Councillors received summary presentations rather than the full findings. To date, no money has been recovered and no official has been held accountable.

This is the environment in which organised land syndicates flourish.

Covid-19 intensified an already severe housing shortage, pushing more families beyond the point where they could wait years for formal housing. Vacant land intended for future development became an opportunity.

The syndicates did not create KwaDukuza’s housing crisis - they recognised it as a market.

They profit from selling land that was never theirs because demand exists, housing projects stall, and enforcement repeatedly fails.

The law in the middle

At the heart of this dispute is the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE), enacted to end the arbitrary evictions that characterised apartheid and to ensure that unlawful occupiers are afforded due process before being removed. Few would argue for a return to the forced removals of South Africa’s past. The question is whether protections designed for the vulnerable are now being exploited by organised syndicates that profit from unlawful occupations while those financing them remain largely beyond the reach of the law.

The Department of Human Settlements appears to recognise that concern.

In April it published the PIE Amendment Bill, proposing prison terms and fines of up to R2 million for those who organise or profit from unlawful land invasions. Public submissions close on 6 August. Critics, including the Institute of Race Relations’ Anthea Jeffery, argue the amendments could make urgent evictions even more difficult. I put those competing arguments, and the Thornhill case itself, to North Coast property and land-use attorney Gavin Steinhobel. That conversation appears in full in this week’s episode of the Uncensored podcast.

A new criminal offence will mean little if the state cannot enforce the laws it already has. A R2 million fine is meaningless if those accused of orchestrating illegal land sales never stand trial, and a High Court order carries little authority if it can be ignored without consequence.

The question underneath it all

The failures exposed at Thornhill are neither abstract nor inevitable. They have names, institutions and decisions behind them: police who declined to enforce a High Court eviction order, a criminal prosecution that has appeared in court about 20 times without hearing evidence, a municipality that says it is not involved while illegal electricity is drawn through its own network, and hundreds of millions of rand spent acquiring land for housing projects on which not a single house has been built.

The consequences extend far beyond one farm outside KwaDukuza. Property rights either apply equally or they lose their certainty for everyone. When court orders cease to be enforceable, organised criminal networks do not create the vacuum; they exploit it. The greatest cost is borne not by those who profit from the system but by those who place their faith in it: the landowner who spends years and millions defending property already recognised by the courts as his own, and the woman who handed over R25,000, believing she was buying a place to build a future, only to discover she had bought nothing more than an eviction order.

This investigation began at Thornhill, but Thornhill is not the story. It is one example of a wider failure in which housing delivery has stalled, criminal syndicates have found a market, court orders have become increasingly difficult to enforce and public institutions have struggled, or in some cases failed, to respond.

Until those failures are addressed, the business of selling stolen land will continue to flourish along the North Coast.

The infrastructure the North Coast’s electricity supply depends on has only R5-million committed to it this year and no secured funding for the work that would finish it. KwaDukuza’s own budget documents confirm it.

In his budget speech to council on 28 May, Mayor Sduduzo Gumede called the Dukuza Substation the landmark investment of the medium term, a R125-million commitment made up of R5-million in the current 2026/27 financial year and R60-million in each of the following two years, 2027/28 and 2028/29.

The R5-million for this year is real money. It is internally funded, drawn from ring-fenced developers’ contributions that the municipality is now free to use after the conditions attached to them lapsed. But it does not come close to the cost of completing the project, and the source it draws on is finite.

The R120-million that would complete the substation, across the next two years, is a different matter. The budget describes that loan funding as having been considered, its own word, for 2027/28 and 2028/29. Considered is not approved, and it is not secured. The document sets out the rule plainly: capital expenditure not funded through grants can only commence once funds are received or an unconditional letter of commitment is obtained from the funding agency. The loan has neither.

The municipality has said as much itself. At a mayoral imbizo in April, acting municipal manager Siyabonga Khanyile told residents that efforts to secure national grant funding had been unsuccessful, and that the municipality had not yet accepted a loan, as it was still engaging provincial and national Treasury on the correct procurement process. The municipality, he said, was weighing whether to run a competitive bidding process with banks or to approach the Development Bank of Southern Africa directly. He raised a blended finance model, combining a grant and a loan, as a possible solution, while acknowledging that borrowing would increase the municipality’s financial burden.

ActionSA, one of two parties that rejected the budget alongside the Democratic Alliance, says that is the problem. The party’s KwaDukuza caucus leader, Nel Sewraj, said the R5-million this year comes from a reserve that should be protected, while the money to finish the project has not been secured at all.

“That R5-million is real, it comes from internal reserves, the ring-fenced developer contributions. That is why the mayor says the money is there. But it is a one-off reserve. It can be used, but it should be kept for future infrastructure growth. It is not sustainable to deplete it and eat into our future capacity,” Sewraj said. “And you cannot budget to spend loan money you have not secured. That is why this budget is not credible as far as ActionSA is concerned.”

The substation, under construction on the P445 between the Umhlali Country Club and the R102, opposite the Shaka’s Head informal settlement, was meant to address a growing pressure on the network. Once commissioned, it would feed the Zimbali, Ballito, Business Park, Shaka’s Rock and Imbonini supply points and create capacity for growth across the southern corridor toward the Dube TradePort. The project is being built in phases. The first phase is funded through National Treasury grants. The second phase, which carries the electricity supply infrastructure the region is waiting on, is the one that remains unfunded. The Dolphin Coast Residents and Ratepayers Association has put the project’s position bluntly: R320-million spent, a further R180-million needed, and no power yet delivered.

The association has been trying to see the paperwork behind that spending. DOCRRA filed a request under the Promotion of Access to Information Act, the law that gives the public a legal right to records held by government bodies, for the substation tender documents. The municipality did not cooperate.

The stakes sit in figures the mayor set out himself. In the same speech, Gumede told council that energy losses of R440-million to R480-million a year remain the most pressing financial challenge facing the municipality, driven by theft, illegal connections, meter tampering and billing inaccuracies. Bulk electricity purchases, at roughly R1.7-billion, account for more than half the municipality’s operating budget. The substation was meant to ease part of that strain and stabilise supply to the greater Ballito area.

For now it does neither. It sits part-built, carried this year by a one-off reserve and dependent for completion on a loan the municipality has not raised, described in the budget as funding only considered for years that have not yet begun.

The questions the budget leaves open are the ones that matter most. How will the loan be raised, and on what terms? What is the plan if it cannot be secured? When will the substation be finished? The municipality has committed R5-million from a reserve it concedes should be protected and named no date, no lender, and no fallback. Until it does, the project that was meant to secure the region’s power supply remains a plan without the money to deliver it.

It bets on R122 million in electricity savings from losses the municipality has never managed to control. It protects salaries for executives who received bonuses in a year when the municipality hit 38% of its targets. And it leaves unfunded the Dukuza Substation, the critical infrastructure that’s two years overdue and essential for powering some of the biggest employers on the North Coast: Sappi Stanger Mill, Hesto Harnesses, and Gledhow Sugar Mill. The municipality operates on a temporary Eskom arrangement that has already failed repeatedly. KwaDukuza has grown 37.8% since 2011 but increased electricity capacity by only 1.7% a year.

If you have been following the proposed six-storey development in Ballito Village, you will already know the outline of the application: a vacant site on Compensation Beach Road, a developer seeking to build what would become the tallest structure in the village, and a public response that grew from near silence to hundreds of formal objections.

What has not been reported until now is what happened inside the process itself.

The official record of a formal consultation meeting between KwaDukuza Municipality, the developer and their appointed professional team shows that key issues were identified but left unresolved: non-compliant parking, traffic modelling conducted outside peak seasonal conditions, and the absence of an updated planning framework for the area. Despite this, the Final Basic Assessment Report was completed and submitted to the province, advancing the application to the next stage of approval.

That sequence sits at the centre of this story.

A specialist environmental attorney has since filed a formal legal submission, arguing the assessment process was legally defective. The Dolphin Coast Residents and Ratepayers Association (DOCRRA), representing 7,000 North Coast households, files its own formal submission this week.

The documents reveal a 40-bay parking shortfall confirmed in writing by the developer’s own consultant, yet dismissed as someone else’s problem. The municipality acknowledges its own planning framework is obsolete but says developers need not wait for the replacement.

What is actually being proposed

The developer, Niche Investments, plans to build a six-storey mixed-use building on the vacant site next to Mozambique Restaurant - eight storeys if you include the two basement levels. The building will contain 52 serviced apartments, ground floor shops and restaurants, and a rooftop bar. At 20.25 metres it will be the tallest structure ever built in Ballito Village.

The site is privately owned. Most residents had assumed it was public open space. It is not.

What “environmental review” actually means

Before any major development can proceed in South Africa, the developer must commission an environmental study assessing the impact on the surrounding area, including traffic, parking, neighbourhood character and the natural environment. This study is called a Basic Assessment Report (BAR).

Critically, the developer appoints and pays the consultant who writes it. In this case, Niche Investments appointed Stephanie Denison of Confluence Strategic Development. She completed the report, concluded the development is environmentally acceptable, and submitted it to the KwaZulu-Natal Department of Economic Development, Tourism and Environmental Affairs (EDTEA), the provincial authority responsible for environmental approvals, for a final determination.

That determination has not been made. The province has 107 days to rule. Nothing has been approved. That is where things stand.

How this nearly happened without anyone knowing

When the development first went out for public comment in November 2025, almost nobody in Ballito knew it existed. The notice ran in a local newspaper’s classifieds column, which most residents never read. Signboards went up on the fence. An email went to people registered for previous unrelated processes.

After the entire first round of public participation, only eight submissions were received. Not one from an immediate neighbour.

In December 2025, Uncensored was the first publication to report on The Square to a wider Ballito audience. Residents who had never heard of it read it, shared it and objected. The original comment period closed on 19 January 2026. Following concerns about limited public awareness, Doccra requested an extension, which was granted until 30 January. By the time that window closed, registered objectors had grown from eight to 353.

What the official minutes reveal

A consultation meeting between the developers, their consultants and KwaDukuza Municipality took place on 6 February 2026. This is a standard step in the environmental process. The official minutes were circulated to all 353 registered objectors. Uncensored has reviewed them.

What they reveal is a consistent pattern: problems acknowledged, standards identified, solutions deferred.

On traffic and parking: The developer’s traffic consultant acknowledged peak holiday congestion but argued it is not appropriate to design infrastructure for peak periods only. His study was conducted on quiet weekday mornings in September. He stood by it. Municipal officials confirmed the development does not comply with their own parking requirements. The proposed solution: road verges, revised drawings and a parking fund contribution. Not solving the problem. Managing the paperwork around it.

On the Framework Plan: The document governing what gets built in Ballito Village - its scale, its character, its future - dates from 2009. The municipality acknowledges it is outdated and a replacement is being procured. Their position, recorded in the official minutes: developers do not have to wait for the new one. By the municipality's own admission, the rulebook that should protect Ballito Village is obsolete. And the most significant development ever proposed for the Village is being assessed without it.

On height: The developer argues that a four-storey building is not profitable enough. Only six storeys at 20.25 metres make the project viable. But the official minutes record something the public has not been told: the municipality's own town planner warned that making this argument could legally weaken the height relaxation application. It was raised internally. It stays in the minutes. Until now.

The developer’s own consultant confirmed the parking shortfall in writing

On 9 March 2026, Stephanie Denison sent a formal letter to all 353 registered objectors. It was presented as a response to their concerns. It is something else entirely.

She confirmed a 40-bay parking shortfall. In writing. In an official document. Not a disputed estimate - the developer’s own consultant stated plainly: there is a 40-bay parking shortfall. Her proposed solution is to construct 15 bays on Compensation Road, leaving a 25-bay deficit in a village already overwhelmed every weekend before this development adds a single additional car.

Her solution for peak holiday periods: a one-way routing system, a shuttle bus, pointsmen and driver advisory services.

The same letter dismissed all 353 objections as outside the scope of the environmental process. The concerns about height, density, infrastructure and the loss of Ballito Village’s character, she wrote, pertain predominantly to town planning matters. The relevant authorities would need to make a final determination.

Not her department. Someone else would handle it.

If it is not an environmental matter and it is not yet a town planning matter because that process has not started, then whose matter is it? That question sits at the heart of this story.

The legal opinion: five failures

A specialist environmental attorney has submitted a formal legal opinion to the province arguing the entire assessment process was legally defective and that authorisation should not be granted in its current form. Her submission, dated 1 April 2026, is already on the official record. DOCRRA’s own submission in support goes in this week.

Brian Pottinger, DOCRRA vice chair and chair of its Environmental Subcommittee, has read the opinion and described it as powerful. DOCRRA, he confirmed, intends to formally support it. But Pottinger’s concern extends beyond the legal technicalities. The developer justified the height increase from four to six storeys partly on the basis that bulk service charges make a four-storey building unviable.

“That way all developers can claim relaxation,” Pottinger said.

If that justification is accepted, every future developer in Ballito Village has a ready-made argument for breaking height limits. The Square would not be the exception. It would be the template.

Five things the law required. Five things that were never done.

1. No public meeting was ever held. Despite 353 registered objectors, community petitions and a detailed DOCRRA submission, not one public meeting was convened. No opportunity was afforded to residents to hear what was being proposed, ask questions and get answers in real time. South Africa's National Environmental Management Act gives effect to Section 24 of the Constitution, which guarantees every citizen the right to an environment not harmful to their health or wellbeing. The Act's guidelines require genuine public engagement when interest is this high, and a Supreme Court of Appeal judgment handed down in September 2025, months before this process concluded, reinforced that requirement. Without meaningful public participation, a process is legally defective from the start.

2. Nobody assessed what this building will actually look like. The government's own environmental screening tool recommended a visual and landscape impact assessment - a proper study of how a 20.25-metre building will alter the streetscape, the beachfront view and the human scale of a low-rise village. The consultant decided it was not required. When public objections came in, the official report upgraded its own visual impact rating from moderate to HIGH, conceding that the damage to Ballito Village's character will be severe. Yet no specialist study was commissioned. The report was submitted to the province regardless. The legal opinion argues that an upgraded rating alone triggered a mandatory assessment. It was not done.

3. The traffic assessment must be completely redone. Conducted on quiet weekday mornings in September, it excluded the 120 days a year when Ballito Village operates at or beyond capacity. On Saturday, 28 March 2026, the attorney visited Ballito Village and found no available parking in the village core, cars overflowing onto the beachfront road and feeder streets blocked. That is today’s baseline before 52 apartments, a restaurant, retail and a rooftop bar are added. The 40-bay shortfall cannot be resolved by road verges, one-way traffic, fund contributions, pointsmen or a shuttle bus. It is structural.

4. No genuine alternatives were considered. South African law requires a developer to honestly assess lower-impact options - a smaller footprint, reduced height, an alternative design, or the option of not proceeding at all. Two Constitutional Court judgments confirm this obligation is not a formality. What occurred here was that a four-storey option, within the current permitted zoning, was presented and immediately dismissed as insufficiently profitable. That was the entire alternatives analysis. One option. Ruled out on financial grounds.

5. The Village’s character was never treated as worth protecting. Ballito Village’s identity of low buildings, wide pavements, outdoor tables, and the smell of the ocean has real legal standing. The National Building Regulations require refusal of any building that will disfigure an area, be unsightly or objectionable, or reduce surrounding property values. These tests were never applied. One further matter has not been reported until now: a land claim was lodged over this property. Apparently dismissed on a technicality, it is unclear whether the claimants intend to appeal. This was never investigated before the report was submitted.

This is how Umhlanga happened.

Those who remember Umhlanga Rocks before the towers came remember a lighthouse, a beachfront, restaurants with tables on the pavement - a village that felt like somewhere rather than anywhere.

Then came the Pearls of Umhlanga.

The eThekwini Municipality indicated a preferred maximum of around 20 storeys for the key towers. What was built: Pearl Dawn at 31 storeys, Pearl Breeze at 25, later phases marketed at 40 floors and beyond. That escalation did not happen through one dramatic decision. It happened phase by phase, each approval individually justifiable, the outcome drifting upward until the skyline bore no resemblance to what residents had been shown at the start.

The Pearls redefined what could be approved and became the benchmark developers across the North Coast still cite when seeking height increases in coastal nodes.

Today Umhlanga is a compressed version of Sandton dropped next to the ocean. The village character it once traded on is gone.

Brian Pottinger has warned that what is permitted by exception can easily become the norm. The only question is whether Ballito is paying attention before that process begins here.

The province has 107 days to rule and that window is open. Any registered objector can formally challenge the application. Any member of the public can write to the province and place their concerns on record. It costs nothing. It takes five minutes.

KwaDukuza Municipality paid performance bonuses to senior executives during a period marked by declining service delivery, rising financial losses, a damning NERSA audit, and significant weaknesses in internal controls.

The municipality’s 2024/25 annual report records service delivery at 38% of targets, with overall performance declining to 70%.

Over the same period, electricity losses reached R386.93 million, the highest figure recorded by the municipality. Irregular expenditure rose to R106 million, and infrastructure spending fell short of the budget, while the Auditor-General’s findings paint a picture of a municipality struggling to govern itself effectively.

Despite these troubling indicators, senior executives earned between R1.8 million and R2.2 million, with bonuses awarded across multiple departments.

Notably, three of the municipality’s top officials, municipal manager Nhlanhla Mdakane, corporate services executive director Pamela Mntaka, and civil engineering executive director Thembela Nxumalo, are currently on precautionary suspension following a Section 106 forensic investigation into governance and financial management issues.

While these suspensions do not imply wrongdoing, they certainly cast a shadow over the decisions made during this period, including the awarding of performance bonuses.

A Revenue System Under Pressure

Nowhere is that pressure clearer than in the municipality’s electricity function.

Sibusiso Jali, executive director for electrical engineering, earned R1.83 million, including a bonus of R86,220.

During this period, KwaDukuza reported electricity losses amounting to R386.93 million, translating to a loss of 26.73% of electricity purchased - more than double NERSA’s acceptable threshold of 6% to 12%.

This failure is not new.

In 2022, the municipality engaged a service provider through the Vuthela Programme to undertake a root cause analysis and formulate a five-year Electricity Loss Reduction Plan (2022-2027), which proposed 60 strategic interventions aimed at reducing losses below NERSA's threshold by 2027.

However, by the 2024/25 reporting period, only four interventions had been completed, and thirteen were still in progress.

Electricity revenue is crucial for municipal operations. When this revenue is not recovered, the municipality incurs the cost of purchasing power while losing essential income for service delivery. This cumulative effect tightens cash flow, stalls maintenance, and increases operational pressure across departments.

Over the past three financial years, civic organizations estimate that unbilled electricity has exceeded R1.2 billion.

Public Concerns and Oversight Questions

The issues surrounding performance bonuses and declining service delivery were raised during public consultations on the annual report.

Submissions from the Dolphin Coast Residents and Ratepayers Association (DOCRRA) and the KwaDukuza Ratepayers Organisation (KORA) expressed concerns over both the municipality's performance and the decision to award bonuses.

Their discussions with the Municipal Public Accounts Committee (MPAC), which oversees municipal spending and audit outcomes, yielded recommendations largely identical to those made in the prior year, highlighting a troubling pattern of unresolved issues.

In their written comments, ratepayer groups posed critical questions:

What criteria were evaluated in determining the performance bonuses and why should ratepayers pay for this lack of performance?

Limited Accountability and Consequence Management

Oversight records indicate that identified issues lacked immediate corrective action.

In the case of electricity losses, no action was recorded against senior officials during the financial year under review. Responses instead pointed to adjustments in future performance measures, including additional weighting for energy losses.

Similar concerns arise regarding irregular expenditure, where findings were not consistently investigated to determine accountability.

Ineffective Controls and Governance Weaknesses

Pamela Mntaka, executive director for corporate services, earned R1.83 million, including a bonus of R86,220.

The Auditor-General’s findings point to weaknesses in governance and financial controls.

Irregular expenditure reached R106 million and was not consistently investigated.

The AG also flagged potential conflicts of interest, including instances where employees shared contact details with suppliers, raising concerns about procurement integrity.

Furthermore, inadequate record-keeping delayed the provision of information during the audit process. Supply chain management delays were also identified as affecting project implementation.

These findings indicate a control environment that did not operate effectively in all areas.

Mntaka is among the officials now on precautionary suspension.

Infrastructure Delivery Shortfalls

Thembela Nxumalo, executive director for civil engineering, earned R1.29 million. No bonus is recorded.

His department is responsible for roads, stormwater systems and infrastructure delivery. Capital spending reached 83% against a 90% target, while the Municipal Infrastructure Grant, ring-fenced national funding designated specifically for infrastructure, was underspent at just over 71%.

Such underspending on conditional grants can prevent communities from receiving promised infrastructure and may lead to clawbacks by the national government, jeopardizing future funding.

This corresponds with projects not being completed within planned timeframes.

A bridge design remained incomplete. A crèche project did not meet its milestone. Other infrastructure projects were delayed or left unfinished.

Housing delivery also fell short, with 78 houses constructed against a target of 90.

DA caucus leader Privi Makhan criticized the reliance on consultants in the civil engineering function, citing stalled disaster-funded projects despite R1.2 billion in funding.

Nxumalo is also among those on precautionary suspension.

A Broader Pattern of Poor Performance

A consistent pattern emerges across departments.

• Sikhumbuzo Hlongwane, executive director for economic development and planning, earned R1.94 million, including a bonus of R155,197. Auditor-General findings indicated a disconnect between reported performance and actual outcomes, with limited evidence of completed developments, tangible investment attraction or job creation.

• Mandla Manzini, chief operations officer, earned R1.92 million with a bonus of R137,953, with missed targets attributed to coordination and operational challenges.

• Siyabonga Khanyile, executive director for community services, earned R1.91 million with a bonus of R166,932. His projects faced delays, impacting public access to facilities.

• Cecil Viramuthu, executive director for community safety, earned R1.89 million with a bonus of R155,197, with the report reflecting a decline in service conditions.

Accountability at the Top

Municipal manager Nhlanhla Mdakane, as accounting officer, earned R2.23 million, including a bonus of R64,389.

The annual report signals declining performance, rising losses, and governance concerns under his oversight.

Mdakane is also among the three officials currently under precautionary suspension, with the Section 106 investigation focusing on financial management, procurement systems, and oversight - areas central to his responsibilities.

The Auditor-General emphasized that sustainable improvement hinges on strong leadership, effective council oversight, and urgent corrective action implementation.

ActionSA caucus leader Nel Sewraj characterized the findings as indicative of "a municipality in crisis," lamenting that the losses and irregular expenditure could have been redirected to enhance service delivery, with residents ultimately suffering from a lack of accountability.

Conclusion: What Was Rewarded?

The municipality’s reporting for the period reflects:

• Service delivery at 38%

• Electricity losses of R386.93 million

• Irregular expenditure of R106 million

• Debt increasing instead of meeting reduction targets

• Projects delayed or incomplete

• Capital underspending and MIG underspending at 71%

• Recurrent governance findings from the Auditor-General

Amid this backdrop, performance bonuses were awarded to KDM’s senior executives without clear alignment to these outcomes.

Performance bonuses are intended to recognise delivery, effective management and sound financial control.

In most performance-driven environments, such significant shortcomings would typically trigger a thorough review and corrective measures.

However, in this instance, bonuses were granted despite the evident decline in service delivery and financial performance.

The critical question, raised by ratepayers and reflected in oversight proceedings, remains:

“What criteria were used to justify the awarding of these bonuses?”

KwaDukuza’s latest annual report shows service delivery has dropped to just 38%, down from 58% the year before.

At the same time, performance bonuses were still paid to senior municipal officials, with some payouts running into hundreds of thousands of rand.

That is the disconnect. If delivery is falling, what exactly is being rewarded?

On parts of the North Coast, a different pattern is emerging: a shadow network of brokers presenting themselves as having the authority to allocate plots, often by telling buyers the land falls under traditional control.

At Thornhill, the consequences are now visible. Homes built outside the lawful framework appear connected to the electricity grid, even though they do not form part of the municipal billing system and pay no rates for the services they use. That is placing added pressure on infrastructure never intended to support unregulated development, while shifting the financial burden onto compliant ratepayers.

What has deepened concern is the lack of action from authorities. Despite court orders, criminal allegations and the visible expansion of unlawful building, enforcement has stalled.

The shortfall is draining one of the municipality’s biggest sources of revenue and raising fresh questions about governance, billing systems and oversight of major power users.

Municipal financial statements show that 29.19% of electricity purchased from Eskom during the first quarter of the 2025/26 financial year was not billed to consumers. At current tariff levels, that translates into roughly R1.3 million in lost revenue every day.

Civic organisations estimate the cumulative financial impact over the past three years has exceeded R1.2 billion.

The financial damage is already visible in the municipality’s books. KwaDukuza’s 2025/26 adjustment budget, presented to council in February, shows an operating deficit of R219.6 million. Officials attribute much of the shortfall to rising bulk electricity costs and persistent electricity losses.

Electricity resale is one of the most important revenue streams for South African municipalities. Councils buy power from Eskom and resell it to households, businesses and industry, using the margin to help fund services such as road maintenance, infrastructure upgrades and street lighting.

When that electricity is consumed but never billed, the revenue disappears. In effect, the municipality is paying Eskom for electricity that generates no income in return.

The KwaDukuza Residents Forum (KDRF) says losses on this scale threaten the municipality’s financial viability and the stability of essential services.

Municipal officials have previously linked high electricity losses to illegal connections in townships and informal settlements. But civic organisations say that explanation cannot account for losses of this magnitude.

Both KDRF and the Dolphin Coast Residents and Ratepayers Association (DOCRRA) argue that the scale of unbilled electricity points to deeper failures in the municipality’s electricity metering, billing and oversight systems.

Triple National Norms

Electricity losses occur in all municipal networks, typically because of technical transmission losses, infrastructure faults or theft.

But the level recorded in KwaDukuza is far above what is generally considered financially sustainable.

National Treasury guidance indicates that electricity losses in municipal systems typically range between 7% and 10%. KwaDukuza’s reported losses of 29.19% place the municipality at roughly three times the national norm.

The issue has already drawn national regulatory attention. Following a complaint by DOCRRA, the National Energy Regulator of South Africa (NERSA) conducted a compliance audit of KwaDukuza’s electricity distribution operations.

Billing and Metering Failures

The scale of the losses has also raised questions about how electricity consumption is measured and billed.

According to Warwick Chapman, chair of the KDRF, internal municipal reviews have already identified weaknesses in the municipality’s electricity metering and billing systems.

Chapman said an audit of 493 large electricity users found that 118 customers required back-billing because their electricity consumption had been under-recorded.

Large power users include shopping centres, factories and major commercial developments whose electricity consumption can run into millions of rand per month.

Municipal officials have acknowledged that some of these customers were not properly monitored because of outdated or faulty metering systems.

“You do not get losses of this size without large power users being involved,” Chapman said.

Delays Stall Recovery Efforts

Mary Kassam of DOCRRA has also raised concerns about the municipality’s response.

Speaking in an interview on the Uncensored podcast, Kassam said the municipality had previously indicated that a private-sector service provider would be appointed to implement a large power-user reconciliation programme.

The programme was intended to identify discrepancies between electricity purchased from Eskom and electricity billed to consumers, and to recover lost revenue.

A proposal outlining the intervention was presented to council. However, the contract has still not been finalised.

According to Kassam, municipal officials have repeatedly committed to timelines they later failed to meet.

At an IDP and budget meeting in October 2025, Sibusiso Jali, executive director of the electricity business unit, said the contract would be finalised.

During a meeting with civic organisations two months later, officials again shifted the timeline, saying the agreement would be signed by the end of January.

Later reporting to the Municipal Public Accounts Committee (MPAC) indicated the contract would instead be signed by the end of the second quarter of the financial year.

KwaDukuza is now already in the third quarter.

“The goalposts keep shifting,” Kassam said.

Officials Promise a “Governance Reset”

Responding to questions from DOCRRA at a recent MPAC meeting, Jali said the municipality’s strategy to reduce electricity losses was continuing.

Officials were revisiting the analysis of the root causes and working toward what he described as a “governance reset”, supported by a new implementation framework.

He did not provide a timeline for when the revised strategy would be finalised.

Civic organisations say KwaDukuza’s leadership has squandered years while electricity losses spiralled, and that the latest reform promises may come only after severe financial damage has already been done.

KDRF has called on Jali and the senior management team of the electricity business unit to step down, saying their failure to halt the losses has wrecked public confidence in those charged with protecting the municipality’s single most important revenue stream.

The “Elephant in the Room”

For Chapman, the scale of the losses also raises uncomfortable questions about large electricity consumers.

During the interview, he suggested that meters serving major users could, in some cases, be manipulated to record lower consumption than is actually used.

“If you have a R3-million monthly electricity bill and someone tells you they can adjust the calibration of your meter so that it becomes a R1-million bill,” Chapman said, “and all they ask in return is a monthly payment, that becomes a parallel income stream.”

The scale of the losses, he argued, makes it difficult to ignore the possibility that corruption is contributing to the problem.

Chapman also questioned why the issue has not triggered stronger responses from political parties represented in council.

“This is the single greatest threat to the financial viability of the municipality,” he said.

“And yet you have to search hard to find our opposition political parties saying anything substantial about it.”

Cost to Residents

For civic organisations monitoring the issue, the crisis confronting KwaDukuza is no longer simply a technical failure within the electricity network.

They say it is fundamentally a governance issue.

Electricity losses of this magnitude have appeared in municipal reports for several years, yet many of the proposed corrective measures have not been implemented.

Electricity sales revenue is one of the primary funding sources for local government services. Money lost through unbilled electricity cannot be used for infrastructure upgrades, maintenance or repairs to ageing municipal systems.

For residents, the consequences are not abstract.

Electricity revenue helps fund the basic machinery of local government. When that money disappears, so does the municipality’s ability to maintain infrastructure, repair failing systems and sustain essential services.

Civic organisations warn that unless KwaDukuza brings its electricity losses under control, the municipality risks sliding deeper into the kind of financial crisis already crippling councils across South Africa.

In this episode of Uncensored, representatives from the Dolphin Coast Residents and Ratepayers Association (DOCRRA) and the KwaDukuza Residents Forum (KDRF) confront one of the most pressing issues facing the municipality. Nearly R242 million in electricity losses and growing financial pressure on the municipal budget.

Electricity losses of this scale affect every resident and every business across the KwaDukuza region through rising tariffs, unreliable supply and delayed infrastructure.

If you live or work anywhere on the North Coast, this conversation matters.

In KwaDukuza, water outages are no longer occasional disruptions but part of daily life. Taps run dry without warning, businesses scramble to secure backup supply, and families keep containers filled because they cannot rely on the system. In some neighbourhoods, water is off for days at a time. Tankers are announced, but they do not always arrive, and when they do, the supply is quickly exhausted.

The 41% Problem

The issue is not seasonal rainfall but system management. On 27 January 2026, the iLembe District Municipality tabled its 2024/2025 Annual Report.

Inside that document is a figure that frames the scale of the problem: 41% of all purchased water was lost in a single financial year.

In rands, that amounts to R123.76 million. In practical terms, it is treated water that was bought, processed and pumped into the network but never reached a paying customer.

iLembe District Municipality is responsible for water and sanitation across four local municipalities: KwaDukuza, Mandeni, Ndwedwe and Maphumulo.

Together, these areas make up the iLembe district, stretching from the north coast through inland rural communities. The district operates the water treatment works and maintains the bulk pipelines that supply these towns and surrounding settlements.

The only exception is in specific concession areas in Ballito, where services are operated by Siza Water under a long-term agreement. Outside those areas, responsibility for water provision rests with the district.

Water losses above 25% are generally regarded as inefficient. At 41%, the system is under serious pressure.

Ageing pipes, illegal connections, faulty meters and overflowing reservoirs all contribute to the losses. The effect is straightforward: less water reaches homes and businesses, and less revenue is available to repair and upgrade the infrastructure.

Stopgaps Instead of Solutions

The district has increasingly relied on water tankers as a temporary solution. Millions have been spent on procurement while the underlying loss rate remains high. In parts of the district, residents report going days without water and rarely seeing a tanker. When one arrives, demand quickly outstrips supply.

Yet municipal accounts continue to be issued, reinforcing the perception that residents are paying for a service that cannot be guaranteed.

A tanker may ease a shortage for a day. It does not fix a system.

Governance Under Pressure

The same annual report highlights governance concerns.

The Auditor-General recorded R37.51 million in irregular expenditure, largely linked to procurement and contract management failures. Some suppliers were not paid within the required 30 days. Debt collection controls were weak. In certain cases, irregular spending was not fully investigated to determine accountability. A material error in service delivery reporting had to be corrected during the audit process.

These findings point to weak internal controls in a municipality already struggling to maintain its core service.

The cost of running the institution adds another layer to the debate.

In the same financial year that R123.76 million in water was lost, the municipality spent R266.9 million on employee costs. Senior managers earned basic salaries exceeding R1 million each, excluding benefits.

There is nothing improper about paying for experience and expertise. But when nearly half of purchased water does not reach consumers, residents are entitled to ask whether performance matches pay. What operational improvements can be clearly demonstrated? What targets are in place? And what happens when those targets are not met?

Enterprise iLembe and the Transparency Question

The same scrutiny applies to Enterprise iLembe, the district’s economic development agency.

The municipality transferred R42.29 million to the agency during the same period. It is governed by a ten-member board made up of five paid non-executive directors and five representatives from the district and its local municipalities. The agency is funded through allocations from the district’s budget - the same public funds responsible for delivering basic services such as water.

The Auditor-General identified governance weaknesses at the agency as well.

Key documents were submitted late. Financial statements had to be corrected during the audit process. Certain gifts were not properly disclosed.

That detail matters. Disclosure rules exist to protect public trust. When gifts are not declared, transparency is weakened.

Beyond compliance issues lies a broader question of accountability.

Enterprise iLembe’s board and executive remuneration are not presented in a manner that allows straightforward public scrutiny. How much are non-executive directors paid? What are the full executive packages? Why are these figures not clearly itemised?

More importantly, what measurable outcomes justify R42.29 million in public funding? How many sustainable jobs were created? What tangible economic gains can residents point to?

Development cannot be abstract. It must be visible and measurable, particularly in a district struggling to stabilise basic services.

The Hard Truth

Across iLembe, the pattern is becoming familiar. Water outages recur. Emergency measures persist. Audit findings are noted and carried forward.

Elsewhere in South Africa, similar trajectories have preceded far deeper crises. Municipal systems did not fail overnight. Governance weaknesses were acknowledged but not corrected until they hardened into systemic problems.

iLembe is not there yet, but a 41% loss rate, repeated audit concerns and rising costs alongside infrastructure instability are not isolated issues. Together, they form a warning.

Unless consequences begin to match the scale of failure, iLembe District risks learning a harsh lesson: systems do not collapse in a single moment.

They leak - until there is nothing left to pump.

Tongaat Hulett’s long-running business rescue has taken a decisive and troubling turn.

On Thursday, the company’s Business Rescue Practitioners (BRPs) confirmed they have approached the KwaZulu-Natal High Court to place the sugar producer into provisional liquidation.

The move signals a likely end to a three-year attempt to stabilise the once-dominant agribusiness, which has been battling debt, governance failures and operational strain since 2022.

The application follows the collapse of a key funding arrangement with investment group Vision. Without that funding, the approved business rescue plan cannot be implemented, leaving the company with few options.

From accounting scandal to crisis

Tongaat entered business rescue in October 2022, three years after a major accounting scandal first surfaced.

Investigations revealed that senior executives had overstated profits and assets over an extended period, materially misrepresenting the company’s financial position. Once the irregularities came to light, Tongaat was forced to restate its financial results.

The fallout was severe. Around R12 billion in shareholder value was wiped out.

The share price collapsed, lenders tightened exposure, and liquidity pressures mounted. Heavily indebted and struggling to generate cash, the company sought protection through business rescue, framed as a last opportunity to restructure its balance sheet and stabilise operations.

The deal that was meant to save it

In January 2024, creditors approved a rescue plan anchored by Vision Group, which would acquire Tongaat’s operations and recapitalise the business.

The plan depended on significant funding commitments.

Central to this was R2.3 billion advanced by the Industrial Development Corporation (IDC) to keep Tongaat operating during business rescue. Vision was required to secure financing to assume that obligation.

The agreement also required Vision to deposit R517 million into a protected escrow account - money held by a third party until certain legal matters involving the South African Sugar Association were resolved.

In addition, R75 million had to be made available for certain creditors.

According to the BRPs, binding funding agreements were never concluded.

As implementation deadlines approached, the practitioners sought a short extension to continue negotiations. Vision indicated it was prepared to extend the arrangement, but subject to new conditions. The practitioners said those conditions were inconsistent with the approved rescue plan and introduced additional commercial risk.

The sale agreements lapsed on 7 February 2026. With that, the rescue plan effectively fell away.

An immediate financial threat

Tongaat has since received a letter of demand from Vision for approximately R11.7 billion, which Vision says is due and payable immediately.

The BRPs said this demand poses a serious and immediate threat to the company’s solvency.

If the KwaZulu-Natal High Court grants provisional liquidation, business rescue will formally terminate, and a provisional liquidator will be appointed.

Creditors would then submit claims, and the company’s assets could be realised to repay outstanding debt.

While operations do not automatically cease, control of the company would shift from the rescue practitioners to the appointed liquidator, who would oversee the winding-up process.

What it means for the North Coast

For the KwaZulu-Natal North Coast, the implications are significant. Tongaat is one of the region’s key sugar producers and a major off-taker for cane growers. Hundreds of direct jobs are tied to its milling and agricultural operations, with many more seasonal workers, contractors and small businesses dependent on the broader sugar value chain.

Communities across KwaDukuza and surrounding rural areas rely heavily on the industry. Small-scale and emerging farmers, in particular, depend on stable milling operations and predictable payment cycles. Any disruption, whether through asset sales, restructuring, or prolonged uncertainty, could ripple through local transporters, suppliers and service providers.

The application applies to Tongaat Hulett Limited in South Africa. Operations in Zimbabwe, Mozambique and Botswana continue under separate corporate structures.

The court’s ruling will determine whether there is any remaining path to restructuring or whether one of South Africa’s historic agribusiness groups now moves fully into liquidation.

The High Court has yet to make its decision.

A special council meeting held behind closed doors this week has pushed KwaDukuza Municipality’s long-running provincial investigation into a decisive new phase.

At that meeting on Tuesday, council initiated precautionary suspension processes against the municipal manager and two senior executive directors following the conclusion of a Section 106 investigation by the KwaZulu-Natal Department of Cooperative Governance and Traditional Affairs (Cogta). The decision was not released publicly and was confirmed through information provided to Uncensored.

The move followed weeks of in-committee deliberations on the investigation’s findings and the adoption of an accompanying Action Plan.

The Section 106 process was triggered in March 2025 after sustained pressure from civic organisations and opposition parties, who raised concerns about financial controls, procurement practices, stalled infrastructure projects, and a perceived lack of accountability within the administration. Section 106 is a formal provincial intervention invoked when there are credible allegations of maladministration, financial failure, or abuse of municipal systems.

Since the report was tabled before council in mid-December last year, it has been dealt with exclusively in committee. Councillors are legally barred from discussing its contents publicly, a restriction intended to protect sensitive labour and legal processes.

Civic groups and opposition parties argue, however, that once findings are made and council resolutions adopted, continued secrecy around matters involving public funds undermines accountability and public trust.

Each of the three officials has been given seven days to submit written representations, in line with labour law and due process. This step does not constitute a finding of guilt. It is a procedural safeguard intended to allow investigations and consequence management to proceed without interference.

A formal consequence framework is already in place

The Action Plan adopted by council leaves little room for interpretation. The Section 106 investigation was never intended as a set of recommendations.

It sets out a clear path for consequence management, including disciplinary action where misconduct is found, criminal referral where legal thresholds are crossed, and civil recovery of losses suffered by the municipality.

In several instances, the document notes that these steps should not be delayed, particularly where failures stemmed from negligence, ignored controls, or breaches of statutory duty.

While the accounting officer is formally responsible for implementation, the Action Plan provides for delegated or interim oversight, given that the municipal manager is among the officials facing precautionary suspension.

The bank breach was not an isolated incident

Central to the investigation is the R35.7 million theft from the municipality’s primary bank account on 31 January 2025.

According to the Action Plan, the loss followed identified weaknesses in banking access controls, information and communication technology governance, and cybersecurity oversight. These weaknesses had been flagged before the breach and were not remedied in time.

The document directs that forensic processes be finalised, disciplinary action pursued where failures are attributable to officials, and criminal referrals and civil recovery initiated where warranted.

The breach is treated not as an aberration, but as a consequence of unresolved control failures.

Governance failures extended beyond the cyber theft

The Section 106 investigation also examined a broader pattern of governance breakdowns.

These included possible misconduct by officials and office bearers requiring formal disciplinary assessment, unresolved irregular expenditure from the 2022–23 financial year identified by the Auditor-General, and weaknesses in contract and project management linked to disaster-funded infrastructure projects, including the Hulett and KwaMfanomdala bridge projects.

In each instance, the Action Plan records required corrective action, assigns responsibility, and sets out monitoring and reporting mechanisms.

Why this moment matters

KwaDukuza is not a municipality with room for further failure.

It recorded a R270 million budget deficit in the 2023–24 financial year, while service delivery challenges from deteriorating roads to unreliable infrastructure continue to affect residents.

For years, Auditor-General reports on the municipality have pointed to recurring control failures, weak governance, and limited consequences. This investigation will be judged not on its scope or its paperwork, but on whether it produces a different outcome.

Closing

The Section 106 investigation was designed to restore accountability, not to manage reputational risk.

Its findings have been made. A formal Action Plan has been adopted. Consequence management has been triggered.

What remains unresolved is whether this process results in visible accountability or whether it joins a long list of reports that identified problems without fundamentally changing outcomes.

That decision now sits with council. And it will determine whether this moment marks a break from past patterns or their continuation.

Public participation for a proposed mixed-use development within the Ballito Village node, known as The Square, has been extended to 30 January 2026, following concerns about limited public awareness and the timeframe of the application.

The proposal relates to a site within one of Ballito’s most spatially constrained and sensitive precincts and is subject to environmental assessment because it falls within the 100-metre coastal management line.

What is being proposed

According to the application documents, the development includes:

• A six-storey mixed-use building

• Ground-floor retail with 52 serviced apartments above

• Two basement parking levels

• A rooftop entertainment level

• Excavation of approximately 3,360 cubic metres of material

• A request for a height departure from four storeys, or 18 metres, to 20.25 metres

In Ballito Village, where height limits have historically been used to manage density and scale, such departures carry broader implications. Once approved, they often become reference points for future applications in the same node.

Traffic and infrastructure considerations

The Traffic Impact Assessment submitted for The Square concludes that no road upgrades are required. This finding contrasts with existing congestion patterns along Library Lane, Compensation Beach Road and within the broader Village road network.

Bulk water capacity has also been raised. Siza Water has issued a conditional no-objection, noting that capacity constraints may exist and should be taken into account during the planning phase. The submission signals that existing infrastructure is already under pressure.

Limited public engagement to date

Public participation levels for earlier phases of the application have been notably low. Only eight submissions were received, none from immediate neighbours.

For a six-storey development proposed within one of the town’s most congested and environmentally sensitive nodes, that level of engagement is unusually limited. It has been cited as one of the reasons for extending the public participation period.

A broader planning context

The proposal forms part of a wider pattern on the North Coast, where development pressure continues to intensify while supporting systems remain constrained.

Traffic congestion in Ballito has become an all-day reality. Road capacity is finite, and there is no integrated public transport network to absorb increasing density. Environmental pressure is also building, particularly along the coastline, where dune systems and public open spaces serve as critical buffers.

Once environmental authorisations are granted, developments of this scale are difficult to reverse. Public participation remains one of the few formal mechanisms through which residents and stakeholders can engage with planning decisions before they are finalised.

While good development breathes life into a place, growth without balance, realistic planning and an honest assessment of infrastructure limitations creates long-term strain that is difficult to reverse. Ballito is already showing the effects of rapid densification, yet despite this, high-intensity developments continue to move through the system.

And something else is becoming clear.

Public participation is increasingly happening out of sight - tucked into classifieds few residents read, placed on noticeboards easy to miss, or opened with the minimum legally required timeframes that many residents only discover once most of the window has already passed.

By procedural standards, consultation has taken place. In reality, residents are being blindsided. Once the comment window closes, the decision stands, and the community loses its say in developments that will define the town for decades.

Two applications currently before the authorities show how significant shifts to Ballito’s coastline and Village core are unfolding with limited public awareness: the La Montagne walkway realignment and The Square, a proposed six-storey development in the Village node.

Both are now out for comment. Both are likely unknown to the majority of people who live here.

La Montagne: A Walkway Realignment With Far-Reaching Consequences

The application submitted by the La Montagne Body Corporate frames the project as a realignment and reconstruction of the public beachfront walkway.

At face value, it looks like a modest adjustment, but the implications are far greater.

A coastal professional who reviewed the documents and requested anonymity raised several concerns that point to a more significant intervention than the summary suggests.

Shifting the walkway seaward

Their review notes that the existing promenade sits at roughly 8 meters above the high-water mark.

The proposed alignment lowers that to about 6.5 meters and shifts the walkway closer to the ocean. In past storm events, including 2007 and 2022, water overtopped the current height.

A lower, forward position places the structure in a zone of greater exposure during severe weather.

Cutting into the dune

The analysis indicates that creating the new alignment requires cutting up to 1.5 meters into the dune.

In this stretch of coastline, dune volume plays a critical role in absorbing storm energy. Reducing it weakens the natural defence system.

Retaining wall instead of a natural dune face

The documents show a dry-stack loffel retaining wall replacing part of the dune. However, this type of wall is typically suited to inland conditions and may be vulnerable to undercutting from wave action.

Redrawing public space

The proposal includes shifting the public servitude forward to match the new walkway alignment. In practice, this means the legal boundary of public access moves closer to the ocean. Once that line is adjusted, the area behind it is no longer protected as public space.

Planning records across the coast show that servitude shifts are seldom reversed, which is why these decisions carry long-term consequences for public access and coastal management.

How the public notice was issued - and how it could be missed

The notice for the La Montagne application was issued through the standard channels required under environmental law. A classified advertisement was placed in the local community newspaper, and three physical noticeboards were erected around the La Montagne property, mainly along the beachfront side and near pedestrian access points. The Environmental Assessment Practitioner (EAP) also circulated the application to an email list of previously registered Interested and Affected Parties.

These steps satisfy the legal requirements, but they do not ensure broad public awareness. Classifieds draw far less readership today as most residents consume news on digital platforms.

Site notices placed around a single property are easily missed by anyone who does not walk that exact stretch of beachfront. And email notifications only reach those already on the Interested and Affected Party (I&AP) register, leaving the wider community unaware that the process is underway.

In practice, this meant that many of the people who use the walkway daily had no idea the proposal was open for comment.

The Square: A Six-Storey Development in the Village Core

A second proposal, The Square, is also open for comment on a site within the Ballito Village node. Because the property lies inside the 100-meter coastal management line, the excavation and construction work require environmental assessment.

What the developers propose

• A six-storey mixed-use building

• Ground-floor retail with 52 serviced apartments

• Two basement parking levels

• A rooftop entertainment level

• Excavation of roughly 3,360 cubic meters of material

• A height-departure request from four storeys (18 meters) to 20.25 meters

In a node as constrained as the Village, a height departure is a line in the sand. Once the threshold moves, it becomes the reference point for every future application. But height is not the only concern.

Traffic and mobility

The Traffic Impact Assessment argues that no road upgrades are needed for The Square, a conclusion that stands in stark contrast to the lived reality of congestion on Library Lane, Compensation Beach Road and throughout the Village grid.

Siza Water issued a conditional no-objection, noting that capacity constraints may exist and should be considered in the planning phase. In other words, the bulk-water provider is signalling that existing infrastructure is already under pressure.

Public awareness of the application has been extremely low. Earlier participation rounds for this site drew only eight submissions, none from immediate neighbours.

For a six-storey block in one of the town’s most sensitive nodes, that level of engagement is strikingly small and reinforces how easily major proposals can move forward with limited community input.

A Larger Pattern: Growth Outpacing the Systems Meant to Hold It

Ballito is growing fast, but the systems meant to support that growth are not keeping up. Congestion has become an all-day reality, road capacity is fixed and there is no integrated public transport network to absorb increasing density. Yet new developments continue to be assessed as if these limits are not already visible in daily life.

Environmental pressure is building too. Along sensitive stretches of the coastline, dune alterations and gradual shifts in public space are weakening natural buffers. Inland, dense residential and mixed-use projects are moving ahead without a matching adjustment in infrastructure or long-term planning.

Both proposals highlight important shifts. One concerns how a public coastal space is realigned, the other introduces a dense 6-storey block into a node already under strain.
