Start with the names. The argument comes after, and the argument is better if you sit with the names first.

Rudy Giuliani. Eighteen defendants in the Arizona fake electors case. Seventeen got served. Giuliani ducked process for weeks while livestreaming his show every night from a known address, which is the legal equivalent of hiding from the cops in a lighthouse. Arizona sent agents to New York for two days. The doorman wouldn’t ring up. Certified mail, multiple phone numbers, nothing. He posted on X that if they couldn’t find him by morning they’d have to dismiss the indictment. They found him that night, leaving his own 80th birthday party in Palm Beach. The arraignment judge later noted he’d “shown no intent to comply with legal process” and slapped a bond on him for it.

Mo Brooks. A sitting member of the United States Congress hid from Eric Swalwell’s January 6 suit long enough that Swalwell had to hire a private investigator. The PI eventually served Brooks’s wife at the family home in Alabama. Brooks’s response was to try to get the process server charged with trespassing. A congressman. Hiding from paper. While drawing a federal salary.

Kanye West. During the Donda Academy collapse, process servers chased him for months across multiple suits and came up empty. His own lawyers couldn’t find him either, and they were trying to fire him. They took out newspaper ads to notify their own client they were quitting. Read that twice.

Andrew Anglin. The Daily Stormer’s founder has never been personally served in any suit against him. Not once. He told courts he lived in Nigeria. A process server swore under oath he’d spotted him at a grocery store in Ohio. His own lawyer told a federal magistrate he had no idea where his client was. Tanya Gersh’s attorneys had to ask a judge for permission to depose Anglin’s father and brother just to ask where their son lived. He owes north of $18 million across stacked default judgments, fourteen of it to Gersh, four to Dean Obeidallah. He has paid nothing. A federal bench warrant has been out since 2022. He remains, as of this writing, wherever he wants to be.

Robert “Azzmador” Ray. Charlottesville defendant, Daily Stormer writer. Arrest warrant issued September 2020. Whereabouts unknown then, unknown now. Six years a ghost.

Matthew Heimbach. Charlottesville defendant. The plaintiffs won. Collecting requires finding him. They can’t.

Ali Alexander. Stop the Steal’s organizer reportedly went underground after January 6 and made himself hard to find for civil and congressional process both. I’m flagging this one as thinner than the rest of the row. The pattern fits; the documentation is shallower. Weight it accordingly.

Joshua Johnson. Bricks & Minifigs employee, American Fork, Utah. The man Ben Schneider spent weeks trying to serve. Those attempts got Schneider arrested twice by the American Fork Police Department, which spent March operating as Johnson’s personal service-prevention detail and is now learning what 1.3 million views feels like.

That’s the never-served and the barely-served. Behind them stands the served-and-laughing tier: Bannon and Navarro, who ate short prison terms for defying congressional subpoenas and treated it as a branding exercise. Meadows, who defied the same subpoena and ate nothing. Alex Jones, who stonewalled discovery so totally that judges in two states stopped pretending and defaulted him. Musk, who skipped SEC testimony until a federal court had to drag him in by court order.

The Signature

May 28, 2026. Judge Tony F. Graf Jr., Fourth Judicial District, Utah County. Bricks & Minifigs Franchising v. Benjamin Paul Schneider. Ex parte TRO, signed at 5:25 in the afternoon, and with it an authorization to serve Schneider by email.

It worked immediately. Within days Schneider posted a video calling Bricks & Minifigs “a mystery company” because he could no longer say the name. Episode three of his investigation is shelved. He says publishing it puts him in jail and torches the $454,000 GoFundMe raised for an 83-year-old man whose Lego collection started all of this.

So. One signature. One email. Total compliance inside a week, from a defendant who had fled to Mexico at one point because he believed there was a warrant out on him.

Hold that next to the exhibit row and ask the only question worth asking: why does a Utah County district judge get done in an afternoon what the American legal system could not get done in weeks against a former mayor, months against a congressman, and going on a decade against Anglin?

It isn’t the technology. Email existed when Brooks was hiding behind his wife. Rule 4 and its state equivalents have allowed alternative service for generations. Service by email, by social media, by publication, all of it sits in every judge’s toolbox. The toolbox just doesn’t open for everyone.

What opened it here is who was asking. The plaintiff is a franchising corporation represented by Dentons, which is what you hire when you want the largest law firm on the planet. The defendant is a 30-year-old with a camera. Under those conditions a court finds email service reasonable on an ex parte motion, same day, no hearing, no defendant in the room. Flip the parties and watch the standard change. When the person asking is a harassment victim, a defrauded family, or a congressman suing over an insurrection, and the person hiding has money or connections or simple nerve, the courts demand a documented pilgrimage first. Drive-bys. Skip traces. Private investigators. Sworn depositions of a man’s relatives. Only after all that does a judge grudgingly permit what Graf handed Dentons before dinner.

The apotelic test is results, and the results here are not subtle. Measured by outcomes, “reasonable diligence” functions as a wealth screen. Evading process is a privilege, and like most American privileges it’s means-tested in reverse: the more you have, the longer you get to hide. Schneider couldn’t even lawfully serve Johnson himself, because an interested party can’t act as his own process server, and his attempts to route around that got him jailed by the same local apparatus whose court then served him with a single click. The powerful dodge paper for years and we call it due process. The annoying get served at the speed of SMTP.

To be clear about what I’m arguing, because somebody will get it wrong on purpose: email service is good. It should have found Giuliani in week one. It should have found Anglin in 2017, before Tanya Gersh needed a court order to ask a family where their son was. The grievance isn’t that Graf used the tool. The grievance is that the tool’s availability tracks the plaintiff’s letterhead instead of the defendant’s evasiveness.

The fix is dull, which is usually the mark of a real one. Presumptive alternative service: if a defendant has a verified email, an active social account, or counsel of record in any other matter, service to those channels is presumptively valid after one failed personal attempt. For every plaintiff. Not just the ones who can afford Dentons. Graf just ran the proof of concept for the whole country.

He ran it on a YouTuber. I’d like to see it run on a congressman.

And I consider it a badge of honor.

But I also recently trashed the LDS church (here) and some unchristian LDS folks like to “protect the church” by kneecapping its opponents; particularly Deznat. And I know AT LEAST one of them is watching me constantly with only two degrees of separation from myself. A lot of VERY INTERESTING things have happened that imply people making my life interesting.

”April 26, 2007 — The Day My Spirit Died

The LDS church defines Spiritual Death as separation from God the Eternal Father — considered worse than physical death, which is overcome through the universal resurrection achieved by Christ’s atonement. In practice, Spiritual Death is the fate of anyone who leaves the church, and particularly of those who publicly oppose it. Joseph Smith’s quote — “When you join the Church of Jesus Christ, you leave neutral ground forever behind” — is a remarkably convenient mechanism for neutralizing critics.

So I will play their game, and yet not play it.

On October 26th, 2007, my wife and I formally resigned from the Church of Jesus Christ of Latter-day Saints.

What I Mean by “Church”

The word has many meanings. The LDS theocracy defines it however serves them. I am defining it here as the theological doctrines taught by the Church of Jesus Christ of Latter-day Saints as they should be practiced, not as they are practiced.I am not attacking the church as it exists on paper. I am stating my reasons for leaving, and my contempt for those who run it.

The Covenant

The baptismal covenant, as recorded in Mosiah 18:8–10, includes this obligation:

“…to stand as witnesses of God at all times and in all things, and in all places that ye may be in…”

It is in that spirit — as a witness — that I write this.

With the full spiritual certainty I possess, and my faith in Jesus Christ as my Savior, I testify that Gordon B. Hinckley, Thomas S. Monson, and James E. Faust have deliberately enabled evil for their own political agenda. I further testify that virtually all who have held the title of Apostle throughout the church’s history have done the same.

The Breaking Point

Two facts frame everything that follows:

Fact 1: Dick Cheney is an evil man. Fact 2: LDS members are taught from childhood to treat the Prophet’s words as if they come directly from the Lord — binding as scripture, without requiring the phrase “Thus saith the Lord.”

On April 26th, 2007, Dick Cheney spoke by invitation at the BYU commencement. All three members of the First Presidency attended. This was not the reason I left the church. It was the moment when outside sources became more credible to me than LDS sources.

That shift sent me to the history. Primarily: Under the Banner of Heaven by Jon Krakauer, and The Mormon Hierarchy by D. Michael Quinn — a secular history written by someone excommunicated from the church who still believes, with sources that are public, exhaustive, and not easily disputed.

What I Found

Gordon B. Hinckley has counseled members to “focus on the positive and not dwell on the negative aspects of an institution.” There is wisdom in that for minor errors. But some things cannot be ignored:

1. Joseph Smith destroyed the Nauvoo Expositor for publicly reporting his sexual relationships with other men’s wives. The church denies this. After April 26th, I believe other sources before I believe the LDS church.

2. Henry D. Moyle, a member of the First Presidency, personally promoted “Baseball Baptisms” — recruiting children into the church with the promise of athletic club membership. This was not rogue behavior. The church denies it. After April 26th, I believe other sources.

3. The office of Presiding Patriarch, which Joseph Smith taught was central to the spiritual well-being of the church, was phased out by later leaders out of institutional jealousy. The last significant scripture added to the canon was a vision received by Joseph F. Smith. Modern prophets don’t speak of visions. The church says the office is now unnecessary. After April 26th, I believe other sources.

4. The pioneer legacy we are taught to revere is riddled with conspiracy, murder, political intrigue, and the very “secret combinations” the Book of Mormon warns against — including actions associated with my namesake, Thomas E. Ricks. The church contextualizes this away. After April 26th, I believe other sources.

5. Gordon B. Hinckley personally led efforts to destroy the ERA and suppress broader feminist advocacy. The church denies this. After April 26th, I believe other sources.

6. Ezra Taft Benson was closely allied with the John Birch Society — patron of Joseph McCarthy, a figure I hold in contempt exceeded only by Andrew Jackson. Benson was openly rebellious against other Quorum members and was never excommunicated. He later moderated his tone but never apologized for his associations. These are the ideological roots of figures like Ann Coulter. This man led the LDS church. After April 26th, I believe other sources.

The Logical Conclusion

A friend once argued: “If even 1% of that book is false, it cannot be relied upon.” I turned it back on him: “If even 1% of what the church teaches is false, it cannot be relied upon.”

And to which do we hold the higher standard — an academic history written by a mortal man, or the Kingdom of God on Earth, led by a Prophet, Seer, and Revelator who holds all the keys of the kingdom?

On April 26th, 2007, Gordon B. Hinckley honored a man I know to be evil — and was not struck down for it. The only conclusion available within LDS theology is that he is not a prophet.

Even so, I prayed. My wife and I waited six months. We wanted to be sure.

The Lord confirmed to me that Hinckley is not a prophet.

I still feel the Spirit of Christ. I still believe in Him. I do not believe that Gordon B. Hinckley, or any current leader of the LDS church, has ever been authorized to act as an arbiter of God’s will on Earth. And even if I were wrong in that belief — they forfeited it the moment they honored a war criminal.

A Final Testimony

Since an LDS testimony is given through spiritual insight rather than empirical argument, I offer mine in kind — not as proof, but as truths given to me by God, to the extent that God-given intuition and reason can provide them.

I testify that there exists a hidden order within the LDS church, driven by a prophecy that one of their number will one day become President of the United States — which is why the Romney family has pursued the presidency across generations, and will continue to do so.

I testify that it is because of this order that LDS leaders set aside common decency and struck a deal with Dick Cheney — his honorary degree at BYU in exchange for quiet political support from George H.W. Bush in the 2008 election.

I testify it is no accident that Mitt Romney’s “Mormon speech” was delivered in College Station, Texas — home of the George H.W. Bush Presidential Library.

I testify that the Lord was severely displeased by Jeb Bush’s actions in the Terri Schiavo matter, and that this displeasure extends as a condemnation upon the Bush family to the fourth generation, unless they repent and disavow the unrighteous actions of the father — and that this condemnation extends to any candidate who accepts Jeb Bush’s endorsement without doing so.

I testify that George W. Bush, Dick Cheney, Karl Rove, Donald Rumsfeld, Condoleezza Rice, and the architects of the Project for the New American Century will answer — before God and before an earthly tribunal, which I believe will be the International Criminal Court — not for Afghanistan, but for the advocacy and tolerance of torture and war crimes in Iraq.

I testify that if Mitt Romney is elected President, a darkness will fall upon this nation so profound that even those who have refused to see the sins of their leaders will recognize the Hand of God at work.

I say this in the name of Jesus Christ, my Lord and Savior.

Amen.”

If the Sacred Subjective is the foundation for Apotelic Kindness, then we must establish a framework by which the inevitable existence of Hierarchy will be dealt with in this philosophy. Here are Seven Rules that I think best apply:

“All human wisdom is contained in these two words — Wait and hope.”

Abbé Faria says this to Dantès near death in the Château d’If. He is dying, Dantès is watching his only friend and teacher go, and this is Faria’s final gift — not treasure, not knowledge, but orientation. It is the distillation of everything he taught Dantès about patience as a weapon.

1) Hierarchies are knives; useful tools that must be watched and kept from children.

2) Just hierarchies remain accountable to their lowest rank, prioritizing individual dignity over collective convenience.

3) Power must continuously prove its value to those at the bottom through demonstrable results, not deception.

4) Perpetual review must engage both experts and masses to protect individual dignity from unnecessary diminishment.

5) Action speaks louder than ideology; all collective entities are accountable for their direct effects, not their stated intentions.

6) Individual rational interests must remain central to society, with coercion minimized to what the vast majority agrees is necessary.

7) If a child cannot understand the morality behind your actions, you’re probably deceiving yourself and others.

What does this even mean at a practical level? These rules cannot prevent the abuse of hierarchy but since, at the end of the day conservatism is the tool of hierarchy and history shows us that this is the primary vector for unkindness or anti kindness, then preventive maintenance in the abuse of it can reduce the risk of an objectively unkind society. Without it, it will be wielded as a weapon by those who have power but do not deserve it.

It should be understood that all roles are conditional and that no role is an identity. Just authority is only just so long as the practices of that power are upheld and accountable to those who must suffer under it. If it is observed that the role is not living up to the standards of those with whom power has been imbued then that power should be instantaneously revoked.

“Moral wounds have this peculiarity — they may be hidden, but they never close; always painful, always ready to bleed when touched.”

The narrator says this about Villefort, the man who buried his own living child to protect his career. His institutional role consumed his humanity so completely that every subsequent act of self-preservation reopened the original wound rather than healing it.

This applies to:

• Moral roles (leader, judge, protector, healer)

• Intellectual roles (philosopher, strategist, prophet, critic)

• Institutional roles (authority, expert, office-holder)

• Symbolic roles (myth-maker, channel, exemplar)

There should be no permanent authority that is not derived from those put under power; and whenever a child is born into an institution that they are not independently able to rationally join of their own separate recognizance free of influence from those around them, then it is inevitable that an innocent shall be the victim of choices made in the past to serve the needs of those abusing Hierarchy to preserve their own position for its own sake.

“The difference between treason and patriotism is only a matter of dates.”

The Count says this to Fernand Mondego during his unmasking — the man who sold out Ali Pasha and built a career on betrayal dressed as loyalty.

The absence of authority and power can be just as tyrannical as its overwhelming abuse. Hierarchy is going to happen; whether it is formal or informal. The absence of a rules or laws based order is instead going to create an abstract social structure that will simply let the loudest voice in the room grab a mob and burn the heretic. Anarchism is just as tyrannical for its toxification of a healthy anti Hierarchical movement as a majority libertarian town refusing to pay for taxes to keep Bears and criminals from destroying the town. Hierarchy is going to happen; the question is whether it is just or unjust; kind or unkind.

EIGHT. DAYS.

Who Do They Work For

Seven questions to determine if something is moral and good are all well and nice; but if you are doing the classic trolley situation in your own personal frame, its too much to ask or apply. The most important thing about philosophical morality you need to remember besides Apotelic Kindness itself is that a Value has many definitions but here is the one that matters for Christoicism.

A Value is Something that forces a Moral and Ethical decision that matters and costs you to maintain it.

It is well and good to be for public school lunches until you get your tax bill and have to actually pay for it out of your paycheck. It is well and good to honor military service until you have to pay $2450 for a President to Fuck that Particular Fish and Bomb that Particular Thing when they file their taxes. It is well and good to consider yourself an honest person until your wife asks “Do I look fat in this dress?”

If something is a value it is worth having. All of these are values; Integrity, Courage, Compassion, Honesty, Loyalty, Respect, Kindness, Justice, Freedom, Wisdom, Humility, Gratitude, Perseverance, Fairness, Accountability, Generosity, Patience, Excellence, Authenticity, Empathy. But you can’t do them all at the same time. And more importantly in the crisis of the moment what you choose shows what you value. That is what REALLY makes it a value. But if you are aiming to be a good or decent person, or apply the seven questions to all of those it can be exhausting and frankly impossible.

Mercy vs. Justice: Dantès discovers that Maximilien and Valentine are innocent victims caught in the wreckage of others’ sins. He could destroy everyone connected to his suffering—but he chooses to save them instead. Yet he doesn’t forgive Villefort or Danglars. The question becomes: which ones deserve his vengeance, and which deserve his mercy? He learns that absolute justice would make him a tyrant.

Thus the need for a Hierarchy of Values. You can HAVE all of those values but not have them at equal measure. You can decide ahead of time if you choose patience over wisdom, or gratitude over compassion. You’d think that some of these aren’t antithical but I also guarantee if you think about it at a deeper measure, you will find that all of them have been in conflict in your life at some point or another.

Unless of course you didnt care about it at all; but that doesnt make it a value for you.

The Hierarch is a mental exercize that lets you choose ahead of time. That helps you avoid regrets later on. This can be as simple as “What are my top 3 values and what order are they in?” to a formally written list where you frequently update and change what all of them are. Good luck remembering the order of all 20 in your life though.

Loyalty vs. Honesty: When Caderousse appears, broken and dying, Dantès remembers the sailor he once knew. He gives him money and comfort—loyalty to an old friend. But he won’t lie about Caderousse’s complicity in his betrayal. The kindness and the truth have to coexist, even when they pull against each other.

Here is the key pivot; if you are doing this right a value must always have circumstances where it DOES trump the other values even if it isnt your top virtue. Mercy without Justice is terrible and Justice without Mercy is also terrible. There are moments where one is clearly called for above the other; the Hierarchy is simply your default and can never be a substitute for wisdom, inner reflection or just plain old common sense.

One measure that I might recommend is in the conversations you have with yourself; pick a person who represents that value. It can be a famous person like Benjamin Franklin or a fictional person like Clark Ken. It can be your maternal grandfather or it can be some mythological figure. Think of a hypothetical scenario; something you think might realistically occur some day and ask yourself with these two people what they would each do in the situation and determine how they would react and see whic one resonates properly with you.

Authenticity vs. Compassion: Dantès could reveal himself to everyone he loves and be known for who he truly is. But keeping his secret—staying the mysterious Count—is what allows him to save the innocent without destroying them with knowledge. Sometimes you have to remain hidden to show compassion.
