When that friend took back a phone she had lent to Cranmer, she discovered the Snapchat footage. The identification was undeniable: Cranmer’s distinctive tattoos, including a crudely drawn set of breasts, were visible in the footage.

The Defense: “An Innocent Moment”?

In a move that should outrage anyone with a pulse, Cranmer’s defense attorney, Marissa Koerner, attempted to characterize this sexual assault as an “innocent moment” that had been “blown out of proportion.”

Koerner’s argument was that “children often have little appreciation for personal space or privacy.” She compared a toddler touching a babysitter’s genitals to a child following a parent into the bathroom.

Let’s be crystal clear: A 2-year-old child does not have the capacity to “invade” an adult’s privacy in a sexual manner. An adult who laughs while a toddler touches them, records it on Snapchat, and then saves it for later viewing isn’t “experiencing a lack of personal space.”

Judge Kenneth Palmer saw right through the tears and the excuses. He called the footage “bizarre” and “troubling,” specifically noting that there was absolutely no attempt by Cranmer to stop the child. He ordered her held without bail, recognizing the danger she poses to the community.

How Indiana Law Views This Predatory Behavior

While this case is unfolding in New Jersey, the legal principles at play are universal. If this happened in Indianapolis, the hammer of Indiana law would fall even harder. In Indiana, they don’t entertain the idea that a toddler can “consent” or be the “aggressor” in a sexual situation.

IC 35-42-4-3: Child Molesting

In Indiana, sexual acts with a child under the age of 14 fall under IC 35-42-4-3 (Child Molesting). This is one of the most serious charges a person can face in our state.

Under this statute:

• No Consent Possible: A 2-year-old is legally incapable of consent. Period. Any argument about the child being “curious” or “initiating” contact is legally irrelevant and morally reprehensible.

• The “Arousal” Standard: The law covers any fondling or touching of either the child or the adult with the intent to arouse or satisfy sexual desires. Laughing and recording the act on Snapchat is strong evidence of that intent.

• Severe Penalties: Child molesting is typically a Level 1, 2, 3, or 4 felony. A conviction can carry decades in prison.

IC 35-42-4-9: Sexual Misconduct with a Minor and the Position of Trust

Indiana law also specifically addresses situations where an adult is in a position of trust or authority over a minor. Under IC 35-42-4-9, when an adult (18+) engages in sexual misconduct with a minor, the law takes a very dim view if that adult was a caregiver, teacher, or: in this case: a babysitter.

A babysitter is entrusted with the safety and well-being of a child. When that trust is violated for sexual gratification, it is an aggravating factor that can lead to harsher sentencing and higher felony levels. In Indiana, the “Romeo and Juliet” or close-in-age defenses do not apply if the offender is in a position of authority or substantial influence over the victim.

Why This Defense Strategy is Offensive to the Legal Profession

Their crime? Discovering that people use drugs at a Phish show.

It’s like being shocked to find sand at the beach or overpriced beer at a stadium. But for the Hamilton County Prosecutor, this was an opportunity for a dramatic PR stunt. Following Phish’s three-night run at the Ruoff Music Center in Noblesville, the office issued a statement that reads more like a stern lecture from a 1950s principal than a serious legal update.

“Frankly, we are disappointed in the number of people who showed up to engage in illicit behavior,” they posted.

Frankly? We’re disappointed that taxpayer dollars are being wasted on Facebook grandstanding instead of addressing the real, violent crime that actually threatens the residents of Indiana.

The Ridiculousness of the “Surprise” Drug Bust

Let’s look at the numbers. Out of tens of thousands of concertgoers who flocked to Noblesville for a weekend of music and “good vibes,” the police managed to arrest five people. Five.

In a crowd of roughly 60,000 people over three nights, that is an arrest rate of approximately 0.008%. Yet, to read the Prosecutor’s post, you’d think they’d stumbled into a scene from Scarface. They listed off a “scary” inventory: mushrooms, acid, weed, MDMA, and nitrous oxide. They even threw in meth, heroin, and fentanyl for maximum shock value, claiming they found “significant quantities.”

The state wants to act like they are saving the world by busting a few fans with some mushrooms, while real criminals: the kind who actually hurt people: are laughing while the cops are busy playing security guard at a jam band show.

Wasting Taxpayer Dollars on Social Media PR

Why the Facebook post? Why the dramatic “we are disappointed” tone? Because it’s easy. It’s easy to target a specific subculture, make a few arrests, and then post about it on social media to look “tough on crime.”

But this isn’t real crime-fighting. This is a PR stunt paid for by you, the taxpayer. Every hour an officer spent undercover trying to buy a joint at Ruoff is an hour they weren’t investigating robberies, domestic violence, or murders. Hamilton County isn’t safer because five Phish fans are now facing major felony charges. In fact, by focusing so heavily on these victimless “crimes,” the Prosecutor’s Office is proving that their priorities are completely backwards.

When the Prosecutor’s Office responds to comments by saying, “The people who had to go to the hospital might disagree with you,” they are using the outliers to justify a blanket crackdown. It’s moral grandstanding, plain and simple.

You don’t expect to find a teacher using a classroom closet for sexual trysts with students or running an adult content side-hustle that fuels a blackmail ring for better grades.

But that is exactly what happened at Alexander High School in Douglas County, Georgia. The case of Maris Nichols, a 25-year-old former teacher and football program administrator, is a masterclass in how a “position of trust” can be weaponized: and how the law will tear your life apart when that trust is broken.

At the Law Office of Mark Nicholson, we see how fast legal situations escalate. This isn’t just a headline; it’s a warning. If you are facing sex crime allegations in Indiana, the state doesn’t care about your excuses. They care about convictions.

The Shocking Allegations: 27 Counts and a Closet

Maris Nichols wasn’t just a teacher; she was an authority figure who allegedly treated her classroom like a private studio. According to Fox News, Nichols is facing a staggering 27 counts related to sexual relations with six different students.

The details are disturbing. Investigators claim Nichols engaged in sexual acts in a classroom and a closet. They even sought warrants for a “Jesus Loves You” necklace she was reportedly seen wearing in a sex video with a student. The evidence doesn’t stop there: police tracked surveillance footage from St. Andrews Golf Course to document a rendezvous and served warrants on Snapchat, AT&T, and OnlyFans.

In the eyes of the law, these aren’t just “mistakes.” These are calculated violations of the law that carry decades of prison time.

The Blackmail Ring: Grades for Silence

Perhaps the most bizarre twist in the Nichols case is the blackmail component. Students discovered her OnlyFans account: a platform known for adult content: and used it as leverage. The ultimatum was simple: give us better grades, or we leak your secret.

Nichols reportedly complied, trading academic integrity for the preservation of her illicit side-hustle. In the legal world, this creates a toxic cocktail of crimes. Not only are there sexual misconduct charges, but the element of blackmail brings in issues of intimidation and official misconduct.

How Indiana Handles “Blackmail” (Intimidation)

In Indiana, we don’t have a specific “blackmail” statute in the way most people think of it. Instead, this conduct falls under IC 35-45-2-1 (Intimidation).

Communicating a threat with the intent to make someone act against their will is a crime. Usually, it’s a Class A misdemeanor, but it gets aggressive fast. If the threat is made against a school employee or involves a threat to commit a forcible felony, you’re looking at a Level 6 or Level 5 felony. If you think you can “negotiate” your way out of a legal jam by threatening someone, you are just handing the prosecutor more ammunition.

Indiana Law: The “Position of Trust” Trap

A common defense in cases like this: especially when the teacher is young and the students are teenagers: is that the relationship was “consensual.”

Let’s be clear: In Indiana, “consent” is irrelevant when there is a position of trust.

Furthermore, Indiana’s Official Misconduct (IC 35-44.1-2) statutes can be stacked on top of sex charges. When a public servant: like a teacher: violates their oath or uses their position to commit a crime, the state will throw the book at them.

Maris Nichols didn’t just allegedly commit these crimes; she also proved she couldn’t follow instructions. While on house arrest with electronic monitoring, she repeatedly violated the conditions of her bond. She left her home without permission, and now she’s sitting in the Douglas County Jail.

When you are out on bond, you are on a leash. One wrong move, one “quick trip” to the store, and you lose your freedom before your trial even starts. While fireworks are a fun part of summer festivities, they can also carry serious risks. According to the most recent annual data, roughly 14,700 people are injured each year in fireworks-related incidents. With that in mind, I have shared below a few key legal considerations of using fireworks this summer.

Common injury risks

Regardless of whether you are attending a fireworks show or planning to put on a small display of your own, it is important to remember that fireworks can cause serious injuries if not used with caution. A couple of common types of fireworks-related injuries include:

• Burn injuries, which account for 37% of fireworks injuries, often affect hands, arms, and exposed skin. Even sparklers burn at extremely high temperatures and can cause serious burns.

• Eye injuries, which can involve permanent vision impairment when safe viewing distances are not maintained.

• Lacerations, fractures, hearing loss, and respiratory irritation, which can occur when devices malfunction, explode unpredictably, or produce excessive smoke or noise exposure.

• More severe injuries from fireworks, which typically involve aerial shells or mortars from fireworks, may lead to long-term disability.

Common liability risks

If you or someone else is injured during a fireworks display, liability can shift depending on several key factors:

• Individuals using fireworks are generally expected to take reasonable steps to prevent foreseeable harm.

• Failing to maintain safe distances, supervise minors, or follow manufacturer instructions may increase liability exposure.

• Violating local ordinances or restrictions may strengthen negligence claims.

July 1, 2026, marks a dark day for civil rights in Indiana. As of today, the state has officially decided that being poor, unhoused, or simply having nowhere to go is a criminal offense. Senate Enrolled Act 285 (SEA 285) is now the law of the land, and it’s a direct assault on the most vulnerable members of our community.

At the Law Office of Mark Nicholson, we don’t sugarcoat the truth. This law isn’t about “connecting people with services.” It’s about clearing sidewalks by using the threat of handcuffs and jail cells. It’s government overreach at its finest, and if you or someone you know is caught in the crosshairs of this new public camping ban, you need an aggressive defense strategy immediately. We are here to fight these charges and expose the hypocrisy of a system that criminalizes poverty while failing to provide basic human needs.

The Cold Reality of SEA 285: What You’re Up Against

The new law makes it a Class C misdemeanor to camp, sleep, or use public land for long-term shelter without explicit authorization. We’re talking about parks, sidewalks, and underpasses, places that have become the last resort for many Hoosiers.

What does a Class C misdemeanor mean in Indiana?

• Up to 60 days in jail.

• Up to a $500 fine.

• A permanent criminal record that makes finding a job or future housing even harder.

The state claims this law is a “compassionate” way to move people into treatment or shelters. If the state cared about “services,” they’d build more shelters instead of more jail cells.

2. The Warning: If you don’t meet the criteria for a mental health hold, the officer must issue a warning. They are required to give you information about available services or shelters and tell you to move.

3. The 300-Foot Rule: You have 48 hours to clear out. But here’s the kicker: the law says you must move at least 300 feet away from the original location.

If you are still within that 300-foot radius after 48 hours, the handcuffs come out. This is a trap designed to keep people moving in circles until they eventually end up in the criminal justice system.

The “Secret Weapon”: The 5-Mile Defense

The state of Indiana knows this law is on shaky legal ground, which is why they included a specific “out” in the legislation. This is the most critical defense tool we have in our arsenal, and most people don’t even know it exists.

Under SEA 285, you cannot be convicted of public camping if there are no available shelter beds or mental health treatment beds within five miles of where you were staying.

Think about that for a second. The state is literally banking on you not knowing the bed count at local shelters. If the police arrest you, and we can prove that the nearest shelter was full or more than five miles away, the case against you should be dead on arrival.

This creates a high-pressure environment where police are forced to make arrests they might not even want to make, just to avoid a lawsuit from the state.

So, I’m checking the comments on my YouTube channel the other day, you know, where I share legal insights and trial tips, and I see this gem. Someone took the time to watch one of my videos just to call me a “DEI lawyer.”

They didn’t look at my track record of murder case dismissals. They didn’t look at my years of aggressive advocacy for civil rights victims. No, they saw the color of my skin and decided that the only reason I have a law license and a successful practice in Indianapolis is because of Diversity, Equity, and Inclusion (DEI).

Let’s be real: “DEI” is just the latest buzzword for people who want to be racist without saying the N-word. It’s the new “Affirmative Action” trope. This is my deep dive into the “DEI Lawyer” myth, and I’m about to set the record straight.

DEI is Just a Recycled Script

Before the world was obsessed with DEI, the same tired people were crying about “Affirmative Action.” They’ve been using the same script for decades: “A Black person got a job I wanted? Must be a quota. Must be a handout. There’s no way they’re actually better than me.”

To people like the person on my YouTube channel, the “E” in DEI doesn’t stand for Equity; it stands for Exclusion. They feel excluded from a position of power that they think they’re entitled to just by being born. To them, the “D” means Divide and the “I” means Incriminate. They think any minority in a high-level position is a sign of a system that is rigged against them.

The truth? It’s a projection of their own inadequacy. If you’re threatened by a Black lawyer, a Latino doctor, or a woman in the C-suite, it’s probably because you know, deep down, you can’t compete on merit.

The Bar Exam Doesn’t Have a “Race Curve”

Here’s a newsflash for the “DEI” accusers: The Indiana Bar Exam doesn’t ask for your race before they grade your paper. When I sat for that exam, there wasn’t a little box to check that said, “I’m Black, please give me an extra 20 points.”

There is no “extra credit” for being a minority in the legal field. We all take the same exam. We all have to master the same complex laws on negligence, car accidents, and criminal procedure. We all have to prove our competence to the same Board of Law Examiners.

If I’m standing in a courtroom defending a client’s life, it’s because I earned the right to be there. I passed the same bar, went to the same types of law schools, and put in the same work as any white attorney. The difference is, I often had to work twice as hard because I was homeless while in Law School.

The Nepotism Double Standard

People get jobs they aren’t qualified for almost every single day.

• Nepotism: Your dad is a partner at the firm? You’re hired.

• Money: Your family donated a wing to the university? You’re in.

• Connections: You went to the same country club as the hiring manager? You’ve got the job.

But notice how we rarely call those people “Nepotism Hires” or “Country Club Hires” with the same venom used for “DEI Hires.” When a white person gets a job because of a family connection, nobody questions their competence. But the second a Black person or a woman gets a high-level position, the “unqualified” label comes out immediately.

If you’re a woman, they say you slept your way to the top. If you’re Black, they say it’s DEI. If you’re a Black woman? You’re “double the DEI” in their eyes. It’s a way to justify their own failures by pretending that the successful people of color are just “fillers” for a quota.

The Reality of Race in the Courtroom: Batson v. Kentucky

You don’t have to take my word for it that race plays a role in the legal system. The United States Supreme Court, as divided as they are, has recognized it for decades.

Look at Batson v. Kentucky (1986). This is a landmark case that every good criminal defense lawyer knows by heart. It established that the state cannot use peremptory challenges to kick jurors off a case solely because of their race. Why did that case have to exist? Because government prosecutors were systematically excluding Black people from juries to ensure convictions.

Even recently, the United States Supreme Court has had to step in and remind lower courts that racial bias in jury selection and deliberations is a violation of the Fourteenth Amendment’s Equal Protection clause. If the highest court in the land admits that race is a factor in how justice is served, why are some people sitting on their couch pretending it’s all a “victimhood” play?

When I fight for my clients, I’m not just fighting the charges; I’m often fighting the inherent biases of the system. Whether it’s a domestic violence charge or a serious felony, I know that the color of my client’s skin matters in that room.

The Sunburn Analogy

I hear it all the time: “I don’t see race,” or “You’re just playing the race card.”

It’s like someone who stays in the house all day, never stepping foot outside, telling someone in the middle of the desert that they don’t need sunscreen. “I’ve never been sunburned,” they say. “Sunburns aren’t real. You’re just being a victim.”

Well, yeah, you’ve never been sunburned because you’ve never been in the sun! Unless you are someone who has been impacted by unjust decisions, systemic discrimination, and the reality of racism, you aren’t going to see it. You won’t understand how unfair the “burn” is until you’re the one standing in the heat!

Why You Need an Aggressive Advocate

The person who called me a “DEI lawyer” didn’t realize they were actually complimenting me. If having a diverse perspective and the lived experience of navigating a biased system makes me a “DEI lawyer,” then fine. It means I see things other lawyers miss. It means I’m prepared for the tactics the prosecution will use to stack the deck.

Let’s get to work!

You want to talk about justice? Let’s talk about reality.

A few days ago, on June 9, 2026, a jury in Collin County handed down a 35-year sentence to a young man named Karmelo Anthony. Nineteen years old. His whole life ahead of him, now potentially spent behind bars until he’s a middle-aged man. Why? Because the system decided that his claim of self-defense wasn’t “justified” enough.

But we’ve seen this movie before, haven’t we? It’s the same rerun, playing on a loop in courtrooms from Frisco, Texas, to right here in Indianapolis, Indiana. It’s the story of an American injustice system that is rigged from the moment you walk through the door if your skin is anything other than white.

At the Law Office of Mark Nicholson, we don’t sugarcoat this. We see it every single day. We fight against it every single day. Because if you don’t have an aggressive criminal defense in your corner, the “White Advantage” is going to steamroll right over you.

The Courtroom Composition: A Sea of White

Let’s look at the facts. When a white person goes to trial in this country, they walk into a room where they are surrounded by people who look just like them.

Think about it. The judge? Usually white. The prosecutor? Usually white. The jurors? Majority white. Even the defense attorney? More often than not, white.

When a white defendant stands before that crowd, they start with an immediate, unspoken advantage. They look like the judge’s nephew. They look like the juror’s neighbor. They look like someone the system wants to give the benefit of the doubt to.

But when a Black or Latino man stands there? The “benefit of the doubt” disappears. Suddenly, “self-defense” is rebranded as “aggression.” Suddenly, fear for your life is seen as “looking for trouble.”

The “Mental Illness” vs. “Predetermined Criminal” Double Standard

This is where the hypocrisy really starts to stink. Have you noticed how the narrative changes depending on who’s in the hot seat?

When a white person commits a violent act, the first thing the media and the legal system look for is a medical excuse. “Oh, he was struggling with his mental health.” “He had a troubled upbringing.” “He just snapped.” The goal is to humanize them, to find a reason: any reason: why they aren’t actually a “bad person.” They get lighter sentences, charges dropped, or they’re sent to a treatment facility instead of a cell.

But for Black and Latino people? We’re told that’s just “what they do.” No one looks for the “why.” No one talks about mental health or trauma. The system treats us like we were born with a target on our backs and a predetermined path to a jail cell.

The Statistics Don’t Lie: And They Are Ugly

Don’t take my word for it. Look at the numbers right here in Indiana. According to recent data, Black Hoosiers are 4.5 times more likely to be imprisoned than white residents.

If you’re a Black youth in Indiana, you’re twice as likely to be referred to the juvenile system and a staggering 20 times more likely to be transferred to adult court than a white kid. Let that sink in. Twenty times.

It’s not because Black people are “more criminal.” It’s because the system is designed to catch, keep, and crush them while letting others slide. Whether it’s domestic violence charges or drug cases, the punishment is almost always harsher when the defendant is Black.

The Names We Won’t Forget

We see the disparity in the big cases too. We saw it with George Zimmerman, who walked free after killing an unarmed Black kid with Skittles in his pocket. We saw it with Kyle Rittenhouse, who brought a gun to a protest, shot people, and was heralded as a hero by half the country.

In those cases, “self-defense” worked because the people pulling the triggers were white. But for Karmelo Anthony? Self-defense was a “rejected claim.” He gets 35 years. The message is loud and clear: your right to defend yourself may depend on the color of your skin.

Legal Warfare: Fighting a Rigged Game

So, what do you do when the deck is stacked against you? You don’t play nice. You don’t hire a lawyer who is just looking to “get along” with the prosecutor.

If you’ve turned on the news lately, you’ve heard the same tired story from the “donut counties”, those suburban communities like Hamilton, Hendricks, and Johnson that surround Marion County. The narrative? “Everything was perfect here until those people from Marion County started bringing their crime over the border.”

It’s easy, isn’t it? To sit in a manicured neighborhood, point a finger at Indianapolis, and claim that your community’s problems are someone else’s fault. But here at the Law Office of Mark Nicholson, we deal in reality, not fairy tales. And the reality is that crime doesn’t care about county lines, and blaming Marion County is a lazy excuse for a much more complex problem.

Growth Naturally Brings Crime, Deal With It

The donut counties are growing. Fast. People are moving out of the city and into the suburbs for more space and “safety.” But here’s the thing: when a population grows, everything else grows with it. You get more traffic, more infrastructure needs, and yes, more crime.

It’s a natural byproduct of expansion. You can’t have the economic benefits of growth without the social challenges that come with it. Suburban leaders want to have their cake and eat it too. They want the high property values and the booming businesses, but the moment a criminal case pops up in their backyard, they start shouting about “spillover” from Indy.

Crime Has No Borders: Why Suburbs Are “Easy Targets”

The phrase “crime has no borders” isn’t just a catchy slogan; it’s a fact of life. Criminals aren’t checking Google Maps to see where the Marion County line ends. In many cases, criminals leave the city specifically because they know the smaller counties are easier targets.

Think about it. Marion County has massive resources. Between the Indianapolis Metropolitan Police Department (IMPD) and specialized units for everything from drug crimes to domestic violence, it’s a high-resource environment.

Why would a criminal risk operating in a city where the police are used to high-stakes, daily confrontations when they can go to a smaller town where the local PD might spend half their day directing traffic? If you’re looking for a soft target, you head for the suburbs. Instead of blaming Marion County for “exporting” crime, maybe these counties should ask why they’re such attractive destinations for it.

The Reality of “Big City” Experience

Let’s be real about law enforcement experience. I’ve practiced law in Marion County and all the surrounding “donut” counties. There is a massive gap in experience.

The officers in Marion County are dealing with murders, dead children, and extreme violence as a routine part of their day. They have the resources and the “battle-hardened” perspective required to handle high-level criminal activity.

In contrast, many officers in the surrounding counties simply don’t see that level of devastation on a daily basis. When a “big city” crime happens in a small town, the local authorities are often out of their depth. If these surrounding communities really had the magic solution to stopping crime, they’d be in Marion County teaching us how to do it. But they aren’t, because they don’t have the experience.

Calling Out the “Racial Dog Whistle”

We need to call this exactly what it is: racism.

When some people in the donut counties complain about “those people from Marion County” coming into their neighborhoods, they aren’t talking about the geography. They’re using Marion County as a code word for African Americans, Latinos and people of color. They don’t want to sound racist, so they frame it as a jurisdictional issue.

“Oh, it’s just the Marion County crowd,” they say. It’s a classic dog whistle. It’s an attempt to make themselves look superior by putting others down, and it avoids the actual work of coming up with solutions. If you’re more concerned with where a person is from than why the crime happened, your priorities aren’t about “safety”: they’re about exclusion.

Real Solutions: Invest in People, Not Grandstanding

If you actually want to solve crime, you have to look at the root causes. But that requires work and investment, and politicians aren’t usually fans of either if it doesn’t get them a quick soundbite on the news.

The real answers aren’t popular because they involve spending money where it’s needed most: our youth and our schools.

1. Investment in Underprivileged Areas: Crime flourishes where opportunity dies.

2. Fixing School Disparities: Look at the schools where crime is high versus where it’s low. The disparity in resources, facilities, and support is staggering.

3. Addressing Housing and Stability: When people are stably housed and employed, they are significantly less likely to enter the criminal justice system.

When you underfund schools in certain zip codes and then wonder why the “success rate” is lower, you’re being intentionally blind. If we want a safer Indiana, we need to invest in the kids who are currently being set up to fail.

Stop Running to the Media and Start Running to the Table

If the leaders in Hamilton, Carmel, or any other donut county think they have the answers, stop running to the cameras. Go talk to Ryan Mears. Meet with the Marion County Prosecutor’s Office and offer your “brilliant” solutions.

But we all know why they won’t do that. It’s much easier to bad-mouth the city from the safety of a press conference than it is to actually collaborate on regional safety strategies.

Screen Review: Michael (2026)

After years of delays and reshoots, Antoine Fuqua’s long-awaited Michael Jackson biopic Michael finally moonwalked into theaters this spring and on the strength of its showmanship, it largely delivers.

The headline is Jaafar Jackson, the late star’s real-life nephew, who steps into the role for his feature debut and is frankly uncanny. He doesn’t just imitate the King of Pop; he channels him. The concert recreations are the film’s beating heart — dozens of songs staged with real craft, and you’ll feel the urge to dance in your seat. Colman Domingo and Nia Long anchor the family drama as Joe and Katherine Jackson, and Fuqua shoots the whole thing with the gloss and energy you’d expect from the director of Training Day. As a celebration of the music and the rise of a generational talent, it’s a genuine crowd-pleaser. Bring the fan in your life.

The honest caveat: this is a sanitized portrait. The film is estate-approved and ends early in Jackson’s story (roughly around the Off the Wall era) which means it sidesteps the controversies, the legal battles, and the darker chapters that complicate his legacy. Whole figures and storylines are simply absent. You leave dazzled, but aware you’ve watched a carefully curated highlight reel rather than the full, unvarnished man. Enjoy it for the spectacle; don’t mistake it for the complete record.

The Legal Lens

Here’s where it gets interesting for us. Michael reportedly had to rework an entire act of its story because a prior legal settlement agreement stipulated that a particular individual could never be dramatized on screen. That single detail is a perfect real-world illustration of something I explain to clients all the time:

• Settlements can echo for decades. Confidentiality and non-disparagement clauses don’t expire when the check clears. The terms you agree to today can shape what can be said (or filmed) about a dispute years from now.

• Estates control the narrative. Rights to a person’s name, likeness, image, and music don’t die with them; they pass to an estate that can grant or withhold them. “Approved” projects look different from unauthorized ones for exactly that reason.

• Read before you sign. Whether it’s a $5,000 settlement or a business release, the fine print is the whole ballgame. The most expensive mistakes are the ones people make because they didn’t slow down to understand what they were agreeing to.

A blockbuster and a small-claims settlement are governed by the same basic principles. The dollar amounts just have more zeros.

A former federal prison employee has now learned his fate in one of the most disturbing prison abuse scandals in recent American history.

Jeffrey Wilson, a former Bureau of Prisons correctional officer and health technician/paramedic at Federal Correctional Institution Dublin in California, was sentenced to 52 months in federal prison after pleading guilty to five counts of sexual abuse of a ward and one count of making a false statement to federal agents.

FCI Dublin was a low-security federal prison for women. It has since become infamous for something far darker: a widespread sexual abuse scandal so severe that the facility was known among prisoners and staff as the “rape club.”

The Abuse of Power Was the Point

According to federal prosecutors, Wilson worked at FCI Dublin from July 2021 to September 2022. His role gave him access to women who needed medical care. Instead of protecting vulnerable inmates, he admitted to sexually abusing one of them and then lying to federal investigators.

This is the kind of case that reminds us why custody matters. When the government locks someone up, that person loses freedom, privacy, control, and often the ability to protect themselves. That means correctional officers, medical staff, wardens, and prison employees are not just ordinary workers. They hold power over people who cannot simply walk away.

When that power is abused, it is not a “relationship.” It is not a “mistake.” It is exploitation.

FCI Dublin Was Not One Bad Employee

The most troubling part is that Wilson’s case was not isolated. The U.S. Attorney’s Office reported that multiple FCI Dublin correctional staff members have been charged, convicted, or sentenced as part of the broader federal investigation into sexual abuse at the facility. The list includes a chaplain, correctional officers, and former warden Ray Garcia.

Garcia, the former warden, was previously convicted of sexually abusing incarcerated women and sentenced to 70 months in prison. Other staff members received sentences ranging from home confinement to eight years in prison.

That pattern matters. A scandal this large does not happen because of one “bad apple.” It happens when a system allows blind spots, retaliation, silence, and fear to protect the people with power instead of the people being harmed.

The Civil Side Was Historic Too

Yes, there is historical truth inside the soundbite. After the Civil War, white supremacist terror groups like the Ku Klux Klan arose in a political environment where Southern Democrats were deeply tied to segregation and anti-Black oppression. No serious person should deny that history. But stopping the story there is either ignorance or manipulation. Political parties are not frozen in time. Their coalitions change. Their voters change. Their regional bases change. Their priorities change. If you want to talk honestly about race and party politics in America, you have to talk about the realignment that followed the civil rights era, not pretend that 1865 tells you everything you need to know about 2026.

That is why the “Democrats were the party of slavery” line is so dishonest when it is used as a present-day political argument. It skips over the part where segregationist Southern Democrats, including Strom Thurmond, broke away as Dixiecrats and then many of those forces migrated into the Republican coalition during and after the civil-rights era. Thurmond himself ran on the Dixiecrat ticket in 1948 and officially joined the Republican Party in 1964.

So no, you cannot take the worst elements of the Democratic Party from 100-plus years ago and paste them onto the Democratic Party of today as if nothing happened in between. That is not history. That is propaganda.

And more importantly, Black people do not live in 1863 or 1948. We live now! We live under current policies, current rhetoric, current priorities, and current administrations. So if Nick Cannon wants to have a real conversation, then let’s talk about the present.

Let’s talk about what actually affects Black families, Black workers, Black veterans, Black students, and Black communities today. What does renaming the Gulf of Mexico to the “Gulf of America” do for housing? For wages? For health care? For schools? For the cost of groceries or gas? Trump did sign an order to rename it for U.S. government usage, but even the Associated Press noted that the order’s authority is limited to the United States and does not bind other countries or international bodies. It is symbolism, not relief.

Let’s also talk about substance over slogans. Defense Secretary Pete Hegseth issued a January 29, 2025 memorandum declaring that DEI policies are “incompatible” with Defense Department values and directing a “merit-based, color-blind” approach instead. People can debate that policy, but let’s not pretend it is unrelated to concerns many Black Americans have about whether opportunity, advancement, and inclusion are being rolled back in the name of ideology.

That is the problem with Cannon’s comment. It encourages Black audiences to look backward selectively while ignoring what is happening in front of them. It suggests that because Democrats once housed open segregationists, today’s Republican Party should get a pass from scrutiny. That makes no sense. Every party, every politician, and every administration should be judged by what they are doing now, not by a half-remembered history lesson stripped of all context.

And while we are being honest, the Emancipation Proclamation itself is often oversimplified too. Lincoln issued it on January 1, 1863, and it was a monumental wartime act, but it did not instantly free every enslaved person everywhere in the United States. Real history is more complicated than social-media politics.

So here is the bottom line: Nick Cannon is wrong. He is wrong because he is treating history like a meme instead of a serious subject. He is wrong because he is flattening party realignment into a slogan. And he is wrong because his comments can mislead Black followers into thinking that the racial realities of modern American politics can be understood by repeating one fact from the 1800s while ignoring the last sixty years.

You can support Trump if you want. You can criticize Democrats if you want. You can reject both parties if you want. But do not insult people’s intelligence by pretending that today’s political fight can be understood without talking about civil rights, party realignment, the Dixiecrats, and the policies being pushed right now.

That is not truth. That is spin.

On my way home from work this evening, March 12, 2026, I received a call from a very good friend telling me that David Hennessy had died.

I want to be clear about something from the start: I am not worthy to write this post. There are people who knew David far longer than I did, who tried more cases alongside him, who traded more laughs and more arguments with him, who carry deeper and richer memories of the man. They could and probably will write better stories. But this is my story. And sometimes the people on the edges of someone’s life see things the people at the center take for granted.

“You Need to Meet My Husband. He’s Kind of a Big Deal.”

Before I ever met David Hennessy, I met his wife. She worked at the State Public Defender’s office, and when she found out who I was, she looked at me and said, “Do you know my husband?” I told her I didn’t. “Well,” she said, “you need to meet him. He’s kind of a big deal.”

I had no idea how much of a big deal. And I’d like to say, for the record, that Vickie is quite a big deal herself.

David came to my wedding in 2008. It was around that time I began to understand the weight his name carried in Indiana legal circles. A Marion County magistrate — Magistrate David Hooper — once told me that David Hennessy was one of the finest attorneys he had ever seen practice law. That stuck with me. It still does.

I watched Hennessy try cases. I studied him. I wanted to be like him. Someone once described him as a very gifted attorney but a complicated man. Both parts of that sentence were true, and neither part diminished the other.

Syracuse, Indiana — 2017

Fast forward to 2017. I was on my way to starting my own private practice. We were at an IPDC board retreat in Syracuse, Indiana, one of those settings where real conversations happen between sessions. Before the board retreat, David and I talked at his office. He told me something I never forgot.

He said he’d been hearing stories from people in the jail, clients talking about some other attorney they called “The Black David Hennessy.” He looked at me and said, “If anyone is going to be called The Black David Hennessy, it should be you.” He wanted me to leave the Marion County Public Defender Agency and take over his practice so he could retire.

I thought long and hard about it. I prayed about it. In the end, I knew it wasn’t the right fit for me. He must have known it, too. It never happened. But the honor of him even considering it…that was something I held close. He believed in me when I was still finding my footing. When I was too scared to leave the Marion County Public Defender Agency to go on my own in private practice. Well, instead of taking over his practice, he sent me cases to help me build my practice. He invested in me the way mentors do when they see something worth investing in.

(He also sent me one of the most difficult family law clients I’ve ever had, which is a large part of why I no longer do family law. So, thank you for that too, David.)

The Falling Out

Our relationship broke down over a meeting. Important people in the room, and David felt I didn’t have his back. He thought I’d sold out. That I was scared. He called me later to say so, with considerable foul language.

I told him plainly: I was not scared. I had survived twelve years in prison. I had served in combat. I hung up.

He called back. More of the same. The texts that followed were things I have long since deleted, but their essence remains. I was offended. Deeply. I blocked his number, and it has stayed blocked.

I am not going to pretend that didn’t happen. David was a complicated man. That’s part of his story. It is also part of mine.

Pickleball

Time passed. As it does. I saw him again at a training in Hamilton County. We talked briefly. It was civil. Maybe even warm. The way two people can be warm when they’ve decided, without saying so, to let something go for the moment. Besides, I’m not sure whether David held grudges.

I forgive you because you were a complicated man who did so many good things. You helped so many people, more than I ever have. Because you came to my wedding. Because you saw something in me worth mentoring. Because you sent me cases when I was building something from nothing. Because a magistrate told me you were one of the best he’d ever seen, and watching you work, I believed it.

I forgive you because the last image I have of you is a man leaving a meeting early to go play a sport he loved. And there is something right about that. Something human. But, most of all, I’m sorry for letting my hurt feelings prevent me from spending more time with you.

There are people who knew you far better than I did, David. They will tell your story with more laughs, more depth, more years behind the telling. They will honor you the way you deserve to be honored.

Last Friday night, January 30th, I did something I never thought I’d do as a criminal defense attorney: I watched a vigilante operate completely outside the bounds of lawful conduct, and I enjoyed it.

I’m talking about Tim Burton’s 1989 Batman film, shown in full glory at Clowes Memorial Hall with the local symphony performing Danny Elfman’s iconic score live. And let me tell you, if you haven’t experienced this yet, you’re missing out.

What I Expected vs. What I Got

Walking into Clowes Memorial Hall, I honestly didn’t know what to expect. I figured maybe they’d play some tribute music, show some clips, or do a medley of Batman themes. What I got instead was the full theatrical experience: Michael Keaton’s Cape Crusader on a massive screen, Jack Nicholson’s unhinged Joker causing chaos, and a live orchestra bringing Danny Elfman’s epic score to life.

And here’s where it gets wild: Elfman apparently composed this entire masterpiece on an airplane. In the bathroom of the airplane! Meanwhile, I need three monitors, two cups of coffee, and complete silence to draft a motion to suppress. Just kidding, it’s actually two monitors, a bottle of water and Blues music.

The symphony was so good that I found myself genuinely confused about whether the music was coming from the screen or the orchestra pit. I’d sit there, watch the musicians play, and think, “Wait, is that live? That can’t be live. That’s too perfect.” But it was. They absolutely nailed it.

Also, I got my picture taken with a guy dressed as Batman. So that happened. Clowes Memorial Hall is a fantastic venue, by the way, highly recommend it for any event.

The 35th Anniversary of a Cultural Phenomenon

This year marks the 35th anniversary of Burton’s Batman, and it still holds up. The dark, gothic aesthetic. Prince’s killer soundtrack mixing with Elfman’s orchestral drama. Kim Basinger as Vicki Vale. Billy Dee Williams as Harvey Dent (pre-Two-Face, unfortunately). And of course, the other famous Nicholson, Jack, stealing every scene as the Joker.

But as I sat there watching Bruce Wayne punch his way through Gotham’s underworld, the lawyer in me couldn’t help but start taking mental notes. Because from a legal standpoint, Batman is an absolute nightmare of constitutional violations, criminal conduct, and questionable self-defense claims.

So let’s break down the legal disaster that is Gotham City.

Harvey Dent: The Only One Doing This Legally

Let’s start with the good guy, legally speaking. Harvey Dent is Gotham’s District Attorney, and in the 1989 film, he’s still on the right side of the law. He’s trying to clean up the streets, prosecute criminals, and work within the system. He’s basically doing what every DA is supposed to do.

The problem? The system is so corrupt that even a good DA can’t get the job done. Which brings us to...

Corrupt Cops and the Joker’s Payroll

Officer Eckhardt is exhibit A in why internal affairs exists. This guy is actively on the Joker’s payroll, feeding him information, and helping him evade justice. In Indiana, that’s official misconduct, bribery, and probably conspiracy to commit murder.

When the Joker ultimately shoots Eckhardt, it’s almost poetic justice, except, you know, murder is still murder. But it does raise an interesting question: if a corrupt cop gets killed by the criminal he’s protecting, does anyone really lose?

(The answer is yes. Society loses. Rule of law matters. But you get my point.)

Batman’s “No-Kill” Rule: A Complete Lie in This Movie

Here’s where things get really interesting from a legal perspective. Batman is famous for his “no-kill” rule. It’s his whole thing. He doesn’t use guns. He doesn’t kill. He brings criminals to justice, but he doesn’t become an executioner.

Except in this movie, he absolutely kills people.

Let’s count the bodies:

The Bell Tower Thug

Remember when Batman throws a guy against the bell during the final showdown with the Joker? That guy falls all the way down from the top of the cathedral to the ground level. We’re talking hundreds of feet. He’s dead. There’s no way he survived that.

Legal Analysis: That’s at minimum manslaughter, possibly murder if you can prove intent. Batman used excessive force in a situation where he could have restrained the guy or used non-lethal methods.

The Joker

And then there’s the big one: Batman essentially kills the Joker. Yes, he tries to save him, he’s holding the Joker’s hand as they dangle from the cathedral. But then Batman ties a rope with a gargoyle statue attached to the Joker’s leg while the Joker’s trying to escape on the ladder hanging from the helicopter.

What did he think was going to happen?

The Joker’s helicopter lifts off, the rope goes taut, the gargoyle statue (which probably weighs several hundred pounds) pulls the Joker down, and he falls to his death.

Legal Analysis: This is where it gets murky. Batman could argue he was trying to prevent the Joker’s escape and didn’t intend to kill him. But any reasonable person would know that tying a heavy object to someone’s leg while they’re in a helicopter ladder would likely result in death.

In Indiana, that’s what we call “knowingly” causing death, which is murder under Indiana Code 35-42-1-1.

Defense of Others: Batman’s Strongest Legal Argument

Now, here’s where Batman’s defense attorney (if he had one) would make their stand: Defense of Others.

Throughout the movie, Batman intervenes to protect innocent people:

• Saving Vicki Vale: When the Joker threatens to kill her, Batman steps in. That’s textbook defense of others.

• Helping the Police: When Batman provides information to Commissioner Gordon or intervenes in crimes in progress, he’s arguably acting in defense of the community.

• The Final Showdown: When Batman confronts the Joker at the cathedral, the Joker is actively trying to kill Vicki Vale. Batman’s use of force (up to a point) is justified.

In Indiana, you’re allowed to use reasonable force to protect another person from imminent harm. The problem is that “reasonable force” has limits. You can’t use deadly force unless the person you’re protecting is facing serious bodily injury or death.

Batman’s actions at the cathedral? Probably justified under defense of others, right up until he ties that gargoyle to the Joker’s leg.

The Axis Chemicals Raid: Breaking and Entering with Style

Let’s talk about Batman’s raid on Axis Chemicals, the Joker’s lair where he’s manufacturing his poison products.

Batman drives the Batmobile straight through the facility, plants explosives, and blows the whole place up. It’s awesome cinematically. Legally? It’s a disaster.

Charges Batman Would Face:

• Breaking and Entering: He didn’t have a warrant. He wasn’t invited. He literally broke through the walls.

• Criminal Mischief: Destroying someone’s property (even a criminal’s property) is still a crime. In Indiana, if the damage exceeds $750, it’s a felony.

• Arson: Blowing up a building? That’s arson.

• Reckless Endangerment: There were people inside that facility. Batman’s actions could have killed them. And probably did!

Now, could Batman argue that he was preventing a greater harm? Maybe. There’s a defense called “necessity” where you can break the law if you’re preventing a greater harm. But that’s a tough sell when you’re blowing up buildings.

The Verdict: Would I Represent Batman?

As a criminal defense attorney, would I take Batman as a client? Absolutely.

Why? Because his actions, while technically illegal, were driven by a genuine desire to protect innocent people in a city where the justice system had failed. Harvey Dent, the only honest DA, couldn’t get convictions because of corrupt cops and a broken system.

Batman filled the gap. He operated in the gray area between law and justice.

And honestly? Some of his charges would be easier to defend than you’d think. Defense of others is a legitimate defense in Indiana. Necessity can work in extreme circumstances. And a good jury might just be sympathetic to a guy who’s trying to clean up a city overrun by a homicidal clown.

Final Thoughts: Go See This Concert

Look, I walked into Clowes Memorial Hall expecting a fun nostalgia trip. What I got was a phenomenal live music experience, a reminder of why this movie is a cultural touchstone, and a mental exercise in how badly Batman could lose in court.
