The core of this shift revolves around how the US government is choking off China&#8217;s access to raw AI infrastructure, while leaving standard software access relatively untouched.</strong></p><p>Here is why SaaS is back, and what you need to know about the new regulations reshaping the cloud landscape.</p><p><strong>The Catalyst: What is RASA?</strong></p><p>For years, US export controls were strictly physical: you couldn't ship a top-tier NVIDIA GPU to mainland China. But the laws were written for a pre-cloud era. Chinese AI labs realized they didn't need to <em>buy</em> the chips; they could just log onto the internet and <em>rent</em> them from data centers located outside of China.</p><p>To shut down this "cloud loophole," the U.S. House of Representatives overwhelmingly passed the Remote Access Security Act (RASA) on January 12, 2026.</p><p>RASA modernizes the Export Control Reform Act by granting the Bureau of Industry and Security (BIS) explicit statutory authority to regulate and restrict "remote access" to controlled technologies via cloud computing. In short: renting out an advanced AI chip via the cloud is now legally treated the same as physically packing it in a box and shipping it to Beijing.</p><p>The IaaS Crackdown: Bare Metal is the Target</p><p>The immediate impact of RASA and the Commerce Department's new "Know Your Customer" (KYC) rules falls squarely on Infrastructure-as-a-Service (IaaS).</p><p>To put this in real-world terms: Imagine a Chinese AI company trying to build a rival to ChatGPT. To do this, they need to spin up a massive cluster of NVIDIA H100s. Under the new rules, U.S. cloud providers like Amazon Web Services (AWS EC2), Microsoft Azure, and Google Cloud are legally barred from renting them this raw infrastructure.</p><p>These IaaS providers cannot give Chinese developers API keys that allow them to directly access advanced GPUs to run their own custom training scripts. However, the Chinese user never touches the raw compute. They cannot use Snowflake to train a massive, unauthorized foundation model from scratch; they simply send their data in, and the software spits the insights back out.</p><p>Because the Chinese user is buying a <em>software function</em> rather than <em>raw compute capacity</em>, companies like Snowflake and Databricks can legally sell these advanced services to Chinese clients. The US government is restricting the "picks and shovels" (the GPUs), but it is not restricting the gold (the software output).</p><p>The Investment Takeaway</p><p>The physical chip war evolved into a cloud computing war, and the U.S. government has made it clear that raw computing power is a matter of national security.
