The federal criminal case against the Southern Poverty Law Center in the Middle District of Alabama, involving 11 counts of wire fraud, false statements to a bank, and conspiracy to commit money laundering related to payments to informants in extremist groups from 2014–2023, remains the central factor. Indicted in April 2026 under the Trump administration, the organization entered a not guilty plea in May and saw its motion to dismiss on vindictive prosecution grounds denied by U.S. District Judge Emily Marks in August. A trial is scheduled for October. Traders appear to view conviction as unlikely given the contested evidentiary issues, the nonprofit’s established defense strategy, procedural timelines, and historical outcomes in comparable donor-fraud prosecutions, though a guilty verdict could still result from developments before year-end.
