The Tech Rotation Letter

These Terms govern your use of The Tech Rotation Letter (the “Newsletter”), including all free and paid content delivered by email, website, app, or any platform used to distribute it (the “Services”). By using the Services, you agree to these Terms.

1. Operator

Where you access the Services through a third-party platform, that platform’s terms may apply in addition. Mandatory statutory provisions always prevail.

2. What the Newsletter is

The Newsletter is an editorial publication. It contains general market commentary, charts, explanatory material, and discussion of a rules-based binary framework applied to a technology-weighted equity index, together with its signals and scenarios. It is addressed to a general readership and is not tailored to any individual reader.

We may change, pause, or discontinue any part of the Services, including format, frequency, features, and the framework itself.

3. No advice

The Services do not constitute investment advice within the meaning of Section 2 (8) of the German Securities Trading Act (WpHG), investment brokerage, portfolio management, or any other regulated financial service, nor legal or tax advice. Nothing in them is a personal recommendation, an offer, or a solicitation to buy, sell, or hold any financial instrument.

We do not take into account your financial situation, risk tolerance, objectives, knowledge, tax position, or jurisdiction, and we are not in a position to do so. Any decision you take is your own. We recommend obtaining individual advice from a qualified and licensed adviser before making any investment decision.

Content is prepared with reasonable care but may contain errors, may rely on third-party data that is delayed or inaccurate, and reflects the information available at the time of publication. We do not undertake to update it.

4. Signals, illustrations, and simulated results

The Newsletter may present positioning states, signal histories, charts, and backtested or simulated illustrations. These document the behaviour of a rules-based framework. They are illustrative, not instructions, and the Services are not a signal service.

Backtested and simulated results are hypothetical. No capital was placed at risk in producing them, they apply rules to historical data with the benefit of hindsight, and they generally do not account for transaction costs, spreads, slippage, taxes, or the prices actually available at the time. They are not a representation of what any reader achieved or would have achieved.

Execution timing, spreads, liquidity, taxes, fees, broker constraints, and personal risk limits can change real outcomes materially.

5. Risk

Financial markets involve risk, including the loss of some or all capital committed.

A technology-weighted index is concentrated by sector and, in practice, by a small number of large constituents. It can therefore fall further and faster than a broad market index and can underperform for extended periods.

A binary framework is either positioned or not positioned. It can be out of the market during a sustained advance, in the market during a sustained decline, and can produce a sequence of signals that each turn out to be wrong. Signals are generated from historical price data and necessarily follow rather than anticipate market moves.

Past performance, whether actual, simulated, or backtested, is not a reliable indicator of future results.

6. Conflicts of interest

The author may hold positions in the instruments discussed. Where a position is held in an instrument that is the subject of a publication, this is disclosed in that publication.

7. Subscriptions and billing

Prices and billing intervals are shown at checkout and may change for future billing periods, not for the current one. Unless stated otherwise, subscriptions renew automatically until cancelled. Payments may be processed and content delivered by third-party providers, and access may depend on their availability and account rules. You are responsible for keeping your account credentials confidential.

8. Right of withdrawal for consumers

Right of withdrawal. If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.

How to withdraw. To exercise your right of withdrawal, you must inform us by a clear statement of your decision to withdraw. Send this to Felix Faust, Kruppstraße 111, 40227 Düsseldorf, Germany, or faust118@outlook.de. You may use the model form in the Annex, but you are not required to do so.

Deadline. To meet the deadline, it is sufficient that you send your communication before the withdrawal period expires.

Effects. If you withdraw, we will reimburse all payments received from you without undue delay and no later than 14 days from the day we receive notice of your withdrawal. We will use the same means of payment you used for the original transaction unless expressly agreed otherwise. You will not be charged any fee.

9. Cancellation and refunds

You may cancel at any time, effective at the end of the current billing period, with access continuing until then. Beyond the right of withdrawal above and any other mandatory statutory rights, fees are not refunded unless we expressly grant a refund. Your statutory rights remain unaffected. If you initiate a chargeback, we may suspend access while the dispute is pending.

10. Content and permitted use

All content and branding within the Services is owned by or licensed to the Operator. For the duration of your subscription you receive a limited, personal, non-transferable, non-exclusive right to access it for your own private use.

You may not copy, republish, distribute, sell, sublicense, publicly display, or create derivative works from the content without our prior written permission, except where mandatory law permits. Paid content is for the individual subscriber; systematic sharing, forwarding, or publishing screenshots or substantial parts of it is not permitted.

You also agree not to circumvent paywalls or access restrictions, scrape or bulk download content, disrupt the Services or their platform providers, or post unlawful, abusive, or infringing content in any comment feature.

11. Third-party content and availability

The Services may reference third-party sources, links, charts, market data, or tools. We have no control over these and assume no responsibility for their accuracy or availability.

We take reasonable care to keep the Services available but do not owe uninterrupted availability. Your statutory rights in respect of defects in digital content remain unaffected.

12. Liability

We are liable without limitation for damage arising from injury to life, body, or health, for damage caused intentionally or by gross negligence, and under the German Product Liability Act.

In cases of slight negligence, we are liable only for breach of a material contractual obligation, meaning an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely. In such cases liability is limited to the foreseeable damage typical for contracts of this kind. Any further liability is excluded.

These limitations apply equally in favour of our legal representatives and vicarious agents. Subject to the two paragraphs above, decisions you take on the basis of the Services are your own and any resulting market outcome falls outside the scope of our contractual obligations.

13. Termination

We may suspend or terminate access where you have materially breached these Terms, where there is fraud or abuse, or where required by law or platform policy. Your statutory rights and any claim to a pro rata refund of prepaid fees in the event of unjustified termination remain unaffected.

14. Privacy

Information on the processing of your personal data is set out in our Privacy Policy, published on this publication. Where third-party platforms deliver content or process payments, their own privacy terms may apply in addition.

15. Changes to these Terms

We may amend these Terms where there is a valid reason, for example changes in the law or in the Services. We will notify you in text form at least six weeks before an amendment takes effect and will inform you that failure to object is treated as acceptance. You may terminate your subscription without notice up to the date the amendment takes effect.

16. Governing law

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, this choice does not deprive you of the protection of mandatory provisions of the law of that country (Article 6 of Regulation (EC) No 593/2008). Jurisdiction follows the applicable statutory provisions.

If any provision of these Terms is or becomes invalid, the remaining provisions are unaffected and the invalid provision is replaced by the applicable statutory provision.
