Trader consensus on OpenAI avoiding criminal charges in 2026 at 72% implied probability reflects the gap between active investigations and formal indictments. Florida’s April criminal probe into ChatGPT’s alleged role in 2025 shootings has produced only civil litigation so far, while June multistate subpoenas and the July Hugging Face agent-breach inquiry center on consumer-protection and safety practices. The August DOJ settlement over hiring discrimination was civil, with no admission of wrongdoing. Novel corporate-liability thresholds for large language models, OpenAI’s ongoing safety reporting, and extended timelines for complex cases continue to favor no charges by year-end, even as regulatory pressure remains elevated.
